A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, DIRECTING THE CITY ADMINISTRATION TO DEVELOP A
COMPREHENSIVE PLAN FOR THE INSTALLATION AND DAILY USE OF METAL
DETECTORS AT ALL PUBLIC ENTRANCES TO CITY HALL, CONSISTENT WITH
FLORIDA LAW WHICH GENERALLY AILOWS THE CONCEALED CARRY OF
WEAPONS IN PUBLIC BUILDINGS AND PREEMPTS LOCAL REGULATION OF
WEAPONS, FOR THE PURPOSE OF MAINTAINING PUBLIC SAFETY; AND
FURTHER, DIRECTING THE CITY ADMINISTRATION TO PRESENT ITS
DEVELOPED PLAN TO THE MAYOR AND CITY COMMISSION AT THE JUNE 25,
2025 CITY COMMISSION MEETING.
WHEREAS, the City of Miami Beach is committed to ensuring a safe and secure environment
within all of its municipal facilities and public spaces; and
WHEREAS, City Hall serves as a cenlral hub for public services, meetings, and civic
engagement, which occasionally includes angry, emotional, and/or disgruntled persons, necessitating
proactive measures to safeguard employees, City residents, and the visiting public; and
WHEREAS, the City Commission recognizes that under Florida law, including Sections 790.06
and 790.33, Florida Statutes, individuals with concealed carry licenses (or otherwise eligible to carry a
concealed weapon)may lawfully carryweapons into certain public buildings (excluding buildings such as
police stations, courthouses, jails, etc.) and local governments are preempted from regulating weapons
independently; and
WHEREAS, norivithstanding lhe preemption on local regulation of weapons, the City retains the
responsibility to take reasonable measures to protect the safety and well-being of individuals within City-
owned facilities; and
WHEREAS, while the City generally cannot restrict the lawful carry of concealed weapons into
City Hall, the use of inetal detectors can alert security personnel to the presence of such items; and
WHEREAS, the City already possesses the metal detectors necessary for use at all public
entrances to City Hall; and
WHEREAS, the installation and daity use of inetal detectors at all public en[rances to City Hall
may serve as a deterrent to the introduction of weapons by those persons not legally permitted to carry
a concealed weapon, and may further enhance the overall security of City Hall; and
WHEREAS, it is appropriate for the City Administration to develop a comprehensive plan(or the
installalion and daily use of inetal detectors at all public entrances to City Hall, which should include, buf
not be limited to:
a. Identification of the type and number of ine�al detectors, and handheld wands,
necessary for effective screening.
b. A proposed timeline for the installation and implementalion of the metal detectors.
c. An assessment of the costs associated with the installation, maintenance, and operation
of the metal detectors.
d. Consideration of staffng requirements for the operation of the metal detectors and
related security procedures.
e. Protocols for the efficient and respectful screening of individuals entering City Hall,
minimizing disruption to public access.
f. Include training for security personnel on proper protocol and on interacting with
individuals lawfully carrying weapons.
g. Ensuring compliance with all applicable federal and state laws, including those related
to accessibility and non-discrimination.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and the City Commission hereby direct the
City Administration to develop a comprehensive plan for lhe installation and daily use of inetal delectors
at all public entrances to City Hall, consistent with Florida law which generally allows the concealed carry
of weapons in public buildings and preempts local regulation of weapons, for ihe purpose of maintaining
public safety; and further, directing the City Administration to present its developed plan to the Mayor and
City Commission at the June 25, 2025 City Commission meeting.
