95-21678 Reso RESOLUTION NO.95-2167 8 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA, CREATING,SUBJECT TO THE APPROVAL OF A MAJORITY OF THE AFFECTED PROPERTY OWNERS, A SPECIAL ASSESSMENT DISTRICT FOR A PERIOD OF ONE(1)YEAR,TO BE KNOWN AS THE LINCOLN ROAD MANAGEMENT DISTRICT NO. 2; PROVIDING FOR THE LEVYING OF SPECIAL ASSESSMENTS; INDICATING THE LOCATION, NATURE AND ESTIMATED COST OF THOSE SERVICES WHOSE COST IS TO BE DEFRAYED IN PART BY THE SPECIAL ASSESSMENT;PROVIDING THE PORTION OF THE ESTIMATED COST OF THE SERVICES TO BE PARTIALLY DEFRAYED BY THE SPECIAL ASSESSMENT; PROVIDING THE MANNER IN WHICH SUCH SPECIAL ASSESSMENTS SHALL BE MADE; PROVIDING WHEN SUCH SPECIAL ASSESSMENTS SHALL BE MADE; DESIGNATING LANDS UPON WHICH THE SPECIAL ASSESSMENTS SHALL BE LEVIED; PROVIDING FOR PUBLICATION OF THIS RESOLUTION; AND AUTHORIZING RELATED ACTIONS. WHEREAS, the Lincoln Road Task Force, and its successor, the Lincoln Road Partnership, Inc. (Partnership) was established in order to work with the City of Miami Beach, Florida(City) in developing a comprehensive plan for the overall redevelopment and revitalization of the Lincoln Road Area, a nationally recognized historic retail business district located within the corporate limits of the City (Area); and WHEREAS,the purpose of the Partnership and the City's revitalization efforts is to maintain the redevelopment momentum which has been generated in the Area and to realize the promise that many business and property owners are experiencing, as well as to increase the sense of pride and community that the citizens of Miami Beach have for the Area; and WHEREAS, in order to continue, stimulate and ultimately realize the City and Partnership's revitalization plan for the Area,the Mayor and City Commission determined last year,on July 13, 1994, to establish the Lincoln P,ad Management District No.1,which has been successfully operational since October 1, 1994, providing supplementary common area clean-up and ambassador/security services, tram operation, institutional marketing and programming,and administration of the above services;and WHEREAS, the Mayor and City Commission have determined, subject to the approval of a majority of the affected property owners, to provide, or cause to be provided, the services set forth in Exhibit "A",attached and incorporated herein(Services), for that area of Lincoln Road bounded on the West by Alton Court,on the East by Collins Avenue,on the South by either 16th Street or Lincoln Lane South, and on the North by 17th Street(District); and WHEREAS, the Mayor and City Commission wish to defray a portion of the cost of the Services by special assessments (Assessments); and , WHEREAS,Chapter 170,Florida Statutes,as amended(Act),provides that a municipality may levy and collect special assessments against property benefited for the purpose of stabilizing and improving retail and/or wholesale business districts and/or nationally recognized historic district through promotion, management, marketing, environmental maintenance, and other similar services in such district of the municipality, and the City wishes to proceed in accordance with the Act by creating a special assessment district to be known as the "Lincoln Road Management District No. 2", for the purpose of providing , for a period of one (1) year,the Services within the District; and WHEREAS,the Mayor and City Commission have further determined that benefits will accrue to the property improved within the District, and that Assessments will be made in proportion to the benefits received, all as set forth in Exhibit "B", attached and incorporated herein; and WHEREAS, the Mayor and City Commission have determined that the Assessments to be levied will not exceed the benefits too the property improved thereby. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA THAT: SECTION 1. All findings and recitals contained in this Resolution are hereby adopted and incorporated herein. SECTION 2. Assessments shall be levied in accordance with the provisions of the Act, and as described herein, to defray a portion of the cost of the Services. SECTION 3. In accordance with Ordinance No. 92-2782, adopted by the City on June 17, 1992, it is hereby determined that the provisions of Ordinance No. 92-2782 shall not apply to the Assessments levied and imposed pursuant to the provision of this Resolution. SECTION 4. The nature of the Services is set forth in Exhibit "A", attached and incorporated herein. SECTION 5. The District upon which the Assessments shall be levied shall incorporate the total area as set forth in the map attached and incorporated herein as Exhibit"B",and reflecting the legal description as set for the in Exhibit "C", attached and incorporated herein. SECTION 6. The estimated cost of the Services is approximately$767,000 (Estimated Cost). SECTION 7. The Assessments will defray approximately$267,000 of the Estimated Cost,the balance thereof to be paid by the City from other available funds. SECTION 8. The Assessments shall be made on the basis of the formula set forth in Exhibit "D", attached and incorporated herein. SECTION 9. In the event the actual cost of the Services exceeds the Estimated Cost, such excess shall be paid from other available funds. • SECTION 10. The Assessments shall be levied on all lots and lands which are specially benefited thereby,and further designated on the assessment plat referenced below within the boundary of the District. SECTION 11. At the time of adoption of this Resolution, there is on file with the City Clerk,an assessment plat showing the area to be assessed, delineating the services to be provided and an estimate of the costs which is open to inspection by the public. SECTION 12. The City Administration is hereby authorized and directed to cause to be made a preliminary assessment roll, as promptly as possible, which shall show the lots assessed, the amounts of benefit to and the Assessments against each lot (Exhibit E). SECTION 13. Assessments shall be payable at the Office of the Finance Director of the City in one (1) installment on such date as shall be contained in a bill to be mailed to each property owner within the Distric .t least thirty(30)days before their due date. Installments not paid when due shall become due and payable in accordance with the provisions of the Act. SECTION 14. Upon completion of the preliminary assessment roll,the Mayor and City Commission shall adopt a subsequent resolution to fix a time and place at which the owners of the property to be assessed or any other persons interested therein may appear before the Mayor and City Commission and be heard as to the propriety and advisability of the Assessments or the provision of the Services,the costs thereof, the manner of payment therefore, or the amount thereof to be assessed against each lot so serviced, all in accordance with the Act. SECTION 15. The City Clerk is hereby directed to cause this Resolution to be published once in a newspaper of general circulation within the City. SECTION 16. The City Administration is hereby authorized and directed to take all actions necessary to carry out the intent of this Resolution, including any action in connection with obtaining the approval of the affected property owners. SECTION 17. This Resolution shall take effect upon its adoption; provided, however, that if the City does not obtain the approval of the affected property owners in accordance with the Act, this Resolution shall be dull and void. L (. 1 TO: Mayor Seymour Gelber and DATE: July 26, 1995 Members of the City Commission FROM: Jose Garcia-P4drosa City Manager (I;' SUBJECT: RECOMMENDATION OF THE CITY ADMINISTRATION TO ADOPT RESOLUTIONS TO CREATE A SPECIAL ASSESSMENT DISTRICT TO BE KNOWN AS THE LINCOLN ROAD MANAGEMENT DISTRICT NUMBER 2 FOR THE PROVISION OF SPECIAL SERVICES FOR THAT AREA BOUNDED BY COLLINS AVENUE ON THE EAST, 17TH STREET ON THE NORTH, ALTON COURT ON THE WEST, AND EITHER 16TH STREET OR LINCOLN LANE SOUTH ON THE SOUTH, AND TO SCHEDULE THE REQUIRED PUBLIC HEARING. ADMINISTRATION RECOMMENDATION: The Administration recommends that the City Commission adopt the attached resolutions to 1) create a special assessment district to be known as the Lincoln Road Management District No. 2 for the provision of special services for that area bounded by Collins Avenue on the east, 17th Street on the north, Alton Court on the west, and either 16th Street or Lincoln Lane South on the south and 2) schedule the required public hearing. BACKGROUND: After more than two years of extensive open study, debate, and planning with the Lincoln Road Task Force and it's succeeding organization, the Lincoln Road Partnership, Inc., the City of Miami Beach, Miami Beach Development Corporation, and all other interests in the Lincoln Road area, consensus was reached on the interest and commitment present to revitalize the Lincoln Road area, and thus the need for capital improvements and effective management of that area. On July 13, 1994, the City Commission enabled the formation of the Lincoln Road Capital Improvement District #1, for the purpose of a $16 Million capital improvement in the established district, and the formation of the Lincoln Road Management District #1 to provide services that would enhance the physical and business environment for citizens and visitors, as well as business and property owners. These services were seen as necessary to improve the appearance, safety, and ultimately the business and cultural viability before, AGENDA ITEM 11—� DATE 1 during, and after the capital improvements. With special emphasis on public involvement, the management district was requested by the Lincoln Road Partnership, Inc., as part of a long range plan for revitalization. The Lincoln Road Partnership, Inc. now proposes to continue the district for a second one year period. Administrative staff has met with representatives of the district to discuss budget, and alternate sources of funding in place of the current allocation of city funds. ANALYSIS: The Administration proposes that current districts receive funding from the City for a period of 5 years from inception subject to the availability of resort tax following priority pledges. In years one through three the districts would receive the same level of funding from the City. For the Ocean Drive, Washington Avenue and Lincoln Road Districts, the City currently funds approximately two-thirds of the total budget for each district. The level of funding from the City would decline in years four and five such that funding provided by the City in year four would be reduced by one-third of the funding level in year three and in year five the funding level would be a third less than the funding in year four. There would be no funding provided to the districts by the City in year 6 and in subsequent years. Administrative staff and representatives of the districts met on July 17, 1995 to discuss alternate methods of funding the districts in lieu of city funds. Some potential funding sources suggested by the districts' representatives include an increase in the service fees charged by establishments within the district, funding from the Greater Miami Visitors and Convention Bureau and implementation and use of sidewalk cafe permit fees on Lincoln Road and Washington Avenue. Ocean Drive is currently using this revenue source to help fund its operations. Lincoln Road has considered other revenue sources, including revenue sharing with the City from increased activity in the district. Additional meeting will be held to develop a plan for these districts to reduce and ultimately eliminate their dependence on the City to provide funding. Services to be provided to the District for the second year are described in the budget summary attachment (Exhibit A). No budget increase is proposed for the second year, based upon the successful programs and procedures initiated in the first year. This also means there will be no substantive change in the assessment of individual property owners. CONCLUSION: Lincoln Road continues to generate excitement, and its dramatic comeback is dependent upon the support of management services, especially in the next two years. During the critical construction period, as well as the continuing emergence as a cultural and commercial destination, the Lincoln Road district will be dependent on these management services. The initial positive impact • of this district, forged by the consensus and commitment of this community, is evident. The continuation of the management services, enabled by the formation of Lincoln Road Management District No. 2, is vital in this period of Lincoln Road and the City of Miami Beach's history. It is another step in the exciting process that the City of Miami Beach and the Lincoln Road community are taking together to restore and enhance the heritage and secure an even better future for this "World Class Center of Commerce and Culture of Miami Beach".
