95-21627 Reso • RESOLUTION NO. 9 5-216 2 7 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING A PUBLIC HEARING TO CONSIDER A REQUEST BY A.V. PARTNERS LTD. AND GIMEL PROPERTIES, INC., COLLECTIVELY DOING BUSINESS AS AGIL ASSOCIATES, AS THE OWNER OF THE LA TOUR CONDOMINIUM LOCATED AT 4201 COLLINS AVENUE, FOR A REVOCABLE PERMIT TO INSTALL BRICK PAVERS ON 42ND STREET, EAST OF COLLINS AVENUE, AND FOR CONSTRUCTION OF BRICK PAVER SIDEWALKS AND WALKWAYS WITH LANDSCAPING, IRRIGATION SYSTEM AND LIGHTS, ALSO WITHIN THE 42ND STREET CITY RIGHT-OF-WAY ABUTTING THE PROPERTY. WHEREAS, A.V. Partners Ltd. and Gimel Properties,collectively doing business as Agil Associates, is the owner of the La Tour Condominium located at 4201 Collins Avenue; and WHEREAS, Agil Associates has applied for a revocable permit to install brick pavers on 42nd Street, east of Collins Avenue, and for construction of brick paver sidewalks and walkways, with landscaping,irrigation system and lights,also within the 42nd Street City right-of-way,abutting the property; and WHEREAS,pursuant to City of Miami Beach Ordinance No. 93-2855,the Mayor and City Commission are required to hold a public hearing to consider the aforestated request. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing to consider a request by Agil Associates, as the owner of property located at 4201 Collins Avenue, for a revocable permit to install brick pavers on 42nd Street, east of Collins Avenue, and for construction of brick paver sidewalks and walkways with landscaping,irrigation system and lights, also within the 42nd Street City right-of-way abutting the property,is hereby called to be held before the Mayor and City Commission in their Chambers on the Third Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida on July 26 , 1995 beginning at 3:35 p.m, and the City Clerk is hereby authorized and directed to publish appropriate Public Notice of the Public Hearing in a newspaper of Miami Beach,at which time and place all interested parties will be heard. ZV- (5 TO: Mayor Seymour Gelber and Members of the City Commission DATE: July 12, 1995 FROM: Jose Garcia-Pedrosa City Manager SUBJECT: SETTING A DA AND TIME FOR A PUBLIC HEARING TO CONSIDER THE REVOCABLE PERMIT REQUEST BY A.V.PARTNERS LTD. AND GIMEL PROPERTIES INC.DB/A AGIL ASSOCIATES,OWNERS OF"LA TOUR" CONDOMINIUM LOCATED AT 4201 COLLINS AVENUE, FOR THE INSTALLATION OF BRICK PAVERS ON FORTY-SECOND STREET EAST OF COLLINS AVENUE,AND CONSTRUCTION OF BRICK PAVER SIDEWALKS AND WALKWAYS WITH LANDSCAPING, IRRIGATION AND LIGHTS WITHIN THE 42ND STREET CITY RIGHT-OF-WAY ABUTTING THEIR PROPERTY. Pursuant to the procedures set forth in the City Ordinance No. 93-2855 and the amended Miami Beach City Code Chapter 33 for obtaining a Revocable Permit for the use of City owned property, a resolution setting the date and time for a public hearing shall be submitted for Commission consideration. ADMINISTRATION RECOMMENDATION: The Administration recommends that the City Commission set a date and time for a public hearing to consider the Revocable Permit request submitted by A.V. Partners Ltd.and Gimel Properties Inc., DB/A Agil Associates,a Florida general partnership and owner of LaTour condominium at 4201 Collins Avenue, for the use of the City's right-of-way on Forty-Second street, adjacent to the applicant's property(see attached exhibit A),of Lots 3,4,7 , 8 and the 16' alley in between, Block 37, Ocean Front Property of the Miami Beach Improvement Company, as recorded in Plat Book 5 Pages 7 and 8, of the Public Records of Dade County, Florida. BACKGROUND: On June 30, 1993,the City Commission passed and adopted Ordinance No. 93-2855, amending the City Code Chapter 33, and establishing procedures for granting revocable permits for use of City AGENDA ITEM C.—'7 —� DATE 7-12.-95 COMMISSION MEMORANDUM Page 2 July 12, 1995 • owned property. Pursuant to Section 33-3 of this amended City Code,the City Commission shall schedule a public hearing for the consideration of the proposed request for a Revocable Permit. A.V. Partners Ltd. and Gimel Properties Inc., DB/A Agil Associates„ owner of the La Tour Condominium property located at 4201 Collins Avenue,has completed the application requirements and is requesting a Revocable permit for installing brick pavers in the parking lane on the North side of 42nd Street adjacent to their property as required by the Florida Department of Environmental Protection. In addition the applicant is requesting to construct a brick paver sidewalk and walkways to the boardwalk with landscaping, irrigation system and lighting as shown on the attached Exhibit A, on the North side of 42nd Street abutting the La Tour Condominium. ANALYSIS: A.V. Partners Ltd. and Gimel Properties Inc., DB/A Agil Associates is requesting a Revocable permit to install brick pavers in the parking lane on the North side of 42 nd Street adjacent to their property as required by the Florida Department of Environmental Protection and to construct brick paver sidewalks with trees and brick paver walkway to the boardwalk with landscaping as recommended by the City's Design Review Board,with irrigation system and lights abutting the La Tour Condominium. In addition to the $1,000.00 application fee,this Revocable permit shall generate an annual income to the City based on 3773 square feet. Pursuant to the City's Revocable Permit Ordinance No. 93-2885 and amended City Code Chapter 33,the applicant has submitted the application requirements together with a list of property owners within a radius of 375 feet who have to be notified of the scheduled public hearing. The City Commission is required to schedule a public hearing allowing at least fifteen days notice to the property owners within 375 feet of the site. CONCLUSION: The City Commission should set a time and date for a public hearing to consider this request and • application for Revocable Permit, allowing for the minimum fifteen days to notify concerned property owners.
