95-21713 Reso RESOLUTION NO. 95-21713 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING A PUBLIC HEARING TO CONSIDER PUBLIC COMMENT REGARDING A PARKING AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND CITY NATIONAL BANK FOR THE USE OF TWENTY-SIX(26) PARKING SPACES IN THE CITY PARKING GARAGE LOCATED AT 42ND STREET AND SHERIDAN AVENUE; FURTHER AUTHORIZING A WAIVER, BY A 5/7 VOTE OF THE MAYOR AND CITY COMMISSION, OF THE ADVERTISED PUBLIC BIDDING PROCESS AND OF AN INDEPENDENT APPRAISAL OF THE FAIR RENTAL VALUE OF THE PROPERTY,AS REQUIRED BY ORDINANCE NO. 92-2783. WHEREAS, at its regular meeting on June 21, 1995, the Mayor and City Commission approved the recommendation of the Land Use and Development Committee, conceptually approving a request by City National Bank to enter into a Parking Agreement with the City for the provision of twenty-six(26)parking spaces to City National Bank in the City parking garage located at 42nd Street and Sheridan Avenue; and WHEREAS,the City Attorney's Office and the City Administration are currently negotiating the Parking Agreement with representatives of City National Bank; and WHEREAS, pursuant to Ordinance No. 92-2783,which establishes procedures for the sale and/or lease of City property, prior to the sale and/or lease of City property, the Mayor and City Commission shall hold a public hearing, advertised not less than fifteen (15) days prior to the hearing, in order to obtain citizen input into such proposed sale and/or lease; and WHEREAS, the Mayor and City Commission may, by a 5/7 vote, waive certain other requirements under Ordinance No.92-2783,requiring an advertised public bidding process pursuant to the sale and/or lease of City property, and an independent appraisal of the fair market or rental value of the property. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA, as follows: 1. A public hearing to consider public comment regarding a Parking Agreement between the City and City National Bank for the use of twenty-six(26)parking spaces in the City parking garage located at 42nd Street and Sheridan Avenue, is hereby called to be held before the Mayor and City Commission in its Chambers of the Third Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida on October 11, 1995, beginning at 2:00 p.m. , and the City Clerk is hereby authorized and directed to publish appropriate public notice of the said public hearing in a newspaper of general circulation in the City of Miami Beach at which time and place all interested parties will be heard. 2. The Mayor and City Commission herein waive, by a 5/7 vote, and upon a finding that the public interest would be served by waiver of such conditions, the requirements under Ordinance No. 92-2783, calling for an advertised public bidding process prior to the proposed Parking Agreement and an independent appraisal of the fair market rental value of the proposed leased property. ADMINISTRATION RECOMMENDATION: It is recommended that the Mayor and City Commission adopt the attached Resolution calling for a public hearing to consider public comment regarding a parking agreement between the City of Miami Beach and City National Bank and to consider authorizing a waiver, by a 5/7 vote of the Mayor and City Commission, of the advertised public bidding process and of an independent appraisal of the fair rental value of the property, as required by Ordinance No. 92-2783 . BACKGROUND: The City Commission, on June 13 , 1995, approved the Land Use and Development Committee ' s recommendation to proceed with the above agreements . The Administration and City Attorney have been negotiating with City National Bank and the agreement is pending. 1 AGENDA ITEM el 1- DATE Q- 1 395 • ANALYSIS: The City Commission must take the above action to proceed with the agreements . Pursuant to Ordinance No. 92-2783 , which sets up procedures for sale or lease of property, the City must hold an advertised public hearing to consider such sale or lease . The Commission will also have to waive its requirements for bidding and for an independent appraisal . CONCLUSION: Based on the previous conceptual action the Commission should proceed with setting the public hearing. JGP: jph Attachments 2
