A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE
ART IN PUBLIC PLACES (AIPP) COMMITTEE AND THE CULTURAL ARTS
COUNCIL TO PURCHASE THE STARCHILD SCULPTURE FROM FWY
STUDIOS, INC., IN A TOTAL AMOUNT NOT-TO-EXCEED $170,000.00, WITH
THE INTENT THAT THE WORK WILL REMAIN PERMANENTLY INSTALLED
AT ITS CURRENT LOCATION AT HENRY LIEBMAN SQUARE (WEST 4�sT
STREET AND PINE TREE DRIVE); AND DIRECTING THE PUBLIC WORKS

ADMINISTRATION TO FIRST ATTEMPT TO SECURE FUNDING FOR THE
RELOCATION OF THE SG UTILITY POLE FROM THE AIPP FUND, AND IF
AIPP FUNDING IS NOT APPROVED AND THE RELOCATION COSTS
EXCEED $75,000.00, AUTHORIZING THE CITY ADMINISTRATION TO
PLACE THIS ITEM DIRECTLY ON THE FINANCE AND ECONOMIC
RESILIENCY COMMITTEE'S AGENDA FOR DISCUSSION AND FURTHER
ACTION.
WHEREAS, FriendsWithYou, an art collaboration of Samuel Borkson and Arturo
Sandoval III, produced StarChild (2022), the "Sculpture") as a temporary public art installation
for Miami Beach OnStage! arts and culture program; and
WHEREAS, Starchild is a 50-foot tall bright orange metal sculpfure depicting the main
character in FriendsWithYou's newest body of work, a longform conceptual project in which the
artists are renaming the Earth to "Ocean" as a means to unify the planet; and
WHEREAS, the City installed the Sculpture at Henry Liebman Square, 41�' Street and
Pine Drive, where it has since remained; and
WHEREAS, following discussion by the Art in Public Places Committee and Cultural
Affairs Council (the "Committees"), the Committees recommended that the City acquire the
Sculpture as part of the City of Miami Beach Art In Public Places Collection in a no[-to-exceed
amount of$170,000; and
WHEREAS, there is $170,000 available in the Ciry of Miami Beach Cultural Arts Council
fund to finance the purchase of SfarChild; and
WHEREAS, furthermore, there is a SG utility pole in the vicinity of the Sculpture, which
poses an aesthetic threat to the arlwork and may obstruct view of the Sculpture from certain
viewpoints; and
WHEREAS, if technically feasible, the 5G utility pole should be relocated to a nearby
location that will not compromise the public's ability to view the artwork; and
WHEREAS, initial estimates from the City's Public Works department suggest that
removing and relocating the SG utility pole is a 6-9 month-long project, that will cost between
$50,000-$60,000; however, the City Administration does not have a final estimate for said
relocalion costs; and
WHEREAS, the City Commission directed the Administration to first attempt to secure
funding for the relocation costs from Art in Public Places ("AIPP") funds, instead of the City's
general fund; and
WHEREAS, in the event that the AIPP Committee does not approve the use of the AIPP
funds to relocate [he 5G utility pole and said costs exceed $75,000.00, fhe City Administration to
authorized to place a funding request on the Finance and Economic Resiliency Committee's
agenda for discussion and further action.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF 7HE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby
accept the recommendation of the Art in Public Places (AIPP) Committee and the Cultural Arts
Council to purchase the "StarChild" sculpture from FWY Studios, Inc., in a total amount nol-to-
exceed $170,000.00, with the intent that the work will remain permanently installed at its current
location at Henry Liebman Square (West 41st Street and Pine Tree Drive); and direct the Public
Works Department to take the steps necessary to remove and relocale the 5G utili[y pole,
located in the vicinity of"Star Child" sculpture (if possible), so as to not obstruct the views of the
sculpture; and further, direct the City Administration to frst attempt to secure funding for the
relocation of the 5G utilily pole from the AIPP fund, and if AIPP funding is nol approved and the
relocation costs exceed $75,000.00, authorize the City Administration to place a funding request
on the Finance and Economic Resiliency Committee's agenda for discussion and further action.

A RESOLUTION OF THE MAYOR AND CITY COMMIS510N OF THE
CITY OF MU1MI BEACH, FLORIDA, ACCEPTING THE
RECOMMENDATION OF THE ART IN PUBLIC PLACES COMMITTEE
, AND THE CULTURAL ARTS COUNqL TO PURCHASE THE
STARCHILD SCULPTURE FROM FWY STUDIOS, INC., IN A TOTAL
AMOUNT NOT-TO-FJfCEED $170,000.00, WITH THE INTENT THAT
THE WORK WILL REMAIN PERMANENTLY INSTALLED AT ITS
CURRENT LOCATION AT HENRY LIEBMAN SQUARE (WEST 4181
STREET AND PINE TREE DRIVE); AND FURTHER DIRECTING THE
PUBLIC WORKS DEPARTMENT TO TAKE THE STEPS NECE33ARY
TO REMOVE AND RELOCATE THE 5G UTILITY POLE LOCATED IN
THE VICINITY OF "STARCHILD" SCULPTURE (IF POSSIBLE), SO AS
TO NOT OBSTRUCT THE VIEWS OF THE SCUIPTURE.
WHEREAS, FriendsWithYou, an art collaboratbn of Samuel 8orkson and Arturo
Sandoval III, protluced StarChild (2022), the "Sculpture°) as a temporary puhlic art
installation for Miami Beach OnStage! arts and culture program;and
WHEREAS, Starchild is a 50-foot tall bright orenge metal sculpture depicting the
main charader in FriendsWithYou's newest body ot work, a longfortn concepNal projecl
in which the aRists are renaming the Earth to "Ocean" as a means to unify the planet
and
WHEREAS, the CRy installed the Sculpture at Henry Liebman Square, 41"Streat
and Pine Drive,where it has since remained;and
WHEREAS, following discussion by the Art in Public Places Committee and
CulWrsl Affairs Council (the "Committees"), the Gommittees recommended that the Ciry
acquire the Sculpture as part of the City of Miami Beach Art In Public Places Collection
in a noFto-exceed amount of$170,000; and
WHEREAS, thare is $170,000 available in the Ciry of Miami Beach Cuttural Ads
Council fund to finance the purchese of StaiChild; and
WHEREAS, furthertnore, thare is a 5G utility pole in ihe vicinity of the Sculpture,
which poaes en aesthe[ic threat to the artwodc entl may oDstruc[view of the Sculpture
fmm certain viewpoin[s; and
WHEREA3, if technically feasible, the SG utility pole should be relocated to a
nearby location that will not compromise the Oublic's abillty to view lhe artwork; and
WHEREA3, initial estlmates from the Citys Public Works tlepartment suggest
that removing and relocating the 5G utllity pole is a 6-9 month-long project, that will cost
between$50,000-$60,OOO; and

WHEREAS, in an event that the removal and relocation of the 5G utility pole
exceeds $75,000, the Mayor and City Commission authonze the City Administration to
place this item directly on the Finance and Economic Resiliency Committee's agenda
for discussion and further action.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and
City Commission hereby accept the recommendation of the Art in Public Places
Committee and the Cultural Arts Council to purchase the "StarChild" scuipture from
FWY Studios, Inc., in a total amount not-to-exceed $170,000.00, with the intent that
the work will remain permanently installed at its current location at Hanry Liebman
Square (West 41st Street and Pine Tree Drive); and further, dired the Pu61ic Works
Department to take the steps necessary to remove and relocate the SG utility pole
located in the vicinity of "Star Child" sculpture (if possible), so as to not obstruct the
views of the sculpture.
