SUBJECT: Request from City Attorney's Oversight Committee for Referral
to Land Use and Development Committee to Discuss
Amendment to Section 30-36, Appointment of Chief Special
Master
Please place on the next City Commission agenda the request from the City Attorney's
Oversight Committee, made at yesterday's meeting, a referral to the Land Use and
Development Committee to discuss an amendment to the City Code Section 30-36,
Appointment of Chief Special Master, as follows:
Sec. 30-36. -Appointment of chief special master and other special
masters.
Upon prior recommendation of the city manager, the city commission by a
majority vote may appoint a chief special master, who shall be authorized
to hold hearings and impose fines, liens and other noncriminal penalties
against violators of city or county codes and ordinances. The chief special
master shall be an individual an attorney licensed to practice in any state
with a minimum of five years experience, who shall have been
determined by the city manager and city attorney to have the knowledge,
skills and abilities to perform as chief special master. The chief special
master shall also be authorized to appoint such other special masters
with similar experience as may reasonably be required to conduct the
necessary hearings. Each special master appointed shall have the
knowledge, skills and abilities to perform as special masters.
