2013-28372 Reso RESOLUTION NO. 2013-28372 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY ATTORNEY TO NOMINATE ROBERT MYERS TO CONDUCT AN INVESTIGATION INTO THE DEBARMENT OF UTA MANAGEMENT, LLC AND ITS AFFILIATES AND MAKE A RECOMMENDATION AS TO WHETHER OR NOT DEBARMENT IS WARRANTED. WHEREAS, on July 17, 2013, Commissioner Wolfson initiated a complaint to the City Manager to initiate debarment proceedings against UTA Management , LLC ("UTA") and its affiliates alleging that its principal, Robert Wennett engaged in unregistered lobbying on at least three (3) separate occasions and that Mr. Wennett was untruthful in an affidavit that he submitted in connection with his company's response to the redevelopment of the Convention Center Request for Qualifications ("RFQ"); and WHEREAS, at its September 11, 2013 meeting, the City Commission expressed concerns in connection with the formal complaint made by Commissioner Wolfson against ("UTA") on its failure to comply with the city's lobbyist registration requirements; and WHEREAS, a motion was made by Commissioner Gongora, and seconded by Commissioner Libbin to accept the City Attorneys recommendation to nominate Robert Myers to conduct and make a recommendation vis-a-vis the disbarment of UTA in connection with its failure to comply with the city's lobbyist registration requirements and with its affidavit submitted in response to the RFQ. NOW THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the City Attorney to nominate Robert Myers to conduct an investigation into the debarment of UTA Management, LLC and its affiliates and make a recommendation as to whether or not debarment is warranted. Morales, City Manager / � RJ' : DATE: September 11, 2013 SUBJECT: DISCUSSION REGARDING A REQUEST FOR DEBARMENT OF UTA MANAGEMENT, LLC AND ITS AFFILIATES BACKGROUND/ANALYSIS On July 12, 2013, the City Manager's Office received the attached request for debarment of UTA Management, LLC, and its Affiliates, alleging improper action by, among others, Robert S. Wennett. Thereafter, on July 22, 2013 the City Attorneys Office received a response to the request for debarment from the law firm of Bilzin Sumberg, defending the actions of Mr. Wennett. A hard copy of each is being provided to you via hand out. Section 2-405 of the City Code, which sets forth debarment and suspension procedures, has been amended since the time of these allegations. The City Attorney has opined that the Code sections in place at the time of the alleged actions should govern this debarment request. Consequently, that Code requires the City Manager to'transmit the request to the Mayor and City Commission at a regularly scheduled meeting? Accordingly, this memorandum, and its attachments, shall serve as the transmittal required by the Code.
