95-21723 Reso RESOLUTION NO. 95-21723 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SUPPORTING METROPOLITAN DADE COUNTY'S PROPOSED COUNTYWIDE 3.5% WATER AND/OR SEWER SURCHARGE, WITH THE PROVISO THAT SAID SURCHARGE BE DEPOSITED IN A SEPARATE COUNTY FUND TO BE USED EXCLUSIVELY BY THE COUNTY DEPARTMENT OF ENVIRONMENTAL RESOURCES MANAGEMENT TO PAY FOR THE COSTS OF ENVIRONMENTAL REGULATION OF SAID WATER AND SEWER UTILITIES AND, PARTICULARLY WITH REGARD TO THE CURRENT NEGOTIATIONS BETWEEN THE CITY AND THE COUNTY FOR THE SALE OF THE OJUS PROPERTY TO THE COUNTY, TO PAY FOR THE CLOSURE OF MUNICIPAL LANDFILLS. WHEREAS, the City of Miami Beach supports Metropolitan Dade County's monitoring and evaluation of water sewage systems; and WHEREAS, the City supports the County's efforts to ensure closure of municipal solid waste landfills; and WHEREAS, the City supports the County's environmental remediation at landfill sites and land acquisition of water supply protection; and WHEREAS, the County, upon passage of its proposed 3.5 percent water and/or sewer surcharge, has agreed to purchase a tract of property known as the "Ojus Property", subject to certain terms and conditions as shall be negotiated in a purchase and sale agreement between the parties, and has agreed to use portion of the funds collected from the proposed surcharge to fund the Ojus Property landfill closure costs. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA, that the City of Miami Beach herein supports Metropolitan Dade County's proposed Countywide 3.5 percent water and/or sewer surcharge, with the proviso that said surcharge be deposited in a separate County fund and be used exclusively by the County Department of Environmental Resources Management and, particularly with regard to the current negotiations between the Cit and the County for the sale of the Ojus Property to the County, to pay for the closure of mun. pal landfills. By JGP:JP:pp a:ojusreso.913 Date CITY OF MIAMI BEACH CITY HALL 1700 CONVENTION CENTER DRIVE MIAMI BEACH FLORIDA 33139 COMMISSION MEMORANDUM NO. —1 a -QS TO: Mayor Seymour Gelber and Members of the City Commission DATE: September 13, 1995 FROM: Jose Garcia-Pedrosa City Manager SUBJECT: A RESOLUTION THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA,SUPPORTING METROPOLITAN DADE COUNTY'S PROPOSED COUNTYWIDE 3.5 PERCENT WATER AND/OR SEWER SURCHARGE ADMINISTRATION RECOMMENDATION: It is recommended that the Mayor and city Commission authorize the execution of the attached Resolution in support of a 3.5 percent water/sewer surcharge proposed by Metropolitan Dade County, with the proviso that said charge be deposited in a separate Countywide fund and used exclusively by the Department of Environmental Resources Management to pay for the costs of Environmental Regulation of said water and sewer utilities. BACKGROUND: In a June 26, 1995, memorandum from Roger Carlton, Consultant to the Administration, Mr. Carlton informed the Commission that the sale of the Ojus Property to Metropolitan Dade County was contingent upon closure of the Ojus Trash Transfer Station, with the County being responsible for cleaning of said Trash Transfer Station; that the City conduct tests for methane gas contamination; that the City return its waste stream to the County; and that the City support a 3.5 percent Countywide surcharge on water and sewer bills to fund the landfill closure costs. As of this date, the County has agreed to close the Trash Transfer Station in October, 1995. The City has contracted and obtained the services of OHM Remediation Services Corp to conduct tests for methane gas, and test results have proven negative. The City proposes to direct its waste stream to Dade County. The Administration hereby recommends that the City support the County's recommended 3.5 percent increase in water/sewer surcharge to fund the landfill closure. CONCLUSION: The Mayor and City Commission should approve the attached Resolution supporting a 3.5 percent Countywide water and/or sewer surcharge to be used exclusively by the Department of Environmental Resources Management to pay for landfill closure costs.
