95-21777 Reso RESOLUTION NO. 9 5-217 7 7 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DETERMINING THAT CERTAIN SERVICES BE PROVIDED PURSUANT TO THE CREATION OF THE LINCOLN ROAD MANAGEMENT DISTRICT NO. 2, AS DECLARED BY RESOLUTION NO. 95-21678 ADOPTED ON JULY 26, 1995, AND FURTHER LEVYING SPECIAL ASSESSMENTS AGAINST PROPERTIES IN THE DISTRICT BENEFITTED BY THE PROVISION OF SUCH SERVICES, IN ACCORDANCE WITH THE FINAL ASSESSMENT ROLL TO BE FILED FORTHWITH WITH THE CITY CLERK. WHEREAS,Chapter 170, Florida Statutes,as amended(Act), provides that a municipality may levy and collect special assessments against property benefitted for the purpose of stabilizing and improving retail and/or wholesale business districts and/or nationally recognized historic districts through promotion,management, marketing,and other similar services in such districts of the municipality; and WHEREAS, on July 26, 1995, by Resolution No. 95-21678, the Mayor and City Commission of the City of Miami Beach, Florida, declared the creation of a special assessment district known as the Lincoln Road Management District No. 2, for that area of Lincoln Road bounded on the west by Alton Court,bounded on the east by Collins Avenue,bounded on the south by either 16th Street or Lincoln Lane South,and bounded on the north by 17th Street (District), for the provision of those certain services, as set forth in Exhibit "A", attached and incorporated (Services), all in accordance with the applicable provisions of the Act; and WHEREAS,a preliminary assessment roll has been filed with the Office of the City Clerk indicating the lots and lands to be assessed,the amount of the benefit to and the assessment against each lot and/or parcel of land, all as required by the Act; and WHEREAS,through a special election held in the District on October 6, 1995,approval has been obtained by a majority of the affected property owners within the District as to the levying and collection of the assessments, as also required by the Act; and WHEREAS, on July 26, 1995, by Resolution No. 95-21679, the Mayor and City Commission scheduled and thereafter held a public hearing on October 11, 1995, to hear testimony from all property owners and any other interested persons regarding the propriety, advisability and cost of providing the Services in the District; and WHEREAS, all affected property owners within the District have received appropriate notice of the public hearing, as required by the Act; and WHEREAS,at the public hearing,the Mayor and City Commission,acting as an equalizing board, received complaints, comments and objections by interested persons and affected property owners,and thereafter directed the Administration,as deemed necessary and as appropriate,to adjust and equalize assessments on the basis of justice and right as prescribed by the Act. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: Section 1: All findings and recitals contained in this Resolution are hereby adopted and incorporated. Resolution No. 95-21678, which ordered the creation of the Lincoln Road Management District No. 2, is hereby confirmed. Section 2: The final assessment roll is herein approved, as so equalized, and shall be promptly filed with the Office of the City Clerk in accordance with this Resolution and applicable provisions of the Act. Such assessments contained in the final assessment roll are hereby levied and stand confirmed and remain legal, valid and binding special assessment liens upon properties against which such assessments shall be recorded in the Improvement Lien Book and the final assessment roll shall show the lots or lands assessed, the amount of benefit as to each such lot or land, and the manner of payment of such assessment. Total Collections: $267,281.58 CITY OF MIAMI BEACH CITY HALL 1700 CONVENTION CENTER DRIVE MIAMI BEACH FLORIDA 33139 COMMISSION MEMORANDUM NO. 71-4p2-9 5 TO: Mayor Seymour Gelber and Members of the City Commission DATE: October 11, 1995 FROM: Jose Garcia-Pedrosa City Manager SUBJECT: SPECIAL ASSE MENT LEVY-LINCOLN ROAD MANAGEMENT DISTRICT#2 ADMINISTRATION RECOMMENDATION: The Administration recommends that the City Commission adopt the attached resolution which establishes a new assessment district to take the place of the existing Lincoln Road Management District#1, in order to continue support for improvements to the special assessment district to be known as the Lincoln Road Management District#2 . The services provided have contributed to the vibrancy of the Lincoln Road area over the past year, and will be important during the coming year,when the Lincoln Road district will be experiencing construction during the capital improvement project. BACKGROUND: Property owners in the Lincoln Road area have expressed satisfaction with the services provided during the first year of the management district. Furthermore, a majority of the property owners support the creation of the special assessment district for a second year to provide for security, maintenance, tram operation, marketing and related services. The On July 26, 1995, the City Commission took action establishing the Lincoln Road Management District#2. At that time the assessment formula, district boundaries, services and improvements to be provided, related budgets, and preliminary assessment rolls were presented. Since then, the Partnership has communicated with property owners and businesses to finalize the information in anticipation of the final hearing today, at which AGENDA kR- 2 -E ITEM J DATE time the corrected assessment rolls will be adopted. In legal compliance with Chapter 170 of the Florida State Statute, the notice of the final hearing and the preliminary assessment rolls were mailed to all property owners of record on July 14, 1995. This is the continuation of more than four years of extensive open study, debate, and planning with the Lincoln Road Partnership,Inc. (and it's predecessor, the Lincoln Road Task Force),the City of Miami Beach, Miami Beach Development Corporation, and all other interests in the Lincoln Road area. That process has always been open to the public with most meetings publicly and/or noticed by mail. Where possible, all owners of record of properties,business owners, and others who asked to be kept informed, have been sent or have had hand-delivered the information bulletins and/or newsletters composed by the Lincoln Road Partnership. Ongoing management services will maintain the strengthening economic conditions in "the Road" area. The following is a review of the services to be provided: Management Services In order to maintain the significant physical improvements planned for Lincoln Road, and to provide other important elements for a successful residential,business and cultural district, the multi-purpose management plan proposed when Management District#1 was instituted will be continued.. The purpose of the management plan,which will be funded by this district's assessments and resort tax funds,is to facilitate property and business owner's involvement in the improvement and enhancement of the Lincoln Road area for their own benefit as well as that of the City's and its' citizens. The management program will enhance and expand otherwise unavailable services or service levels within the district. Participation and baseline services provided by the City will continue. The cost for these services is estimated to be $767,000 for the coming year. The proposed budget and summary is attached as Exhibit A. This budget has not been increased from the first year. Major budget categories are basically the same,with an slight increase in marketing expenses, enabled by a cost saving in physical programs. Revenue will be received as;$267,000, special assessments; and $500,000 , the City's resort tax collections. Future allocations from the City of Miami Beach will be subject to availability of funds and the overall City budget process. After construction, table tax collections and alternate funding sources will be sought. The district will be managed by the Lincoln Road Partnership Inc.,which has representatives from all interests that constitute Lincoln Road. An agreement between the City and the Partnership, similar to the Ocean Drive Management Agreement, is being prepared. The assessment formula, which will provide $267,000,is a blended formula based upon linear front footage, side footage and a per square foot fee for area above the ground floor. The formula has not changed from the first year. (Exhibit B) CONCLUSION: Lincoln Road is making a dramatic comeback, stimulated by improvement in the South Beach area,but primarily based on the anticipation of an improved business environment that is physically improved and well maintained and marketed. The success of this concept has been proven in other cities across the nation. Lincoln Road property owners recognize this and have proposed a plan to accomplish that vision. Service enhancements are being funded by the owners and their tenants similar to Ocean Drive. This innovative approach will ensure that this Lincoln Road effort creates long-term success. The City Commission should adopt the Lincoln Road Management District Resolution after the final public hearing. Following the public hearing the City Commission shall meet as an equalization board to consider the testimony of the affected property owners and shall adjust and equalize the assessments on a basis of justice and right.
