WHEREAS, the Mayor and City Commission of the City of Miami
Beach, Florida wish to insure the comfort and well being of all
City Hall personnel.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that Commencing on
June 7, 1995 and throughout the months Of June, July and August of
1995, guayabaras (with or without bow ties) are hereby officially
proclaimed as appropriate summer attire for all City Hall
personnel.

THE MAYOR AND CITY CLERK TO EXECUTE A LETTER
OF AGREEMENT BETWEEN THE CITY AND ROBERT K.
SWARTHOUT, INCORPORATED, FOR PROFESSIONAL
SERVICES TO ASSIST THE CITY IN THE PREPARATION

REQUIRED WITH RESPECT TO THE MIAMI BEACH
COMPREHENSIVE PLAN.
WHEREAS, the City of Miami Beach ("City") contracted with Robert K. Swarthout,
Incorporated ("Swarthout') on July 22, 1992 to provide services relating to the preparation
of the City of Miami Beach Comprehensive Plan ('Plan"), and
WHEREAS, related additional services are now required of Swarthout to prepare
an Evaluation and Appraisal Report of the Plan to comply with Section 163.3191, Florida
Statutes, and
WHEREAS, the Evaluation and Appraisal Report will include those matters as
specifically set forth in the scope of work section of the Letter of Agreement which is
attached. and
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Clerk
are authorized to execute the attached Letter of Agreement between the City of Miami
Beach and Swarthout, whereby Swarthout will provide additional services in conjunction
with the preparation of an Evaluation and Appraisal Report on the City's Plan as required
by State law.

of the City's Comprehensive Plan
The Administration recommends approval authorizing the Mayor and
City Clerk to execute this Letter of Agreement.
BACKGROUND
The City of Miami Beach is required, under Florida Statutes, to
prepare an Evaluation and Appraisal Report of its adopted
Comprehensive Plan. The City has received a grant for $20,224 to
undertake the first phase of this EAR which is to be completed by
August of this year. Robert K. Swarthout, Inc. has already been
contracted to do this work.
The second and final phase of the project, due in November,
requires further analysis of the findings under the first phase,
including the following

Results
Major Problems of Development, Physical Deterioration,
Location of Land Area and Social and Economic Effects of
the Main Problems Identified
- Unanticipated and Unforeseen Problems and Opportunities

ANALYSIS
Robert K. Swarthout, Inc. is best suited to undertake this work as
this company is familiar and fully conversant with all issues
related to the City's Comprehensive Plan. The additional $10,000
is a reasonable fee for the work to be done under Phase II which is
expected to be fairly time consuming and rigorous in terms of the
required details expected by the Florida Department of Community
Affairs.
CONCLUSION
The Administration has concluded that this additional Evaluation
and Appraisal work must be done in a timely and professional manner
and that Robert K. Swarthout, Inc. is capable of completing it
successfully. Therefore, we believe that the Commission should
authorize the exemption of the Letter of Agreement to have this
work done.

Dear Mr. Dellagloria:
This is a Letter of Agreement by which Robert K. Swarthout, Incorporated
will provide professional services to assist the City of Miami Beach in the
preparation of an Evaluation and Appraisal Report (EAR) for the Miami
Beach Comprehensive Plan. This Letter of Agreement supplements the
contract between Robert K. Swarthout, Incorporated and the City of Miami
Beach dated July 22, 1992. Under this Letter of Agreement, Robert K.
Swarthout, Incorporated will provide related additional services described
herein for a fee set forth herein.
Scope of Work
The Evaluation and Appraisal Report will assess and evaluate the City of
Miami Beach Comprehensive Plan. It will address the validity of the plan's
projections, the realization of the plan's goals and objectives, and the
implementation of the plan's policies. The Evaluation and Appraisal
Report will address changes in local conditions that should be considered in
revising the plan. It will evaluate the effect on the comprehensive plan of
changes to the state comprehensive plan, changes to Chapter 163, Part II,
F.S., changes to Chapter 9J-5, F.A.C., and changes to the South Florida
regional policy plan. It will include draft goal, objective and policy
revisions. It will also include maps, schedules, and procedures as set forth
in Section 163.3191, F.S., and Rule 9J-5, F.A.C.
The specific content of the EAR is set forth below.
(1) Condition of Each Element at the Time of Adoption
(a) Summaries of data and analysis from each element of the
existing adopted plan.
(2) Condition of Each Element at the Date of Report

(a) Summaries of each element describing current conditions;
(b) A summary of all land use text and map amendments and all
other major text amendments made to the plan;
(c) A new existing land use map and table of existing land uses for
current conditions as of the date of the report;
(d) A new existing traffic circulation map; and
(e) A summary of the condition and quality of all natural
resources.
(3) Comparison of the Plan's Adopted Objectives with Actual Results
(a) Comparison of the objectives, including specific and
measurable targets, to the actual results and conditions.
Determine whether the objective was achieved.
(4) Major Problems of Development, Physical Deterioration, Location of
Land uses and the Social and Economic Effects of the Major
Problems Identified.
(a) The accuracy and use of the population projections;
(b) Actual vs. anticipated rate of development;
(c) The effect of cencurrency requirements;
(d) The maintenance and/or achievement of adequate Level of
Service Standards;
(e) Coordinating with development the provision of public facilities
and services;
(f) The actual vs, projected revenues and expenditures regarding
capital improvements;
(g) The generation and status of new revenue sources;
(h) Physical deterioration of public building, utilities,
infrastructure, recreation facilities, and parks, and the need for
replacement or rehabilitation;

(i) Physical deterioration of buildings and structures in the
commercial, and industrial land use categories;
(j) Physical deterioration of the housing stock, including mobile
homes;
(k) The location of development with regard to existing
infrastructure;
(1) The location of development in relation to where development
was anticipated in the adopted plan, such as within areas
designated for urban growth;
(m) The location of development in relation to its compatibility with
safety and evacuation in coastal high hazard areas;
(n) The location of development in relation to the maintenance of
environmentally sensitive areas; and
(o) The social and economic effects of the major problems
previously identified by providing a description of the effect.
(5) Unanticipated and Unforeseen Problems and Opportunities Which
Occurred Since Adoption
(a) Provide a description of the unforeseen problems and/or
opportunities and their impact on the comprehensive plan.
(6) Effect on the Local Comprehensive Plan:- The report shall assess
the consistency of the comprehensive plan with:
(a) Changes to state Comprehensive Plan since 1955;
(b) Changes to appropriate strategic regional policy plan;
(c) Changes to Rule 9J-5, F.A.C.; and
(d) Changes to Chapter 163, Part II, F.S.
(7) Identification of any Needed Actions to Address the Planning
Issues Raised in the Report
(a) New, revised, minimum 5-year and minimum 10-year time
frames and population projections;

(b) New and revised goals, objectives and policies;
(c) Revised future conditions maps;
(d) New capital improvements elements;
(e) Other actions, such as monitoring and evaluation procedures;
and
(f) Studies to be completed.
(8) Identification of Proposed or Anticipated Plan Amendments to
Address or Implement the Identified Changes
(a) Identify proposed or anticipated plan amendments; and
(b) Provide a schedule for transmittal and adoption of the plan
amendments identified in the previous section.
(9) The Public Participation Process
(a) Describe the public participation process used in the
preparation of the report.
The above scope of work shall be completed only to the extent necessary to
meet the minimum statutory requirements for Evaluation and Appraisal
Reports. Study and analysis of new planning issues, new goals, new
objectives and new policies over and above the minimum necessary to
address basic Evaluation and Appraisal Report criteria will be undertaken,
if at all, pursuant to another agreement. Study of the impact of the recently
enacted Private Property Rights Act is not included in the above scope of
work. The above scope of work will be completed in a professional manner
consistent with the firm's usual standards and the consulting fee limits set
forth below. Robert K. Swarthout, Incorporated will make a good faith
effort to fully satisfy the Florida Department of Community Affairs
requirements for EARS, but the firm does not guarantee that it will be able
to do so within the consulting fee limits set forth below. Robert K.
Swarthout, Incorporated and the City acknowledge that this is a departure
from the firm's previous practice in fulfilling Florida Department of
Community Affairs requirements on behalf of the City. This departure is
made in order to permit Robert K. Swarthout, Incorporated to offer its
professional services for the smallest possible fee and in the hope but not
confidence that this fee will be sufficient to allow the firm to fully satisfy the
Florida Department of Community Affairs. Robert K. Swarthout,
Incorporated will provide a first draft and a revised draft of all text. The

firm will provide working copies of all maps. The City will prepare final
copies of all required maps. The firm will be paid based on vouchers for
hours and expenses incurred to prepare work products delivered to the
City.
Consulting Fees
The scope of work described above will be performed at the firm's standard
hourly rates plus direct expenses, except that the magnitude of the work
and the total fee authorized shall not exceed $30,224.00 without further
authorization from the City. The firm's standard hourly rates range from
$50.00 for technical support work to $120.00 for Mr. Swarthout's time.
We can commence work as soon one copy of this letter has been signed by
the appropriate city official and returned to our offices.
