Resolution 2025-33470RESOLUTION NO 2025-33470 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AN ENHANCEMENT OF SUPPORT SERVICES. FOR CITY COMMISSIONERS WHO CURRENTLY HAVE ONLY ONE (1) LEGISLATIVE AIDE TO ENABLE THEM TO BETTER SERVE THE PUBLIC AND AUTHORIZING EACH SUCH COMMISSIONER TO DETAIN ADDITIONAL PROFESSIONAL SUPPORT, EITHER ON A FULL-TIME OR PART-TIME EMPLOYEE BASIS OR, IN THE ALTERNATIVE, AS AN INDEPENDENT CONTRACTOR FOR SUCH SERVICES IN ACCORDANCE WITH APPLICABLE CITY POLICIES AND PROCEDURES; FURTHER, PROVIDING THAT THE FISCAL IMPACT OF THIS MEASURE, PER COMMISSIONER, SHALL NOT EXCEED THE EQUIVALENT COSTS TO THE CITY FOR EMPLOYING A FULL-TIME LEGISLATIVE AIDE (APPROXIMATELY $120,000, INCLUSIVE OF SALARY, PENSION AND OTHER BENEFITS); AND FURTHER, WAIVING, BY 517TH VOTE, THE FINANCE AND ECONOMIC RESILIENCY COMMITTEE REVIEW REQUIREMENT IN ACCORDANCE WITH SECTION 2-14(D)(1)(A) OF THE CITY CODE. WHEREAS, the City of Miami Beach recognizes the importance of providing adequate resources to its elected officials to better serve the public and fulfill their duties; and WHEREAS, it is essential for Commissioners to have sufficient support to effectively carry out their legislative duties, engage with constituents, and address public concerns, based on their needs; and WHEREAS, enhancing staff support for Commissioners would greatly improve the efficiency and effectiveness of the Mayor and City Commissioners in carrying out their responsibilities, including but not limited to legislation and constituent affairs; and WHEREAS, on March 13, 2024, the Mayor and City Commission adopted Resolution No. 2024-32956, authorizing each City Commissioner to retain additional professional support, provided that the fiscal impact of this measure, per commissioner, shall not exceed $120,000, inclusive of salary, pension and other benefits at initial hiring of an employee, and waiving, by 5/7th vote, the requirement in section 2-14(d)(1)a of the City Code to refer any agenda items in excess of $75,000 to Finance and Economic Resiliency Committee; and WHEREAS, for efficiency, Resolution No. 2024-32956 provided that each member of the City Commission shall notify the Mayor within 30 days from the adoption of the Resolution of their decision whether or not to avail themselves of the allocation for additional staff support to allow the Finance Department to determine if the allocation could be funded from existing departmental funds, or to otherwise prepare the appropriate budget amendment for City Commission approval; and WHEREAS, after the adoption of Resolution No. 2024-32956, the City's Fiscal Year ("FY") 2024 budget was amended to allocate funding for all Commissioners should they elect to avail themselves of the additional staff support; and WHEREAS, within the thirty (30) day timeframe, only Commissioners Fernandez and Magazine opted to avail themselves of the allocation for additional staff support; and WHEREAS, on June 26, 2024, the Mayor and City Commission adopted Resolution No. 2024-33125, directing the Administration to include funding in the FY 2025 budget process to allow for additional staff support for Commissioners Laura Dominguez and David Suarez; and WHEREAS, the FY 2025 Budget does not include funding for second City Commission legislative aides that were not previously requested during FY 2025 budget process; and WHEREAS, for efficiency purposes, each member of the City Commission who currently has only one (1) legislative aide shall notify the Mayor within 30 days following the adoption of this Resolution of their decision to either accept or decline the allocation for additional staff support to allow the Finance Department to determine if the allocation could be funded from existing departmental funds or to otherwise prepare the appropriate budget amendment for City Commission approval; and WHEREAS, the Mayor and City Commission further wish to waive, by 5/71h vote, the requirement in Section 2-14(d)(1)a of the City Code for review by the Finance and Economic Resiliency Committee of agenda items in excess of $75,000. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve an enhancement of support services for City Commissioners who currently have only one (1) legislative aide to enable them to better serve the public and authorize each such Commissioner to retain additional professional support, either on a full-time or part-time employee basis or, in the alternative, as an independent contractor for such services in accordance with applicable city policies and procedures; further, providing that the fiscal impact of this measure, per Commissioner, shall not exceed the equivalent costs to the city for employing a full-time legislative aide (approximately $120,000, inclusive of salary, pension and other benefits); and further, waive, by 5/7th vote, the Finance and Economic Resiliency Committee review requirement in accordance with section 2-14(d)(1)(a) of the City Code.
