Demolition Permits submitted for 3611 and 3621 Collins Avenue pursuant to
the "Resiliency and Safe Structures Act (Florida Statutes Section 553.8991)
On February 26, 2025, the Mayor and City Commission (City Commission) adopted Resolution
No. 2025-33523, which directs the Administration to notify the City Commission via Letter to
Commission (L TC) when a demolition permit application is submitted to the City for a property
located within a local historic district pursuant to Florida Statutes Section 553.8991, otherwise
known as The Resiliency and Safe Structures Act (The Act).
This purpose of this L TC is to advise the City Commission that building permits for the total
demolition of the existing structures at 3611 Collins Avenue (BC2425173) and 3621 Collins
Avenue (BC2525180) have been submitted to the City pursuant to The Act. Both buildings are
classified as 'contributing' in the Miami Beach Historic Properties Database and are located within
the Collins Waterfront Local Historic District.
The Act, which was signed into law on March 22, 2024, preempts local governments from
prohibiting, restricting, or preventing the demolition of certain qualifying structures and buildings
for any reason other than public safety. As applicable to qualifying buildings and structures, The
Act also preempts the City from imposing additional land development regulations or public
hearings on permit applicants and requires that local governments authorize replacement
structures to be developed in accordance with certain regulations.
The structures at 3611 Collins Avenue and 3621 Collins Avenue are qualifying buildings under The
Act, and therefore exempt from the requirements of the Land Development Regulations of the City
Code (LDR's) regarding demolition. This includes the review and approval of the Historic
Preservation Board.
