COMBINED VOLUNTARY COOPERATION AND OPERATIONAL ASSISTANCE
MUTUAL AID AGREEMENT IN AND BETWEEN THE SIGNATORY LAW
ENFORCEMENT AGENCIES
This Voluntary Cooperation and Operational Assistance Mutual Aid Agreement
("Agreement")is made by and between the Signatory Law Enforcement Agencies,
including the municipal governments /corporations /political subdivisions located within
Miami-Dade County and the Constitutional Sheriffs Office for Miami-Dade County,each
having principal offices at the locations designated in their signature panels.The
Signatory Law Enforcement Agencies state as follows:
WHEREAS,it is the responsibility of the municipal governments /corporations /
political subdivisions located within the boundaries of Miami-Dade County,Florida,and
of the Miami-Dade County Sheriffs Office to ensure the public safety and welfare of
their citizens by providing adequate levels of public safety and police services to address
any foreseeable routine /emergency situation;and
WHEREAS,there exists a continuing possibility of the occurrence of situations /
issues,and other natural /manmade conditions that require law enforcement response
which are,or are likely to be,beyond the control of the capabilities,services,personnel,
equipment or facilities of one or more of the Signatory Law Enforcement Agencies;and
WHEREAS,the Signatory Law Enforcement Agencies must ensure their
preparations and operations will be adequate to address any and all of these conditions,
to protect the public peace,safety and security,and to preserve the lives and property of
the people of Miami-Dade County,Florida and of the municipal governments /
corporations/political subdivisions located within Miami-Dade County;and
WHEREAS,the Signatory Law Enforcement Agencies are so located in relation to
each other that it is in the best interest and advantage of each to receive and extend
mutual aid in the form of law enforcement services and resources to adequately respond
to:
(1)Continuing,multi-jurisdictional criminal activity,so as to protect the public
peace and safety,and preserve the lives and property of the people;and
(2)Intensive situations including,but not limited to,natural or manmade
disasters or emergencies as defined under Section 252.34,Florida Statutes;and
(3)Joint provision of law enforcement services specified herein and allowed
pursuant to Section 166.0495,Florida Statute;and
WHEREAS,the Signatory Law Enforcement Agencies have the authority under
the Florida Mutual Aid Act,Chapter 23,Part I,Florida Statutes,to enter into a Mutual
Aid Agreement for law enforcement services,which both:
(1)Permits voluntary cooperation and operational assistance of a routine law
enforcement nature across jurisdictional lines;and
(2)Provides for rendering of assistance in a law enforcement emergency.

NOW ,THEREFORE,BE IT KNOW N,that the Signatory Law Enfo rcem ent
Agencies,and their respective political subdivisions of the State of Florida,in
conside ratio n of m utual prom ises to render valuable aid in daily operations and in tim es
of ne cessity,do hereby agree to fully and faithfully abide by and be bound by the
follow ing term s and conditions:
1.Provisions fo r Voluntary Cooperation:the Signatory Law Enforcem ent
Age ncies hereby approve and enter into this Agreement whereby each of these
age ncies may provide voluntary cooperation and assistance of a ro utine or
em e rge ncy law enforcem ent nature acro ss jurisdictional lines.The nature of the
law enfo rcem ent assistance to be rendered shall include but is not lim ited to:
A.C oncurrent law enfo rcem ent jurisdiction in and throughout the
jurisdictional lim its of the Signatory Law Enforcement Agencies for
arrests,m ade pursuant to the law s of arrest,fo r felonies and
m isdem eanors,including arrestable traffic offenses,which spontaneously
take place in the presence of the arresting officer,at such times as the
arresting officer is traveling from place to place on offi cial business
outside of their jurisdiction (e.g.,to /from court,vehicle m aintenance run,
any authorized use /operation,per agency policy,of their law
enfo rcem ent vehicle).
B .C oncurrent law enforcem ent jurisdiction in and thro ughout the
jurisdictional lim its of the Signatory Law Enfo rcem ent A gencies fo r
arrests,m ade pursuant to the law s of arrest,of persons identified because
of investigations of any offense constituting a felony,violent misdemeanor
or any act of Dom estic Violence as defined in Section 7 41.28,Florida
Statutes,when such offense occurred within the jurisdiction of the agency
em ploying the arresting officer.
C .C oncurrent law enfo rcem ent jurisdiction in and upon the jurisdictional
w aters of the Signatory Law Enforcem ent Agencies,fo r arrests,made
pursuant to the law s of arrest,fo r felonies and m isdemeanors and fo r
boating infractions.
D .C oncurrent law enfo rcem ent jurisdiction fo r certain exigent situations,
w ithout the need fo r a fo rm al request,including,but not lim ited to,area
searches for wanted subjects,perim eters,crim es in progress,escaped
prisoners,requests fo r assistance when no available local units are
nearby,calls indicating a crim e or incident has occurred in which a citizen
m ay likely be injured and the assisting m unicipality is closer to the area
than the officer receiving the call.
E.C oncurrent law enfo rcem ent jurisdiction in and throughout the
jurisdictional lim its of the Signatory Law Enforcement A gencies,for
investigations of,but not lim ited to,hom icides,sex offenses,robberies,
assaults,batteries,burglaries,larcenies,frauds,gam bling,m otor vehicle
thefts,drug violations pursuant to Chapter 893,Florida Statutes,Intern al
A ffairs,and m ulti-agency task fo rces /joint investigations.

F.Flagrant violations of Traffic Laws,that left unchecked could reasonably
lead to the injury of people on /around the roadway upon which the
violation is occurring (e.g.speeding through a school zone or weaving
through heavy traffic).
Prior to any officer taking enfo rcement action pursuant to paragraphs (A)through
(F)above,the officer shall notify the jurisdiction in which the action will be taken,
unless exigent circumstances prevent such prior notification,in which case
notification shall be made as soon after the action as practicable.If the agency
having normal jurisdiction responds to the scene,they will have the absolute
authority to decide w hether to take over the situation.If the agency of normal
jurisdiction decides to take over,then the assisting agency's officer(s)shall offer
and are required to provide any assistance requested.The assisting agency's
officer(s)shall,at a minimum ,author a follow-up written report docum enting the
event and the actions taken.
These provisions are not intended to grant general law enforcem ent operational
authority,or to respond without request to emergencies already being addressed
by the agency of normal jurisdiction,but is intended to address critical,life-
threatening,or public safety situations,prevent bodily injury to citizens,or secure
apprehension of criminals w hom the law enforcement officer m ay encounter.
2.Provisions fo r O perational Assistance:the Signatory Law Enfo rcem ent
Agencies approve and enter into this Agreem ent whereby each of these
agencies may request /render law enfo rcement assistance to the other to
include,but not necessarily lim ited to,the fo llowing:
Joint m ulti-jurisdictional crim inal investigations.
Civil affray or disobedience,disturbances,riots,
demonstrations,controversial trials,political conventions,
and strikes.
C.Any natural,technological,or m anm ade disaster.

D.Incidents which may require rescue operations /crowd /traffic control
measures,including,but not limited to,large-scale evacuations,aircraft
and shipping disasters,fires,explosions,gas line leaks,radiological
incidents,train w recks and derailm ents,chem ical or hazardous waste
spills,and electrical power failures.
E.Terroristic activities including,but not limited to,acts of sabotage.
F.Escapes fro m or disturbances within detention facilities.
G.Hostage and barricaded subject situations,and aircraft piracy.
H.Control of major crime scenes,area searches,perim eter contro l,backups
to emergency and in-progress calls,pursuits,and missing persons calls.
I.Enem y attack/Active Shooter/Active Assailant.
J.Transportation of evidence requiring security .
K.M ajor events (e.g.,sporting events,concerts,parades,fairs,festivals,and
conventions).
L.Security and escort duties for dignitaries.

P.Exige nt situations w ithout a fo rm al request which occur I arise from
spontaneous occurrences (i.e.area searches fo r wanted subjects,
perim eters,crim es in progress,escaped prisoners;traffi c stops near
m unicipal boundaries,request fo r assistance and no local unit is available
or nearby,calls or transm issions indicating an officer is injured,calls
indicating a crim e or incident has occurred in which a citizen m ay likely be
injured and the assisting agency is closer to the area than the offi cer
receiving the call,active shooter I assailant situations).

w aters of the Signatory Law Enfo rcem ent Agencies.

S .Im paired D riving Investigations,including all aspects of D UI,BUI,and DRE.
T .Extra-D uty D etails /S pecia l Events.
3.Procedure for Requesting Operational Assistance:
A.If a S ignatory Law Enfo rcem ent A gency needs assistance,the Chief
E xecutive,or de signe e ,of the law enforcem ent agency requiring
assistance shall notify the agency from w hich such assistance is
reque sted.The C hief Executive,or designee,whose assistance is sought
shall evaluate the situatio n and available resources and will respond in a
m a nner deem ed appropriate.This authority m ay be granted either verbally
or in w riting as the situatio n dictates.
B .S ig natory Law Enfo rcem e nt A gencies agree to furn ish necessary
m a npow er,equipm e nt,facilities,and other resources and to render
se rv ices to the reque sting part y(ies)as required to assist in addressing the
situation w hich caused the reque st;provided,how ever,that no Signatory
Law Enforcem ent Age ncie s shall be required to unreasonably deplete its
ow n m anpow er,equipm e nt,facilities,and other resources and serv ices in
rendering such assistance.
C .S pecific reporting instructions for personnel rendering m utual aid will be
included in the reque st for m utual aid.In the absence of such reporting
instructions,assisting personnel will report to the ranking superv isor on
the scene .
D .C om m unications instructions should be included in each request for
m utual aid and each responding agency's com m unications centers will
ende avor to maintain radio /telephone /other as appropriate contact with
each other until the m utua l aid situation has ended.

E.Incide nts requiring m ass pro cessing of arrestees,transporting prisoners,
and operating tem porary detention facilities will be handled per
established procedures of the requesting agency or the direction of the
Incide nt C om m a nde r.
F.Age ncy H e ads of Signatory Law Enfo rcem ent Agencies,or their
de signees,shall establish procedures for transferring control of the
m ission and for transferring tactical control of any assigned task,and
superv isory control over personnel or equipm ent provided pursuant to this
A greem e nt.
4.C om m a nd and S u p e rv isory R espo nsibility :
A C om m and:The personnel and equipm ent that are assigned by the
Assisting Agency shall be unde r the im m ediate com m and of a superv ising
offi cer de signated by the A ssisting Agency.Such superv ising offi cer shall
be unde r the direct superv ision and com m and of the C hief Executive or
designee of the age ncy requesting assistance.
B .C onflicts:W he never an off icer is rendering assistance pursuant to this
Agreem e nt,the off icer shall abide by and be subject to the rules and
regulations,pe rsonnel policies,general orders,and standard operating
procedures of their em ployer.If any such rule,regulation,personnel
policy,ge ne ral orde r or standing operating procedure is contradicted,
contravened or othe rw ise in conflict with a direct order of a superior officer
of the requesting age ncy,then the rule,regulation,policy,general order or
procedure of the assisting offi cer's agency shall contro l and w ill supersede
the direct orde r.
C .H andling C om plaints:For any com plaints that are generated because of a
cooperative effort unde r this Agreem ent,the C hief Executive,or designee,
of the age ncy em ploying the subject offi cer shall be responsible fo r the
investigatio n of the com plaint.T he C hief Executive,or designee of the
reque sting age ncy (receiving the com plaint)should,at a m inim um ,
determ ine:
1.T he ide ntity of the com plainant.
2.C o ntact info rm ation fo r the com plainant.
3.T he spe cific allegation.
4.T he identity of the accused em ployee(s)without regard as to
age ncy affi liation.
If,during the investigation,it is determ ined that the subject offi cer is an em ployee
of the Assisting Age ncy,all inform ation and pertinent docum entation gathered
du ring the receipt and pro cessing of the com plaint,shall be forw arded,without
de lay,to the su bject offi cer's em ploying agency for adm inistrative review .The
R eque sting Agency m ay conduct a review of the com plaint to determ ine if any
factua l basis for the com plaint exists and /or whether any of the em ployees of
the R eque sting Agency violated any of their respective policies /pro cedures.

5.Powers,Privileges,Immunities,and Costs:
A.All certified law enfo rcem ent em ployees,as defined in Chapter 943,
Florida Statutes,of Signatory Law Enfo rcem ent A gencies,during such
tim e that said em ployees are actually providing aid outside of the
jurisdictional lim its of the em ploying agency pursuant to the terms of this
Agreem ent,shall pursuant to the pro visions of Chapter 23,Florida
Statutes,have the sam e powers,duties,rights,privileges,and im m unities
as if they were perform ing their duties in the political subdivision in which
they are regularly em ployed.
B.The political subdivision having financial responsibility for the law
enfo rcem ent agency providing the services,personnel,equipment,or
facilities pursuant to the provisions of this A greement shall bear any loss
or dam age to sam e and shall pay any and all expenses incurred in the
m aintenance and operation of sam e.
C .The political subdivision having financial responsibility for the law
enfo rcem ent agency providing aid pursuant to this Agreement shall
com pensate its em ployees pro viding serv ices pursuant to this Agreement,
during the tim e of rendering of such serv ices,and shall defray the actual
travel and m aintenance expenses of such employees while they are
rendering such aid.Such com pensation shall include any am ounts paid or
due for com pensation due to personal injury or death while such
em ployees are engaged in rendering such aid.Such com pensation shall
also include all benefits norm ally due such em ployees.
D .All privileges and im m unities from liability,exem ptions fro m laws,
ordinances and rules,and all pension,insurance,relief,disability,works
com pensation,salary ,death,and other benefits which apply to the activity
of such officers,agents,or em ployees of any such agency,when
perform ing their respective functions within the jurisdictional lim its of the
em ploying agency,shall apply to the sam e degree,manner,and extent
w hile engaged in the perform ance of their functions and duties
extraterritorially under the pro visions of this A greem ent.The provisions of
this A greem ent shall apply with equal effect to paid,volunteer,reserv e,
and auxiliary em ployees.
E .N othing herein shall prevent the requesting agency from seeking
supplem ental appropriations from the govern ing authority having
budgeting jurisdiction to reim burse the assisting agency fo r any actual
costs or expenses incurred by the assisting agency performing hereunder.
6.Liability:Each S ignatory Law Enforcem ent Agency engaging in any cooperation
and assistance pursuant to this A greem ent,agrees to assume responsibility fo r
the acts,om issions or conduct of their ow n em ployees while engaged in
rendering serv ices pursuant to this M utual Aid A greement,subject to the
pro visions of Section 768.28,Florida Statutes,w here applicable.Nothing in this
Agreem ent shall be deem ed or treated as a waiver of any im m unity to which any
party is entitled by law ,incl uding but not lim ited to the sovereign im munity
protections as set fo rt h in Section 768.28,Florida Statutes.

7.Insurance:Each Signatory Law Enforcem ent Agency shall provide,upon
request,satisfactory proof of liability insurance by one or more of the means
specified in Section 768.28,Florida Statutes.
8.Forf eitures:W hile operating under the auspices of this Agreement,property
subject to fo rfeiture under Sections 932.701 -932.707,Florida Statutes,known
as the "Florida Contraband Forfeiture Act,"may be seized.The agency initiating/
pursuing the forfeiture action shall have the exclusive right to control,and the
responsibility to m aintain the property in accordance with Chapter 932,Florida
Statutes,including,but not be lim ited to,the complete discretion to bring the
action or dism iss the action.The proceeds from seized property that is
successfully forfeited shall be distributed equitably among the participating
agencies in proportion to the amount of investigation and participation performed
by each agency,pursuant to the provisions of the Florida Contraband Forfeiture
Act,less the costs and attorney's fees associated with the forfeiture action.The
political subdivision /agency controlling the forfeiture may allow another
Signatory Law Enforcem ent Agency to prosecute the forfeiture,subject to the
written authorization of the Chief Executive and the legal counsel for each of the
participating Signatory Law Enforcem ent Agencies.
9.C onflicts:Any conflict betw een this Agreement and the Florida Mutual Aid Act
will be controlled by the provisions of the latter,whenever conditions exist that
are w ithin the definitions stated in Chapter 23,Florida Statutes.
10.Eff ectiv e D ate and Duration:This Agreement shall be in effect upon execution
and approval by the hereinafter named officials of the Signatory Law
Enforcem ent Agencies and their respective political subdivisions (where
applicable)and shall continue in full force and effect until January 1,2035.
Under no circumstances may this Agreem ent be renewed,amended or extended
except in writing.
11.S up ersed u re:Upon execution and approval by the hereinafter named officials of
the Signatory Law Enforcem ent Agencies and their respective political
subdivisions (where applicable),this Agreem ent will supersede any and all such
agreem ent(s)of this nature and type,becoming the controlling document in
consideration of m utual promises to render valuable aid in daily operations and in
times of emergency,setting the terms and conditions by which the Signatory Law
Enforcem ent Agencies will be bound.
12.N o ne xclusive Privilege:Nothing herein shall preclude any Signatory Law
Enforcem ent Agency from form ulating additional specialty MOU /MAA with other
Signatory Law Enforcement Agencies for the benefit of their collective
operations.In instances where the terms /conditions of such specialty MOU /
MAA overlap with the terms and conditions of this Agreement,the terms and
conditions of this Agreem ent will take priority and bind the Signatory Law
Enforcement Agencies.
13.C a nce llatio n:Participation in this Agreement may be terminated by any
Signatory Law Enforcement Agency and their respective political subdivision
(w here applicable)upon ninety (90)days written notice to the other Signatory
Law Enforcem ent Agencies.

WHEREAS,it is the responsibility of the respective governments of the City of Miami
Beach and the City of Miami Beach Police Department and the Village of El Portal,Florida City,

Florida International University,Florida,to ensure the public safety of their citizens by providing
adequate levels of police service to address any foreseeable routine or emergency situation;
and
WHEREAS,the existence of,and continuing possibility that there may be the
occurrence of law enforcement problems,and other natural and man-made conditions which
are,or are likely to be,beyond the control of services,personnel,equipment,or facilities of the
City of Miami Beach Police Department,and respective police departments for the Village of EI
Portal,Florida City,City of Hialeah,Village of Bal Harbour,Indian Creek Village,Village of Key
Biscayne,Miami Shores Village,Town of Bay Harbor Islands,City of North Miami,City of North
Miami Beach,Village of Pinecrest,City of Biscayne Park,City of Coral Gables,Town of
Surfside,City of Sweetwater,Village of Virginia Gardens,City of Doral,City of Hialeah Gardens,
Town of Medley,Miami-Dade School Board,City of Miami Springs,City of Aventura,
Miccosukee Tribe of Indians,City of Fort Lauderdale,City of Miami Gardens,City of South

WHEREAS,it is necessary to ensure that these law enforcement agencies will be
adequate resources to address any and all of these conditions,to protect the public peace and
safety,and to preserve the lives and property of the people of the City of Miami Beach,and the

Viiiage of Key Biscayne,Miami Shores Viliage,Town of Bay Harbor islands,City of North

the "Florida Mutual Aid Act,"to enter into Voluntary Cooperation and Operational Assistance
Mutual Aid Agreements.

Clerk are authorized to execute Mutual Aid Agreements with the following governmental

ANALYSIS
The City Attorney's Office and the Miami Beach Police Department (MBPD)are requesting
Commission approval for the City Manager and City Clerk to execute Mutual Aid Agreements
(MMA)to coordinate law enforcement planning,operations and assistance between the City of
Miami Beach and the following 32 municipalities:

The City of Miami Beach and these 32 municipalities have the authority under Chapter 23 of the
Florida Statutes,known as the "Florida Mutual Aid Act,"to enter into Voluntary Cooperation and
Operational Assistance Mutual Aid Agreements.
The City of Miami Beach and these 32 municipalities have previously executed such mutual aid
agreements,however,all are set to expire on or about December 31,2024.
Formal agreements are critical to ensure that the City of Miami Beach and these partner agencies
have adequate resources,personnel and equipment necessary to fully respond to an emergency
or routine public safety incident.
FISCAL IMPACT STATEMENT
None.
CONCLUSION
The Mutual Aid Agreements will benefit the City of Miami Beach.
