ADMINISTRATION RECOMMENDATION Forward the proposed ordinance to Planning Board for its review and recommendation and back to the Land Use and Development Committee. SUMMARY At the October 19, 2011 City Commission meeting, at the request of Commissioner Jorge R. Exposito a referral was made to the Land Use and Development Committee to discuss the issue of the 300-ft. distance separation between liquor stores as specified in the City of Miami Beach City Code, and the Miami-Dade County requirement of a separation of 1 ,500 ft. At the March 28, 2012 meeting, the LUDC discussed this issue and requested that the issued be referred to the Planning Board for its input. ANALYSIS Section 6-4 of the Land Development Regulations of the City Code contains location and use restrictions for alcoholic beverage sales within Miami Beach. Section 6-4(a)(3) specifically regulates retail liquor stores, and requires a minimum distance separation between retail stores primarily selling alcoholic beverages for consumption off the premises of 300 feet. This regulation has been in effect since at least 1989. Extending the required distance separation from 300 to 1 ,500 feet will result in fewer locations at which liquor stores could be located as of right.
