Resolution 2025-33582 RESOLUTION NO. 2025-33582 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DIRECTING THE CITY MANAGER TO ADVISE THE CITY COMMISSION, VIA SUPPLEMENTAL AGENDA MEMORANDUM, OF THE PLANNING BOARD'S RECOMMENDATIONS, INCLUDING THE VOTE OF THE BOARD, ON PROPOSED AMENDMENTS TO THE COMPREHENSIVE PLAN OR LAND DEVELOPMENT REGULATIONS, WHEN THE PLANNING BOARD MEETING AT WHICH THE RECOMMENDATION WAS MADE OCCURS AFTER THE DATE THE COMMISSION MEMORANDUM IS ISSUED BY THE CITY MANAGER FOR FIRST READING OF THE ORDINANCE. WHEREAS, as the City's "local planning agency" pursuant to Chapter 163, Florida Statutes, the Planning Board is required to review all amendments to the City's Comprehensive Plan and Land Development Regulations; and WHEREAS, on each amendment to the Comprehensive Plan or Land Development Regulations, the Planning Board is required to make a recommendation as to whether the amendment should be approved by the City Commission or denied; and WHEREAS, in considering each Ordinance, the Planning Board is required to apply specific review criteria which are codified in the Land Development Regulations; and WHEREAS, the Code requires individuals with certain professional or technical expertise to serve on the Planning Board; and WHEREAS, occasionally, Planning Board meetings are held after a City Commission agenda has printed for a Commission meeting at which an Ordinance amending the Comprehensive Plan or Land Development Regulations will be considered; and WHEREAS, in such cases, the Mayor and City Commission desire to ensure the City Commission is advised, in writing, of the Planning Board's recommendation prior to voting on an Ordinance at First Reading. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby direct the City Manager to advise the City Commission, via supplemental agenda memorandum, of the Planning Board's recommendations, including the vote of the Board, on proposed amendments to the Comprehensive Plan or Land Development regulations, when the Planning Board meeting at which the recommendation was made occurs after the date of the Commission Memorandum is issued by the City Manager for First Reading of the Ordinance.
