Resolution 2025-33675 RESOLUTION NO. 2025-33675 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DIRECTING THE CITY ADMINISTRATION TO PROVIDE THE MAYOR AND CITY COMMISSION WITH AT LEAST 72 HOURS' ADVANCE WRITTEN NOTICE PRIOR TO THE CLOSURE OF ANY LANE(S) OF TRAVEL FOR ANY CONSTRUCTION, MAINTENANCE OR UTILITY-RELATED ROAD CLOSURE(S), AND DIRECTING THAT SUCH NOTICE CONTAIN ALL RELEVANT INFORMATION REGARDING THE ROADWORK AND LANE CLOSURE(S)INCLUDING, BUT NOT LIMITED TO:THE LOCATION AT WHICH THE ROADWORK WILL BE TAKING PLACE; THE ENTITY, CONTRACTOR, VENDOR, AND SUBCONTRACTOR PERFORMING THE WORK; THE DATES AND TIMES OF EACH LANE I ROAD CLOSURE; THE DURATION OF THE ROADWORK PROJECT AND ASSOCIATED LANE CLOSURES (INCLUDING SPECIFICALLY WHICH, AND HOW MANY, LANES WILL BE CLOSED); THE NATURE OF THE CONSTRUCTION, MAINTENANCE, OR UTILITY-RELATED PROJECT AND WHY THE PROJECT AND LANE CLOSURES ARE NECESSARY; AND FURTHER, DIRECTING THE CITY ADMINISTRATION TO ASSIGN ONE (1) OR MORE CITY PERSONNEL TO ACTIVELY MONITOR EACH CONSTRUCTION, MAINTENANCE, OR UTILITY-RELATED PROJECT IN ORDER TO ENSURE THAT ALL LANES OF TRAVEL ARE REOPENED IN A TIMELY MANNER CONSISTENT WITH THE CONTRACT PLANS, PERMIT, ANDIOR ASSOCIATED MAINTENANCE OF TRAFFIC ("MOT"). WHEREAS, the closure of travel lanes for construction, maintenance, or utility-related roadwork within the City of Miami Beach ("City") can significantly impact traffic flow, public safety, and the daily lives of residents, businesses, and visitors; and WHEREAS, the Mayor and City Commission seek to ensure adequate transparency and coordination regarding such closures, so as to reduce disruptions and improve accountability; and WHEREAS, it is essential that the City Commission be provided with timely and comprehensive notice of any impending road or lane closures to enable appropriate oversight and communication with the public; and WHEREAS, proactive monitoring of such construction, maintenance, and utility-related projects by City personnel is necessary to ensure that work (whether on City, County, or State roads)is performed in accordance with all approved plans, permits, schedules, and maintenance of traffic("MOT') guidelines, and that affected lanes are reopened as promptly as possible; and WHEREAS, the Florida Department of Transportation ("FDOT") is an executive agency in the State of Florida whose mission is to provide a safe transportation system that ensures the mobility of people and goods, enhances economic prosperity, and preserves the quality of the State's environment and communities; and WHEREAS, FDOT has jurisdiction over the State Highway System,which includes certain roadways in the City such as 41st Street, Collins Avenue, Alton Road, the MacArthur Causeway, the Julia Tuttle Causeway, and the John F. Kennedy Causeway; and WHEREAS, in addition to State roads, there are also various Miami-Dade County ("County) roads located within the City; and WHEREAS, utility companies, such as Florida Power & Light ("FPL"), regularly conduct utility-related work on City, State, and County roadways, which often results in the closing of one or more lanes of travel; and WHEREAS, FOOT, the County, and FPL may also engage the services of contractor(s) who, in turn, may utilize certain subcontractor(s), regarding construction, maintenance, or utility- related projects on State, County, or City roadways; and WHEREAS, the City is concerned that these entities and/or their contractor(s)working on roadways in the City have erroneously closed lanes beyond the portion of the roadway designated for lane closures and/or disregarded the lane closure hours set forth in either the contract plans, permit, and/or MOT by closing lanes before and/or after the designated hours; and WHEREAS, these closures have caused major traffic impacts and created severe traffic problems, particularly during peak hours, for the City's residents and visitors; and WHEREAS, advance written notice (including all relevant information) to the Mayor and City Commission prior to the closure of any lanes of travel within the City for construction, maintenance, and utility-related purposes, along with dedicated City-personnel overseeing these projects involving lane closures, will improve accountability and enable appropriate communication and oversight. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby direct the City Administration to provide the Mayor and City Commission with at least 72 hours' advance written notice prior to the closure of any lane(s) of travel for any construction, maintenance or utility-related road closure(s), and directing that such notice contain all relevant information regarding the roadwork and lane closure(s) including, but not limited to: the location at which the roadwork will be taking place; the entity, contractor, vendor, and subcontractor performing the work; the dates and times of each lane/road closure; the duration of the roadwork project and associated lane closures(including specifically which, and how many, lanes will be closed); the nature of the construction, maintenance, or utility-related project and why the project and lane closures are necessary; and further, directing the City Administration to assign one (1) or more City personnel to actively monitor each construction, maintenance, or utility-related project in order to ensure that all lanes of travel are reopened in a timely manner consistent with the contract plans, permit, and/or associated maintenance of traffic ("MOT").
