95-21604 Reso RESOLUTION NO. 95-21604 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AUTHORIZING AND DIRECTING THE ADMINISTRATION TO SUBMIT A PROPOSAL IN RESPONSE TO "REQUEST FOR PROPOSAL NO. HRS RFP# LV183 MK", ENTITLED "INCLUSION IN RECREATION PROGRAMS", AND TO ACCEPT THE AWARD OF THE PROPOSAL, IN AN AMOUNT OF UP TO $180,000.00 OVER TWO YEARS, IF THE CITY OF MIAMI BEACH'S PROPOSAL IS SELECTED, AND APPROPRIATE THE FUNDS WHEN RECEIVED, AND FURTHER AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE ANY AND ALL NECESSARY DOCUMENTS. WHEREAS, Title II of the Americans with Disabilities Act of 1990, requires that state and local governments provide accessibility in the programs they provide in a manner that does not discriminate on the basis of disability; and, WHEREAS, the City desires to comply fully with all the applicable provisions of the Americans with Disabilities Act of 1990; and, WHEREAS, the Parks, Culture and Recreation Division provides many programs to and for the benefit of residents and visitors of the City, including children; and, WHEREAS, the City considers the children of the City to be one of its most valued resources; and, WHEREAS, the City desires to respond to Request for Proposal "HRS RFP# LV183 MK" entitled "Inclusion in Recreation Programs" to seek an award of up to $180,000.00 over two years to fund the designing, implementing and creation of a manual for a prototype program to include children with disabilities in recreation/leisure programs. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, as follows : Section I: The City Administration is hereby authorized to submit a proposal to Yolanda Rivera, Contract Manager, Development Disabilities Council in response to Request for Proposal "HRS RFP# LV183 MK" titled "Inclusion in Recreation Programs". Section II: The Mayor and City Clerk are hereby authorized to execute the proposal submitted in response to Request for Proposal "HRS RFP# LV183 MK". Section III: The disbursing officers of the City are hereby authorized to disburse the funds awarded under "FIRS RFP# LV183 MK" under the terms required thereby. Section IV: The City's Parks, Culture and Recreation Division Director is hereby charged with the responsibility for the design, implementation and creation of a manual for"inclusion of children with disabilities in recreation programs" in accordance with the awarded proposal to "HRS RFP# LV 183 MK" and for the preparation and filing all required compliance documents. ADMINISTRATION RECOMMENDATION: The Administration recommends the adoption of the attached Resolution authorizing the Mayor and City Clerk to submit a proposal in response to Request for Proposal HRS RFP# LV183 MK, titled "Inclusion in Recreation Programs", to accept the award in an amount of up to $180,000.00 over two years and appropriate the funds when received in order to support the City's efforts to comply with Title II of the Americans with Disabilities Act of 1990. BACKGROUND: In July 1990, the Americans With Disabilities Act was passed by the U.S. Congress. F:\MB-ADA\DOCS\COMM-ARS.W PD AGENDA e, ITEM 1� DATE ""2-1-9-S- Commission Memorandum Page 2 June 21, 1995 Title II of the ADA requires that state and local governments provide accessibility to their programs and do not discriminate on the basis of a persons disability in employment and in the goods, services and programs that they provide. Recreation programs are covered under Title II of ADA and as such, designing and implementing a program to provide for "inclusion of children with disabilities in Recreation programs will support and enhance the City's efforts to comply with ADA and provide a benefit to the children of the City. The Request for Proposal described in the Resolution provides funding for the designing and implementing of a prototype program to include children with disabilities in recreation and leisure programs and then to create a manual to be made available to other municipalities to help them implement their own inclusion programs. ANALYSIS: Under Title II of ADA, programs of state and local governments must be made accessible to persons with disabilities, and must be done so in a manner that does not segregate persons with disabilities form those without disabilities. To comply with the law, the City should design programs to include children with disabilities in recreation/leisure activities provided by the City even if the City is not awarded this proposal. The Administration proposes that this RFP be responded to since receipt of the award of this proposal would enable the City to design and implement an "inclusion" program that would be funded under this proposal and in doing so, would allow the program to be implemented much more rapidly than if any inclusion program would be subject to existing budget constraints.
