95-21818 Reso RESOLUTION NO. 95-21818 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, TO RATIFY THE RETIREMENT STIPULATIONS AS NEGOTIATED BETWEEN THE CITY MANAGER, ON BEHALF OF THE CITY OF MIAMI BEACH, FLORIDA, AND FORMER BUILDING DEPARTMENT DIRECTOR, PAUL GIOIA. WHEREAS, in accordance with Article IV, Section 4.02, of the Miami Beach City Charter, and pursuant the requirements of Resolution No. 91-20287 that the City Manager may negotiate the terms of written documents in which the City is a party or in which the City is bound to the terms thereof; and WHEREAS,the City Manager is hereby submitting to the City Commission the attached letter outlining the retirement stipulations as negotiated between the City Manager, on behalf of the City of Miami Beach, and the former Building Department Director, Paul Gioia, for ratification pursuant to requirements of the Miami Beach City Charter and Resolution No. 91-20287. NOW, THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, hereby ratifies the retirement stipulations as negotiated between the City Manager, on behalf of the City of Miami Beach. BACKGROUND: Pursuant to Article IV, Section 4.02 of the Miami Beach City Charter, and in accordance with the requirements of Resolution No. 91-20287, attached is a letter dated October 24, 1995, which outlines the retirement stipulations negotiated with former Building Department Director, Paul Gioia, who served in that capacity for over eight years. CONCLUSION: The attached Resolution should be ratified. Please consider this as my acceptance of your notice of pending retirement. It is my understanding that you will be processing your retirement paperwork so as to be eligible to retire effective as of March 4, 1996. Therefore,you will continue in your current pay status until March 4, 1996,the anniversary date of your employment with the City of Miami Beach. During the transition period between today and until March 4, 1996, while the City recruits for your replacement,you have agreed to be available for consultation with City of Miami Beach Officials, as may be required with regard to operational needs; litigation, if any; and any such professional inquiries which may require your expertise. It is my understanding that this arrangement is acceptable to you, and that you will be available for such consultation on an as needed basis until your retirement on March 4, 1996.
