BANK ACCOUNTS AND BONDING: Grantee shall maintain all monies received pursuant to this .Agreement in an account with a bank or savings and loan association that Is treated in Miami -Dade County. the Grantee shall provide the City with the name of the bunk or savings and loan association, as well as the name and title of all individuals authorized to withdraw or write chocks on Grant funds. 1 I. Any claim for double payment by Grantee shall be a material breach of this Agreement. 12. INSPECTOR GENERAL AUDIT RIGHTS: A. Pursuant to Section 2--256 of the Code of the City o1 Miami Beach, the City has established the Office of the Inspector General which may, on a random basis, perform reviews, audits, inspections and investigations on all City contracts, throughout the duration of said contracts. 111ie random audit is separate and distinct from any other audit performed by or on behalf of the City. H. The Office of the Inspector Genial is authorized to investigate City affairs and empowered to review past, present and proposed City programs, accounts, records, contracts and transactions In addition, the Inspector General has the power to subpoena witnesses, administer oaths, require the production of witnesses and monitor City projects and programs. Monitoring of an existing City project or program may include a report concerning whether the project is on time, within budget and in conformance with the contract documents and applicable law. The Inspector General shall have the power to audit, investigate, monitor, oversee, inspect and review operations, activities, performance and procurement process including but not limited to project design, bid specifications, (bidfproposap submittals, activities of the Grantee , its officers, agents and employees. lobbyists, City stafiand elected officials to ensure compliance with the contract documents and to detect fraud and corruption. Pursuant to Section 2-318 of the City Code, the City is allocating a pet acinage of its overall annual contract expenditures to fund the activities and operations of the Office of Inspector General. C. Grantee's failure to comply with this paragraph may preclude future grant funding from the City, in the same manner as if Grantee defaulted under this 4grcemen. Grantee expressly understands and agrees that any insurance protection required by this Agreement, or otherwise provided, shall in uo way limit its obligation, as set forth herein, to indemnify, defend and hold harmless the City or its officers, employees, agents, and contractors as herein provided. If the Grantee is a gocenmlent entity, this indemnification shall only he to the extent and within the limitations of Section 768.28, Flonda Statues, subject to the provisions of that Statute, whereby the Grantee entity shall not be held liable to pay a personal injury or property damage claim orjudgment by any one person which exceeds the sum of $200,000, or any claim or judgment or portions thereof. which, when totaled with all other claims or judgments paid by any govemntenl ontny arising out of the same incident or occurrence. exceed the sum of 5300,000 from any and all personal injury or property damage claims, liabilities, losses or causes ofaction which may arse as a result ofthe negligence ofthe Grantee entity. 15. ASSIGNMENT: The Grantee shall not he permitted to assign this Grant, and any purported assignment will be void, and shall he treated as an event of default pursuant to this Agreement. 16. COMPLIANCE WITH LAWS: "the Grantee agrees to abide by and be governed by all applicable Federal. DEFAULT/TERMINATION PROVISIONS: In theevent theGmnce shall fail to comply with any ofthe provisions of this Agreement, the CityManager or the City Manager's designee may terminate this Agreement and withhold or cancel all or any unpaid installments ofthe Grant upon giving five (5) calendar days written notice to the Grantee, and the City shall have no funhen obligation to the Grantee under this Agreement. Further, in the event ftermination, the Grannie shall be required to immediately repay to the City all portions ofthe Grant which have been received by the Grantee, as ofthe date that the written demand is received. Following each meeting, individual school Quality Education Committee representatives provided a ranking of current educational enhancements of interest for their school; and WHEREAS, according to school administration -provided enrollment information, there are currently 2,612 youth from early childhood to grade 12 attending seven (7) private/charter schools in Miami Beach of which 54% (1,419) are Miami Beach residents; and WHEREAS, currently, there are 6,148 Miami Beach K-12 youth attending public schools across Miami -Dade County. TO EXPAND THE COMPOSITION OF THE COMMITTEE INCLUDE REPRESENTATIVES FROM PRIVATE AND CHARTER K-12 SCHOOLS IN MIAMI BEACH TO BETTER SERVE INTERESTS OF ALL STUDENTS IN THE CITY; AND, PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE. The attached Ordinance was prepared at the request of Commissioner Kristen Rosen Gonzalez. The Mayor and City Commission approved the Ordinance on first reading at the February 1, 2023 City Commission meeting. No changes have been made between First and Second Reading. A Summary of the proposed Ordinance is set forth below. The City of Miami Beach's advisory Committee For Quality Education In Miami Beach Schools was established in 1999 to make recommendations to the City Commission and to investigate, develop, and carry out plans to promote and ensure the provision of quality education in Miami Beach public schools. The Ordinance, codified in Sections 2-190.134 through 2-100.138 of City's Code of Laws and Ordinances ("City Code', requires for the Committee to be composed of fifteen (1S) voting members and three nonvoting ex-olficio members. The proposed Ordinance would amend the composition of the Committee to include representatives from all K through 12 schools in the City of Miami Beach, including private and charter schools, to better serve the interests of all students in the City, for a total number of 27 members.
