A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, DIRECTED
TO GOVERNORJEB BUSH, THE FLORIDA LEGISLATURE,
STATE INSURANCE COMMISSIONER BILL NELSON, AS
STATE FIRE MARSHAL, AND THE MIAMI-DADE COUNTY
COMMISSION URGING THAT EACH MUNICIPALITY,
WHICH HAS ITS OWN QUALIFIED FIRE DEPARTMENT,
BE GRANTED THE ABSOLUTE AUTHORITY TO SELECT
THE MOST APPROPRIATE FIRE SAFETY CODE FOR
EXISTING RESIDENTIAL HIGH-RISE BUILDINGS FOR
THE CONDITIONS EXISTING IN THE MUNICIPALITY.
WHEREAS, the cost of retrofitting existing residential high-rises with sprinklers is a severe
financial hardship on the vast majority of the residents; and
WHEREAS, New York City and other major centers with older residential high-rises have
decided not to mandate retrofitting; and
WHEREAS, new and affordable fire safety technologies have been developed since the
introduction of sprinklers; and
WHEREAS, the U.S. Consumer Product Safety Commission is expanding its investigation
of building sprinklers after ordering a nationwide recall of eight (8) million trouble-plagued
sprinklers; and
WHEREAS, the City of Miami Beach and other municipalities which have their own
qualified fire department, should have the absolute authority to select the most appropriate fire safety
code for existing residential high-rises for the conditions existing in the municipality.
NOW, THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA urge Governor Jeb Bush, the
Florida Legislature, State Insurance Commissioner Bill Nelson, as State Fire Marshal, and the
Miami-Dade County Commission to officially grant to each municipality, which has its own
qualified fire department, absolute authority to select the most appropriate fire safety code for
existing residential high-rises for the conditions existing in the municipality.

RE: Implementation of 1991 Life Safety Code

Dear Mr. Helanefy:
The City of Miami Beach adopted ordinance #96-3045 on June 19, 1996. This ordinance adopted the
1991 edition of the NFP A 10 I, Life Safety Code. This is the primary code used by the Fire Service to
insure protection of life in all occupancies. The adopted ordinance requires that all existing residential
buildings which are 75' or greater in height be retrofitted with a fully automated sprinkler system or an
Engineered Life Safety System (ELSS) within 5 years of the date of adoption. Therefore, all required
buildings must be in full compliance no later than September 30, 2001.
Your building must have your engineer or sprinkler company representative schedule a meeting with this
office before August I, 1999. At this meeting the status of the building's plan will be evaluated, and a
realistic schedule of compliance will be set. This schedule will set benchmarks for different aspects of the
project. These will include, but are not limited to, dates for submittal of plans, drawings for pennitting,
contracts for construction, and a schedule for completion. In no case will this last date be later than
September 30,200 I.
While there is no legal means for the City to extend the deadline for compliance, buildings which show
good faith efforts to meet their benchmarks will be granted as much latitude as is allowed by the inspection
process. Buildings which stonewall, or otherwise delay the process, will be taken before the Special
Master. This could result in fines of up to $250 per day. It is the hope of this office that this is a measure
which can be avoided in all cases, for life safety, not punishment, is our ultimate goal.
