95-21855 RESORESOLUTION NO. 95-21855 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA ACCEPTING A DONATION OF ONE HUNDRED (100), TWELVE FOOT (121) AFRICAN MAHOGANY TREES FROM TALLAHASSEE BUILDING CORPORATION DIB/A THE MIAMI BEACH MARINA SUBJECT TO THE NEGOTIATION OF AN AGREEMENT BETWEEN THE PARTIES GOVERNING THE TERMS AND CONDITIONS OF THE DONATION. WHEREAS, the Tallahassee Building Corporation d/b/a the Miami Beach Marina ("TBC") has expressed its desire to enhance and beautify the City of Miami Beach by offering to donate one hundred (100), twelve foot (12') African Mahogany trees to the City of Miami Beach ("City"); and WHEREAS, the trees will be donated to the City free of charge; and WHEREAS, aceeptance of this donation is subject to the negotiation of an agreement between the parties for the terms and conditions of the donation. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA as follows: The donation from TBC of one hundred (100), twelve foot (12') African Mahogany trees is hereby accepted subject to the negotiation of an agreement between the City and the Miami Beach Marina governing the terms and conditions of the donation. 2. The Mayor and City Clerk are herein authorized to execute the Agreement between the parties for the terms and conditions of the donation when negotiated. The Miami Beach Marina in turn subleased a portion of the property to Nick's Restaurant. Recently, that restaurant closed, and the Miami Beach Marina entered into negotiations with Monty's on the Beach, Ltd., for the subleasing of the subject property to Monty's Restaurant. Under the terms of our lease with the Miami Beach Marina, the City has the right to approve any sublease assignment, such as the one from Nick's to Monty's. In connection with that approval, both the Miami Beach Marina and Monty's on the Beach were requested to donate trees for placement throughout the City of Miami Beach. The negotiations between the Miami Beach Marina and Monty's having now been concluded with the execution of a new sublease, which I have approved after receiving advice of the City Attorney, both the tenant (Miami Beach Marina) and the new subtenant (Monty's on the Beach) have generously agreed to donate 100 African Mahogany trees to the City of Miami Beach, to be planted by the donors at their own expense. The attached Resolutions accept the donations. CONCLUS„ ON: The Commission should accept the generous donation of 100 trees each from Miami Beach Marina and Monty's On The Beach.
