MIAMI-DADE COUNTY PUBLIC SCHOOLS BOARD, AND BARRY
UNIVERSITY FOR THE ADDITION OF BARRY UNIVERSITY AS A
PARTNER TO PROVIDE DUAL ENROLLMENT COURSES AT MIAMI
BEACH SENIOR HIGH SCHOOL FOR THE 2025-26 SCHOOL YEAR
AND EACH SUBSEQUENT YEAR, SUBJECT TO FUNDING APPROVAL
DURING THE CITY'S BUDGETARY PROCESS; AND FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL
DOCUMENTS OR AGREEMENTS IN CONNECTION WITH THE
PROGRAM.
WHEREAS, on September 11, 2019, the Mayor and City Commission adopted
Resolution No. 2019-30958, approving an agreement between the City of Miami Beach
("CMB") and Miami- Dade County School Board ("M-DCPS") to provide dual enrollment
courses for the 2019- 2020 school year taught at Miami Beach Senior High School (the
"High School"), and Miami Beach Nautilus Middle School f/k/a Nautilus Middle School
(the "Middle School"), through Miami Dade College ("MDC"), for college credit for 8th
grade students attending the Middle School, Miami Beach Fienberg Fisher K- 8 center,
and for 9th, 10th, 11th and 12th grade students attending the High School, in an amount
not to exceed $ 28,000.00 ("City' s Contribution"); and approving the funding of the City'
s Contribution for the 2019-2020 school year from the City' s 2018- 2019 FY budget; and
further approving the City' s Contribution to the program for each subsequent school year,
subject to funding approval during the City' s budgetary process and provided that the
City' s contribution amount does not exceed $28,000.00; and
WHEREAS, on November 8, 2019, the City and M-DCPS executed an agreement
("Agreement") setting forth the guidelines for the City to support the dual enrollment
courses offered at the High School and the Middle School; and
WHEREAS, on August 19, 2020, the Parties executed Amendment No. 1 to the
Agreement to continue the program for the 2020-2021 school year, as MDC resources
permitted; and
WHEREAS, on February 10, 2021, the Mayor and City Commission adopted
Resolution No. 2021-31572, approving Florida International University ("FIU") as an
additional provider of dual enrollment courses under the Agreement; and
WHEREAS, on May 8, 2021, the Parties executed Amendment No. 2 to the
Agreement to allow CMB to maximize the number of dual enrollment course offerings for
the 2020-2021 school year, based upon the approved budget for the program, by adding
FIU as an additional educational partner; and
WHEREAS, on June 18, 2021, the Parties executed Amendment No. 3 to the
Agreement to allow CMB to maximize the number of dual enrollment course offerings for
the 2021-2022 school year, based upon the approved budget for the program; and
WHEREAS, on April 6, 2022, the Mayor and City Commission adopted Resolution
No. 2022-32099, authorizing the City Manager to execute an agreement with the
University of Florida ("UF")and Miami-Dade County Public Schools(M-DCPS), to provide
dual enrollment courses at Miami Beach Senior High School for the 2022-2023 school
year, in an amount not to exceed $13,432.00, and every subsequent school year, subject
to annual budget approval by the City Commission of the City's contribution for each
subsequent school year; and
WHEREAS, on August 5, 2022, the Parties executed Amendment No. 4 to the
Agreement to allow CMB to maximize the number of dual enrollment course offerings for
the 2022-2023 school year, based upon the approved budget for the program; and
WHEREAS, to promote educational opportunities through the dual enrollment
program in Miami-Dade County, MDC and M-DCPS entered into the 2023-2024 Dual
Enrollment Articulation Agreement in July 2023, which is incorporated herein by reference
and attached hereto as Composite Exhibit A; and
WHEREAS, to promote educational opportunities through the dual enrollment
program in Miami-Dade County, Fill and M-DCPS entered into the 2023-2024 Dual
Enrollment Articulation Agreement in July 2023, which is attached as Exhibit A, and is
incorporated herein by reference and attached hereto as Composite Exhibit A; and
WHEREAS, to promote educational opportunities through the dual enrollment
program in Miami-Dade County, UF and M-DCPS entered into the 2023-2024 Dual
Enrollment Articulation Agreement in July 2023, which is attached as Exhibit A, and is
incorporated herein by reference and attached hereto as Composite Exhibit A; and
WHEREAS, the Dual Enrollment Articulation Agreements with MDC, FIU and UF
shall be collectively referred to herein as the "Articulation Agreement"; and
WHEREAS, on July 28, 2023, the Parties executed Amendment No. 5 to the
Agreement to allow CMB to maximize the number of dual enrollment course offerings for
the 2023-2024 school year, based upon the approved budget for the program; and
WHEREAS, on May 27, 2024, the Parties executed Amendment No. 6 to the
Agreement to allow CMB to maximize the number of dual enrollment course offerings for
the 2024-2025 school year, based upon the approved budget for the program; and
WHEREAS, on July 24, 2024 the Mayor and City Commission adopted Resolution
No. 2024-33180, approving an agreement between the City and Miami-Dade County
Public Schools Board for the City to fund dual enrollment courses through Miami-Dade
College ("MDC"), Florida International University ("FIU") and the University of Florida

("UF") at Miami Beach Nautilus Middle School and Miami Beach Senior High School; and
WHEREAS, Resolution No. 2024-33180 allowed for funds in the amount of
$41,432 to be used as needed to meet the needs of the community through all approved
providers of dual enrollment courses for the 2024-2025 school year and each subsequent
year; and
WHEREAS, the proposed agreement will expand options for students for dual
enrollment courses at Miami Beach Senior High School by including Barry University as
a partner and enter into an agreement with Miami Dade County Public Schools and Barry
University beginning in the 2025-26 school year.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby amend Resolution No. 2024-33180 to approve an agreement
between the City of Miami Beach, Miami-Dade County Public Schools Board, and Barry
University for the addition of Barry University as a partner to provide dual enrollment
courses at Miami Beach Senior High School for the 2025-26 School Year and each
subsequent year, subject to funding approval during the City's budgetary process; and
further authorize the City Manager to execute any and all documents or agreements in
connection with the Program.

RECOMMENDATION
City Administration recommends the inclusion of Barry University, Inc. as a dual enrollment
provider for students at Miami Beach Senior High School.
BACKGROUND/HISTORY
On November 8, 2019, the City and the Miami-Dade County School Board executed an
agreement setting forth the guidelines for the City to support the dual enrollment courses offered
at Miami Beach Senior High School and Miami Beach Nautilus Middle School. Multiple
amendments between Fiscal Year 2020 and Fiscal Year 2024 were executed to increase access
for students to multiple universities/colleges including Miami-Dade College, Florida International
University, and University of Florida.
On July 24, 2024, the Mayor and City Commission adopted Resolution No. 2024-33180
(Attachment A), authorizing the use of the $41,432 allocation for the partnerships at any of the
approved universities/colleges in order to meet student needs for dual enrollment courses during
the 2024-2025 school year and subsequent years.
ANALYSIS
Approving an agreement between the City of Miami Beach, the Miami-Dade County School
Board, and Barry University, Inc. for additional dual enrollment courses at Miami Beach Senior
High School will support student requests (Attachment B). The inclusion of Barry University, Inc.
as a partner will not increase the current funding allocation.

WHEREAS, In January 2008, the City of Miami Beach, Florida ("City") entered into an
Education Compact with Miami-Dade County Public Schools ("M-DCPS") to enhance learning
opportunities for youth; and
WHEREAS, the Education Compact reflects the desire of the Miami Beach community
to support excellence in the City's public schools; and
WHEREAS, the Florida International University ("FIU") First Generation Scholarship
Program is supported by an innovative matching grant program established in 2006 by the
Florida Legislature; and
WHEREAS, the program provides financial support to qualified undergraduate FIU
students who are the first generation in their families to attain a college degree; and
WHEREAS, this program is the only one of its kind in the state of Florida to match
private donations for first generation scholarships, providing financial assistance for students to
attend a state university or state college; and
WHEREAS, to date, FIU has awarded over 15,300 scholarships for critical financial
support for FIU students; and
WHEREAS, the need, however, is far greater than the available resources — currently,
less than one in seven eligible students receives a First Generation Scholarship; and
WHEREAS, as a result, many talented and highly motivated students with limited
resources are forced to attend only part-time or postpone their education altogether; and
WHEREAS, the First Generation Scholarship Program is, therefore, a vital source of
financial support for many of FIU's underserved, low-income students that bridges the gap
between their financial aid funding and their unmet need to fund their cost of attendance at FIU;
and
WHEREAS, increased scholarship and program financial aid are critical to ensure that
all deserving students receive the assistance needed to enroll, succeed, and graduate.; and
WHEREAS, FIU serves more than 58,000 students, 70% of whom are undergraduates,
approximately 90% of FIU undergraduate students are minorities, and nearly 25% self-identify
as first generation college students; and
WHEREAS, first generation students are more likely than their peers to come from
lower-earning households, and yet, despite the significant need, a high percentage of FIU
students receive only partial financial aid, and many students eligible for First Generation
Scholarships remain unfunded; and
WHEREAS, in 2020-21, donor investment and state-matched funds supported 889
students, while 6,555(88.1%)students did not receive funding; and
WHEREAS, investing in FIU's First Generation Scholarship Program will benefit not only
the students, but the greater Miami Beach community; and
WHEREAS, on September 14, 2022, the Mayor and City Commission adopted
Resolution No. 2022-32286, approving and authorizing the City Manager and City Clerk to
execute agreements with the Miami Beach Police Athletic League, Inc. ("MBPAL") and the
Miami Beach Chamber Education Foundation, Inc. ("MBCEF') to provide funding to First
Generation College Scholarships for Miami Beach residents through agreements with Florida
International University Foundation, Inc. as part of the State of Florida 2:1 matching grant, with
the total amount of funding from the City of Miami Beach not to exceed $28,000 for School Year
2022-23, and each subsequent year, and$3,500 each from the MBPAL and MBCEF, subject to
funding approval during the City' s budgetary process; and further authorize the City Manager to
execute any and all documents or agreements in connection with the program; and
WHEREAS, the City of Miami Beach contributed $28,000 for MBPAL which contributed
$3,500, and the MBCEF which contributed $3,500, for total investment in the FIU First
Generation Scholarship in the amount of$35,000 in school years 2022-23 and 2023-24; and
WHEREAS, FIU Foundation, Inc. matching funds provided an additional $70,000 which
is a 2:1 match yielding a total amount of$105,000 for FIU first-generation scholarships; and
WHEREAS, a total of $210,000 has been awarded to 101 Miami Beach residents
through the First Generation College Scholarship; and
WHEREAS, in the 2022-2023 academic school year 44 residents were awarded $2,387
each. In the 2023-2024 academic school year 56 residents were awarded $1,875; and
WHEREAS, the total contribution for fiscal year 2025 has been increased by 10% by all
partners; and
WHEREAS, the City of Miami Beach will contribute $30,800 annually, the Miami Beach
Chamber Education Foundation will contribute $3,900 annually, the Police Athletic League will
contribute$3,900 annually, and FIU will contribute $77,200; and

WHEREAS, funding will be prioritized to meet the needs of students who are degree-
seeking undergrad students with a permanent address in the City and with zip codes of 33139,
33140, and 33141 (only residents in the City)with a preference for First Time in College (FTIC)
students; and
WHEREAS, should there be no eligible FTIC students, other Miami Beach students will
be eligible, and funding will be awarded based on financial need as indicated by the FAFSA
'unmet need' of the student; and
WHEREAS, in an event where there will not be enough students eligible to award the
funds that meet these criteria, funds will be rolled over to the following year or scholarship
amounts per student can be increased; and
WHEREAS, scholarships may be renewable upon meeting certain criteria including
recipients demonstrating financial need by completing the national Free Application for Federal
Student Aid (FAFSA) and being eligible for a Pell Grant, recipients must also be the first
generation in their family to attain a college bachelor's degree (students whose siblings have
attained or are pursuing a degree are also eligible, recipients must be residents of the State of
Florida, be enrolled in or accepted for admission to the FIU, and be a degree-seeking
undergraduate student enrolled for a minimum of six credit hours per semester.

On September 14, 2022 Resolution No. 2022-32286 was passed to approve and authorize the City Manager and City Clerk to
execute agreements with the Miami Beach Police Athletic League, Inc. (MBPAL) and the Miami Beach Chamber Education
Foundation. Inc. (MBCEF) to provide funding for First Generation College Scholarships for Miami Beach residents through
agreements with Florida International University Foundation, Inc. as part of the State of Fonda 2:1 matching grant,with the total
amount of funding from the City of Miami Beach not to exceed $28,000 for Sdaol Year 2022- 2023, and $3,500 each from the
MBPAL and MBCEF and oath subsequent year,subject to funding approval during the Cites budgetary process.
As of the 2023-2024 academic school year the State of Florida program no longer provide a 2.1 matching grant due to insufficient
funding. As such.the FIU Foundation Inc.continues to match Miami Beach contributions with a 2:1 matching grant.

MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY
MANAGER AND CITY CLERK TO EXECUTE AGREEMENTS WITH THE
MIAMI BEACH POLICE ATHLETIC LEAGUE, INC. ("MBPAL") AND THE
MIAMI BEACH CHAMBER EDUCATION FOUNDATION, INC. ("MBCEF") TO
PROVIDE FUNDING TO FIRST GENERATION COLLEGE SCHOLARSHIPS
FOR MIAMI BEACH RESIDENTS THROUGH AGREEMENTS WITH FLORIDA
INTERNATIONAL UNIVERSITY FOUNDATION, INC. AS PART OF THE
STATE OF FLORIDA 2:1 MATCHING GRANT, WITH THE TOTAL AMOUNT
OF FUNDING FROM THE CITY OF MIAMI BEACH NOT TO EXCEED $211,000
FOR SCHOOL YEAR 2022-23, AND $3,500 EACH FROM THE MBPAL AND
MBCEF AND EACH SUBSEQUENT YEAR, SUBJECT TO FUNDING
APPROVAL DURING THE CITY'S BUDGETARY PROCESS; AND FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND AU.
DOCUMENTS OR AGREEMENTS IN CONNECTION WITH THE PROGRAM.
WHEREAS, in January 2008, the City of Miami Beach, Florida ("City) entered into an
Education Compact with Miami-Dade County Public Schools (M-DCPS) to enhance learning
opportunities for youth; and
WHEREAS, the Education Camped reflects the desire of the Miami Beach community
to support excellence in the Citys public schools;and
WHEREAS, the Florida International University (FIU) First Generation Scholarship
Program is supported by an innovative matching grant program established in 2006 by the
Florida Legislature:and
WHEREAS, the program provides financial support to qualified undergraduate FIU
students who are the first generation in their families to attain a college degree; and
WHEREAS, this program is the only one of its kind in the state of Florida to match
private donations for first generation scholarships, providing financial assistance for students to
attend a state university or state college; and
WHEREAS, to date, FIU has awarded over 15,300 scholarships for critical financial
support for FIU students; and
WHEREAS, the need, however, is far greater than the available resources — currently,
less than one in seven eligible students receives a First Generation Scholarship; and
WHEREAS, as a result, many talented and highly motivated students with limited
resources are forced to attend only part-time or postpone their education altogether; and
WHEREAS, the First Generation Scholarship Program is, therefore, a vital source of
financial support for many of FRY underserved, low-income students that bridges the gap
between their financial aid funding and their unmet need to fund their cost of attendance at FlU;
and

WHEREAS, increased scholarship and program financial aid are critical to ensure that
all deserving students receive the assistance needed to enroll, succeed, and graduate.;and
WHEREAS, FIU serves more than 58,000 students, 70% of whom am undergraduates,
approximately 90% of FIU undergraduate students are minorities, and nearly 25% self-identify
as first generation college students; and
WHEREAS, first generation students are more likely than their peers to come from
lower-earning households, and yet, despite the significant need, a high percentage of FIU
students receive only partial financial aid, and many students eligible for First Generation
Scholarships remain unfunded; and
WHEREAS, in 2020-21, donor investment and state-matched funds supported 889
students,while 8,555(88.1%)students did not receive funding;and
WHEREAS, Investing in FIU's First Generation Scholarship Program will benefit not only
the students, but the greater Miami Beach community; and
WHEREAS, the City of Miami Beach will contribute $28,000 for First Generation
Scholarships and partner with the Miami Beach Police Athletic League, Inc. ('MBPAL') which
will contribute $3,500, and the Miami Beach Chamber Education Foundation, Inc. ('MBCEF)
which will also contribute$3,500, for total investment in the FIU First Generation Scholarship in
the amount of$35,000; and
WHEREAS, the Florida state matching funds will provide an additional $70,000 which is
a 2:1 match yielding a total amount of$105,000 for FIU first-generation scholarships; and
WHEREAS, approximately 30 students who are residents of the City would receive a
$3,500 scholarship In the 2022-23 school year, and
WHEREAS, funding will be prioritized to meet the needs of students who are degree-
seeking undergrad students with a permanent address in the City and with zip codes of 33139,
33140, and 33141 (only residents in the City)with a preference for First Time in College(FTIC)
students:and
WHEREAS, should there be no eligible FTIC students, other Miami Beach students will
be eligible, and funding will be awarded based on financial need as indicated by the FAFSA
"unmet need"of the student end
WHEREAS, in an event where there will riot be enough students eligible to award the
funds that meet these criteria, funds will be rolled over to the following year or scholarship
amounts per student can be increased;and
WHEREAS, scholarships may be renewable upon meeting certain criteria including
recipients demonstrating financial need by completing the national Free Application for Federal
Student Aid (FAFSA) and being eligible for a Pell Grant, recipients must also be the first
generation in-their family to attain a-college bachelor's degree (students whosesiblings have
attained or are pursuing a degree are also eligible, recipients must be residents of the State of
Florida, be enrolled in or accepted for admission to the FIU, and be a degree-seeking
undergraduate student enrolled for a minimum of six credit hours per semester.

NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CRY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve and authorize the City Manager and City Clerk to execute
agreements with the Miami Beach Police Athletic League, Inc. ('MBPAL-)and the Miami Beach
Chamber Education Foundation, Inc. rMBCEP)to provide funding to Fast Generation College
Scholarships for Miami Beach residents through agreements with Florida International
University Foundation, Inc. as part of the State of Florida 2:1 matching grant, with the total
amount of funding from the City of Miami Beach not to exceed $28,000 for School Year 2022-
23, and $3,500 each from the MBPAL and MBCEF and each subsequent year, subject to

WHEREAS, dual enrollment is a program that allows eligible high school and middle
school students currently attending accredited Miami Dade County public schools, private high
schools, or home schools, to enroll in a college course while attending high school or middle
school; and
WHEREAS, the credits that students earn in the dual enrollment program must be
applicable toward a high school diploma and postsecondary educational title, such as a college
associate, a baccalaureate degree, or a technical certificate; and
WHEREAS, due to state funding changes for dual enrollment courses in July 2013, M-
DCPS is responsible for reimbursing colleges for instructor and administrative fees, which has
limited the number of courses offered due to available funding and credentialing limitations of
instructional school staff; and
WHEREAS, on May 21, 2014, the Mayor and City Commission adopted Resolution No.
2014-28601 to support dual enrollment at Miami Beach Senior High School beginning in Spring
2015 through Florida International University at an amount not to exceed $20,000; and
WHEREAS, prior to the City providing this enhancement, dual enrollment was not offered by the
high school or offered sporadically; and

WHEREAS, dual enrollment courses save students and parents money, as dual enrollment
students are exempt from paying application, registration, tuition, laboratory, and special fees if
the classes taken are being used toward high school graduation; and
WHEREAS, at the July 6, 2016, Finance and Citywide Projects Committee ('FCWPC")
meeting,the committee recommended accepting the enhancement request of$13,000 to expand
dual enrollment options at Miami Beach Nautlus Middle School and Miami Beach Senior High
School, through a partnership between the City, Miami Dade College, and Miami-Dade County
Public Schools; and
WHEREAS, at the July 13, 2016, City Commission meeting, a discussion relating to the
expansion of dual enrollment options at Miami Beach Nautilus Middle School and Miami Beach
Senior High School,was referred to the Neighborhoods/Community Affairs Committee CNCAC").
The NCAC unanimously recommended the enhancement in the Citys FY 17 budget and the
FCWPC unanimously recommended expanding the dual enrollment program; and
WHEREAS, on August 26, 2016,the Mayor and City Commission adopted Resolution No.
2016-29537, accepting the recommendations of the FCWPC and the NCAC, and authorizing the
City to execute an agreement with Miami Dade College and M-DCPS, to provide dual enrollment
courses taught at Miami Beach Senior High School, Miami Beach Nautilus Middle School, for 8th
grade students attending the Middle School and Miami Beach Fienberg Fisher K-8 Center during
the 2016-2017 school year, and
WHEREAS,on September 11,2019, the Mayor and City Commission adopted Resolution
No. 2019-30958, approving an agreement between the City of Miami Beach and the Miami-Dade
County School Board to provide dual enrollment courses for students attending Miami Beach
Senior High School, in an amount not to exceed $28,000; and
WHEREAS, on November 8, 2019, the City and M-DCPS executed Amendment No. 1 to
the agreement extending the program for the 2020-2021 school year, and
WHEREAS,on May 8, 2022,Amendment No.2 to the Agreement was executed to include
Florida International University(FIU)as an additional provider of dual enrollment courses, so that
the City, through its partnership with M-DCPS, may maximize the amount of dual enrollment
courses that may be offered at the High School and the Middle School, based upon the approved
City Contribution; and
WHEREAS, on February 10, 2020, the Mayor and City Commission adopted Resolution
No. 2021-31572, amending Resolution Nc. 2019-30958, which approved an agreement between
the City and Miami-Dade County School Board for the City to fund dual enrollment courses,
through Miami Dade College, at Miami Beach Nautilus Middle School and Miami Beach Senior
High School; said amendment adding Florida International University as an additional provider of
dual enrollment courses; and
WHEREAS, on April 6, 2022, the Mayor and City Commission adopted Resolution No.
2022-32099,which approved an agreement with the University of Florida and Miami-Dade County
Public Schools to provide dual enrollment courses, for college credit, for students at Miami Beach
Senior High School. The City's partnership with OF provides funding in the amount of$13,432 to
cover the cost for instructors, approximately $6,716 per course per semester, for eligible and
credentialed teachers, City Staff, and Miami Beach residents, in an amount not to exceed
$13,432; and

WHEREAS, the City's partnership with UF continues to expand with two new Artificial
Intelligence (Al)dual enrollment courses available in the 2024-25 school year; and
WHEREAS, MESH will be the only high school in the state to offer Al classes with a UF
professor; and
WHEREAS, as such, this amendment will allow for the utilization of the allocated funds of
$41,432 to be used for dual enrollment courses offered through FIU, MDC. and UF based on
student interest on a school-year basis; and
WHEREAS, the flexibility to utilize the funds allocated, in an amount of$41,432, for dual
enrollment at both MBSH and MBNMS through partnerships with FIU, MDC.and UF will allow the
City and M-DCPS to meet the needs of the Miami Beach community within the public schools;
and
WHEREAS, the City Manager recommends authorizing the City to execute Amendment
No. 3 to the Agreement, to maximize the number of dual enrollment courses that may be offered
at Miami Beach Senior High School and Miami Beach Nautilus Middle School through any
combination of the approved providers including Florida International University, Miami Dade
College, and University of Florida.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby authorize the City Manager to negotiate and execute an amendment to
Resolution No.2019-30958, Resolution No.2021-31572,and Resolution No. 2022-32099, which
approved an agreement between the City and Miami-Dade County School Board for the City to
fund dual enrollment courses, through Miami Dade College. Florida International University, and
University of Florida, at Miami Beach Nautilus Middle School and Miami Beach Senior High
School; said amendment allowing for funds in the amount of$41,432 to be used as needed to
meet the needs of the community through all approved providers of dual enrollment courses for
the 2024-2025 school year and each subsequent year thereafter, subject to funding approval
during the CiWs budgetary process; and further authorize the City Manager to execute any and
all documents or agreements in connection with the program.

The Administration recommends authorizing the City Manager to execute Amendment No. 3 to

On May 21,2014,the Mayor and City Commission adopted Resolution No.2014-28601 to support
dual enrollment at Miami Beach Senior High School beginning in Spring 2015 through Florida
International University at an amount not to exceed 820,000. Prior to the City providing this
enhancement, dual enrollment was not offered by the high school or offered sporadically. Dual
enrollment courses save students and parents money, as dual enrollment students are exempt
from paying application, registration, tuition. laboratory, and special fees if the classes taken are
being used toward high school graduation. At the July 6, 2016, Finance and Citywide Projects
Committee(FCWPC)meeting,the committee recommended accepting the enhancement request
of$13,000 to expand dual enrollment options at Miami Beach Nautilus Middle School and Miami
Beach Senior High School, through a partnership between the City, Miami Dade College, and
Miami-Dade County Public Schools. At the July 13.2016.City Commission meeting,a discussion
relating to the expansion of dual enrollment options at Miami Beach Nautilus Middle School and
Miami Beach Senior High School, was referred to the Neighborhoods/Community Affairs
Committee (NCAC). The NCAC unanimously recommended the enhancement in the Citys FY
2017 budget and the FCWPC unanimously recommended expanding the dual enrollment
program.
On August 26, 2016, the Mayor and City Commission adopted Resolution No. 2016-
29537(Attachment A), accepting the recommendations of the FCWPC and the NCAC, and
authorizing the City to execute an agreement with Miami Dade College and M-DCPS, to provide
dual enrollment courses taught at Miami Beach Senior High School,Miami Beach Nautilus Middle
School,for 8th grade students attending the Middle School and Miami Beach Fienberg Fisher K-
8 Center during the 2016-2017 school year.
On September 11, 2019, the Mayor and City Commission adopted Resolution No. 2019-30958
(Attachment B), approving an agreement between the City of Miami Beach and the Miami-Dade
County School Board to provide dual enrollment courses for students attending Miami Beach
Senior High School, in an amount not to exceed $28,000.
On November 8, 2019, the City and M-DCPS executed Amendment No. 1 to the agreement
extending the program for the 2020-2021 school year.
Amendment No.2 to the Agreement was executed on May 8,2022,to include Florida International
University (FIU)as an additional provider of dual enrollment courses, so that the City, through its
partnership with M-DCPS, may maximize tie amount of dual enrollment courses that may be
offered at the High School and the Middle School, based upon the approved City Contribution.
On February 10. 2020, the Mayor and City Commission adopted Resolution No. 2021-31572
(Attachment C), amending Resolution No. 2019-30958, which approved an agreement between
the City and Miami-Dade County School Board for the City to fund dual enrollment courses,
through Miami Dade College, at Miami Beach Nautilus Middle School and Miami Beach Senior
High School: said amendment adding Florida International University as an additional provider of
dual enrollment courses.
On April 6, 2022, the Mayor and City Commission adopted Resolution No. 2022-32099
(Attachment D), which approved an agreement with the University of Florida and Miami-Dade
County Public Schools to provide dual enrollment courses,for college credit,for students at Miami
Beach Senior High School. The City's partnership with OF provides funding in the amount of
813,432 to cover the cost for instructors, approximately $6,716 per course per semester, for
eligible and credentialed teachers, City Staff and Miami Beach residents, in an amount not to
exceed $13,432.

Funding to support and expand the partnership in the 2023-2024 school year included an
estimated City contribution of$104,000 for instructor salaries and MDCPS estimated contribution
of$28,560 for textbooks. This partnership also supports class size reduction.

priority outcomes of the Mayor and City Commission were formally adopted on March 5, 2014

WHEREAS, Resolution No. 2014-28525 established the KIO to Induce Public School
Accountability Mainly at Middle School and Achieve K-12 Educational Excellence; and
WHEREAS, at the July 6, 2016 Finance and Citywide Projects Committee meeting, the
Committee recommended accepting the enhancement request of $13,000 to expand dual
enrollment options at Nautilus Midde School and Miami Beach Senior High School, through a
partnership with the City. Miami-Dade College. and Miami-Dade County Public Schools via the
Education Compact Fund, and further approved a unanimous favorable recommendation at its
July 22, 2018 meeting;and
WHEREAS, discussion item CAA on the July 13. 2016 City Commission agenda,
regarding a partnership with Miami-Dade College and Miami-Dade County Public Schools for
the expansion of Dual Enrollment options with Nautilus Middle School and Miami Beach Senior
High School, was referred to and received a unanimous favorable recommendation from the
Neighborhoods/Community Affairs Committee at its July 15, 2018 meeting as a recommended
enhancement in the City's 2018/17 fiscal budget, and
WHEREAS,the graduation rate at Miami Beach Senior High School (MBSH)was 79.4%
in 2015, a 16.7% increase from 2010; and

WHEREAS, M-DCPS climate survey data for the 201415 School Year reflected that
75% and 87% of parents, and 91% and 93% of school staff, agree or strongly agree that
children are receiving a good education at Miami Beach Senior High School and Nautilus Middle
School, respectively, and that 55% and 67% of students at those schools agree or strongly
agree that they are receiving a good education, and
WHEREAS, an activity included in the Education Compact to increase academic support
and achievement is to identify and pursue the implementation of best practices strategies to
increase the graduation rate at MBSHS; and. Dual Enrollment programs are best practice
programs that enrich the course opportunities for outstanding high school students and saves
students and parents money; and
WHEREAS, Dual Enrollment is a program that allows eligible high school and middle
school students currently attending accredited MiamFDade County public or private high
schools, or home schools, to enroll in a college course while attending high school or middle
school. The credits that students earn must be used toward both a high school diploma and are
acceptable towards a college Associate or Baccalaureate degree, or a Technical Certificate
and
WHEREAS, students in the 611, 7111, 81N, el, 10114, 111M, and 12" grades that are
enrolled in M-DCPS are eligible to participate in Dual Enrollment programs and must meet
specific criteria; and
WHEREAS, Miami-Dade College (MDC) currently offers dual enrollment courses in
approximately 34 out of 53 high schools and two (2)middle schools across Miami-Dade County;
and
WHEREAS, due to state funding changes for Dual Enrollment comes in July 2013,
individual high schools are responsible for reimbursing colleges for instructor and administrative
fees. As such, the number of courses offered is limited due to available funding, along with
credentialing limitations of instructional school staff; and
WHEREAS, the City Administration recommends, and it would be in the best interest of
high school and middle school students attending public school in the City, that the City of
Miami Beach enter into an agreement with MDC to allow for the credentialing of eligible City
staff, as well as qualified residents, to increase the number of Dual Enrollment courses available
at Miami Beach Senior High School and Nautilus Middle School for upcoming School Years;
and
WHEREAS, a City of Miami Beach partnership with MDC woad provide funding for
instructors at a cost of approximately 54,330 per course per semester for eligible and
credentialed City staff and Miami Beach residents, not to exceed two (2) Dual Enrollment
courses during the 2018.17 School Year at Miami Beach Senior High School and one (1) Dual
Enrollment courses during the 2018.17 School Year at Nautilus Middle School, with the
expectation that the number of Dual Enrollment courses offered each subsequent School Year
would increase; and
WHEREAS, students attending Fienberg Fisher K-8 Center will also be able to enroll in
the Dual Enrollment courses offered at Nautilus Middle School.

The graduation rate at Miami Beach Senior High School at 79.4 percent in 2015, Is a 16.7 percent

• A ninimum 3.0 high school unweighted grade point average(GPA)
• Passed the appropriate sections of the College's Basic Skills Assessment Tests (PERT or
CPT),or submitted adequate SAT/ACT scores,or submitted adequate FCAT scores.
• Pemission from the parent/guardian,high school principal and counselor
• Met with the Colege Dual Enrollment Coordinator at the Carrpus he/she plans to attend
• An understanding that the amount of work necessary to succeed in dual enrolment courses
will be greater than in high school courses and must earn a grade of "C or higher in their
college4evel courses to continue participation. Students whose College GPA falls below 2.0
are ineligible to continue dual enrollment.
Due to legislative changes (Senate Bill 1514), funding for the dual enrollment program changed,
effective July 1, 2013. Previously, community colleges and universities assured the cost of dual
enrollment Students are exempt from paying for tuition, however, stools mist reimburse the
college/university for college credit comes (dual enfdlmmnt) taken by eligible high school and
middle school students, who mat have a 3.0 unweighted GPA and be colege-ready in Reading and
Writing per state-approved tests(PERT, SAT/ACT, FCAT).
As such, the number of courses offered is limited due to available funding, along with credentialing

courses in approximately 34 out of 53 high schools and two (2) middle schools across Miami-Dade

as the college associate, a baccalaureate degree, or a technical certificate; and
WHEREAS, students in 8th, 9'^, and 10t grades that are enrolled in M-DCPS
are eligible to participate in dual enrollment programs and must meet specific criteria;
and
WHEREAS, due to state funding changes for dual enrollment courses in July
2013, M-DCPS is responsible for reimbursing colleges for instructor and administrative
fees; therefore, limiting the number of courses offered due to available funding and
credentialing limitations of instructional school staff; and
WHEREAS, Miami Dade College ("MDC) currently offers a dual enrollment
courses in approximately 34 out of 53 high schools and two (2) middle schools across
Miami-Dade County; and
WHEREAS, at the January 31, 2014 Miami Beach City Commission Retreat,
the Key Intended Outcomes ("KIO') in the City's Strategic Plan were discussed and
amendments to the priority outcomes of the Mayor and City Commission were formally
adopted on March 5, 2014 pursuant to Resolution No.2014-28525; and
WHEREAS, Resolution No. 2014-28525 established the KIO to "Induce Public
School Accountability Mainly at Middle School and to "Achieve Educational K-12
Excellene; and
WHEREAS, the City of Miami Beach has supported dual enrollment at Miami
Beach Senior High School since Spring, 2015 for 11°' and 12th graders through Florida
International University; and
WHEREAS, prior to the City providing this enhancement, dual enrollment was
not offered by the high school or offered sporadically; and
WHEREAS, since the implementation of the program, in Spring 2015,there was
a financial savings, in the amount of$440,907.39 (based on 2018-2017 Florida State
tuition rates), to Miami Beach families for those children choosing to enroll in dual
enrollment courses; and
WHEREAS, dual enrollment courses save students and parents money,as dual
enrollment students are exempt from paying application, registration, tuition,
laboratory, and special fees if the classes taken are being used toward high school
graduation; and
WHEREAS, at the July 8, 2018 Finance and Citywide Projects Committee
("FCWPC")meeting,the committee recommended accepting the enhancement request
of $13,000 to expand dual enrollment options at Nautilus Middle School and Miami
Beach Senior High School, through a partnership between the City, Miami Dade
College,and Miami-Dade County Public Schools via the Education Compact Fund; and

WHEREAS, at the July 13,2016 City Commission meeting,a discussion relating
to the expansion of dual enrollment options at Nautilus Middle School and Miami Beach
Senior High School, was referred to the Neighborhoods/Community Affairs Committee
('NCAC");
WHEREAS, at its July 15,2016 meeting,the NCAC unanimously recommended
the enhancement in the City's 2018-2017 fecal budget; and
WHEREAS, at its July 22, 2016 meeting, the FCWPC unanimously
recommended expanding the dual enrollment program; and
WHEREAS, on August 26, 2016, the Mayor and City Commission adopted
Resolution Number No. 2016-29537, accepting the recommendations of the FCWPC
and the NCAC, and authorizing the City to execute an agreement with Miami Dade
College and M-DCPS, to provide dual enrollment courses taught at Miami Beach
Senior High School (the "High School"), for 9r` and 10th grade students attending the
High School, and at Nautilus Middle School (the "Middle School"), for 8t^ grade
students attending the Middle School and Fienberg Fisher K-8 Center during the
2016-2017 school year, and
WHEREAS, on January 4, 2017, the City, M-DCPS, and Miami Dade College
executed an agreement to provide these dual enrollment courses, providing for a total
City contribution of$13,000 in fiscal year 2016-2017; and
WHEREAS, on.December 10, 2018, the City and M-DCPS executed another
Agreement to provide these dual enrolment courses, providing for a total City
contribution of$28,000 in fiscal year 2018-2019; and
WHEREAS, on June 5, 2019, the Miami Dade County Public School Board
adopted a resolution relating to Item D-67, renaming Biscayne Elementary School to
Biscayne Beach Elementary School; South Pointe Elementary to Miami Beach South
Pointe Elementary; Nautilus Middle School to Miami Beach Nautilus Middle School; and
Fienberg Fisher K-8 Center to Miami Beach Fienberg Fisher K-8; and
WHEREAS,the Administration recommends the City continue the program and
contribute a total amount of$28,000 for instructor salaries ('cuts Contribution"), with
M-DCPS contributing approximately$18,000 for textbooks, based on six (6) classes
for the 2019-2020 School Year and subsequent school years, subject to funding
approval during the City's annual budgeting process: and
WHEREAS, the Administration recommends that the Mayor and City
Commission approve, in substantial form, the agreement, incorporated herein by
reference and attached hereto as Exhibit"1."

NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE
CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor
and City Commission hereby approve, in the form attached to this Resolution, an
agreement between the City of Miami Beach and Miami-Dade County School Board
to provide dual enrollment courses for the 2019-2020 School Year, through Miami
Dade College, for college credit for eighth grade students attending Miami Beach
Nautilus Middle School f/k/a Nautilus Middle School, Miami Beach Fienberg Fisher K-

WHEREAS,through this Agreement, in partnership with M-DCPS,CMB seeks to combine
its resources with M-DCPS and MDC in order to increase the competitiveness of the students
attending Miami Beach Senior High School by nurturing and supporting the dual enrollment

School(the"Middle School");end
WHEREAS,this Agreement provides the guidelines for CMB to financially support the dual
enrollment courses at the High School and the Middle School.
NOW, THEREFORE, in consideration of the promise and of the mutual covenants
contained herein, and other good and valuable consideration, the receipt and sufficiency of
which are hereby admowledged,the Parties agree as follows:

ARTICLE 1—RECITALS AND DEFINITIONS
1.01 Recitals, The Parties agree that the foregoing recitals are true and correct and that
such recitals are incorporated herein by reference. The provisions of this Agreement
are subject to the provisions of the Articulation Agreement.
1.02 K-e Center. Fienberg Fisher K-8 Center(the "K-8 Cent&), a public school which
matriculates students from kindergaetm to Sh g cede, located at 1420 Washington
Avenue,Miami Beach,Florida 33139.
1.03 MDC Faealkv. A full-brae or pat-time member of the teaching faculty of MDC.

1.65 Middle School Nautilus Middle School (the "Middle School"), a middle school

1.06 9heh School Teaeherfsl and Middle School Teaeherfs':. A Miami-Dade classroom
teacher, as defined in Section I0I2.01(2Xa), Florida Statutes, as may be amended,
who is employed on a full-time basis at Miami Beach Senior High School or Nautilus
Middle School.
ARTICLE 2—SPECIAL CONDITIONS
2.01 Trr of Aornwilt The tam of this Agreement shall begin on the Effective Dare
and end on June 30,2020,unless this Agreement is terminated or the Articulation Agreement
is tamimted, whichever may occur fiat. This Agreement may he renewed for additional
periods of time upon dm mutual written consent of each Party to this Agreement and subject
to such terms and conditions a the Parties shall determine in writing.
In support of the objectives of this Agreement to aped the opposnmitia of the students of
the High School,Middle School.and K-8 Center byenhancing and expanding the existing dual
enrollment program at the High School and the Middle School,as a condition to renewing this
Agmmrent for an additional period,CMB may request that M-DCPS consider I)massing
the number of adentialed High School Teachers and Middle School Teachers;2)increasing
the number of dual emolhnent courses offered at the High School and the Middle School;
and/or 3) increasing the scope of cane subjects being offered at the High School and the
Middle School.

2.02 joint Resoeadb0ides. M-DCPS and CMB shall maintain responsibility for
implementing the various components of this Agreement as delineated in this Agreement and
the Articulation Agreement.
2.03 MDC Conran .Hoed on the Hlai School and the Middle School Camases.
CMB will provide financial support to M-DCPS, as set forth below, for eligible students to
engage in a rigorous curriculum at the High School and Middle School that integrates the core
academics Mary to a four(4)year degree and also count toward a high school diploma
Priority registration will provided to S°gmde students attending the Middle School and K-8
Center for classes taught at the Middle School,and to 96, 10'". 1la and 12a students attending
the High School for classes taught at the High School. M-DCPS agree to permit students
enrolled at the High School, Middle School, and K-S Center (or who otherwise qualify
pursuant to Section 1007271,Florida Statutes)who meet the eligibility requirements outlined
in the Articulation Agreement,to dually enroll in MDC courses offered at the High School or
Middle School,as applicable. The dual enrollment course offerings at the High School and
Middle School shall be set forth in a Memorandum of Understanding("School MOU")signed
by their respective Khoo/ principals and the MDC Campus President, as stipulated in the
Articulation Agreenwt. An exception to the School MOU and this Agreaneat is that the
Student Life Skills (SIS) course may not be offered on-site at the High School or Middle
School due to the lower entry requirements. Additionally,only courses providing a minimum
of three(3)credits pa coupe will be funded by CMB. Additionally,no courses that require a
pre-requisite class may be offered,only metal Dual Fnnollmem classes with no pre-requisite
class may be funded by the City.
M-DCPS agree to permit eligible Sa grade students attending the Middle School and K-S
Center to attend dual enrollment comes at the Middle School.
A. $arkesigg, M-DCPS, and the CMB will work collaboratively to market the
progtems, provide staff development, transition students, evaluate courses, and
assess overall results.
B. lam, The fee for the dual enrollment classes will be allocated as follows:
1. M-DCPS shall reimburse MDC for the provision of dual enrolment canes
at the High School and Middle School, at the aka and in the manna
stipulated in the Articulation Agreement.
2. M-DCPS shall invoice CMB to reimburse it for the provision of dual
enrollment courses at the High School and Middle School for students
attending MDC's dual enrollment courses. The total amount of

reimbursements paid by CMB to M-DCPS under this Agreement("CMB
Contributions"), shall be paid within thirty (30) days from receipt of a
detailed invoice from M-DCPS,setting forth the breakdown of the charges
and the number of recistaed students for each course. CMB Contributions
shall not exceed 528,000.00, or the cost of six (6) three-credit coupes,
whichever is less, in each fiscal year (from October 1 — September 30).
Funding for the CMB Contributions for the 2019-20 school year has been
approved by CMB and incorporated into the CMB 2019-20 fiscal year
budget.Thereafter, funding for the CMB Contributions shall be subject to
budget appropriation and funding approval by the City Commission for
each fiscal year.
3. M-DCPS shall provide a copy of the invoice for the courses taught at the
High School and Middle School each semesterlterm to CMB,upon CMB's
request_
4. Regardless of the amount of or the timing of payment of CMB
Contributions, M-DCPS shall ramie liable fix reimbursing MDC for the
provision of dual enrollment wanes at the High School aid Middle School,
in accordance with the tams of this Agreement and in accordance with the
Articulation Agreement in the event CMB funding is not sufficient or
available.
5. CMB is not responsible for paying any costa or additional fan to MDC or
M-DCPS for dual enrollment coupes provided at the High School and
Middle School by High School Teaches or Middle School Teaches, M-
DCPS is responsible for material and supply costs in accordance with the
Articulation Agreement.
6. It is anticipated that the cost for the student instructional material web will
be S18,000 for Fall, 2019 and Spring, 2020, based upon 150 enrolled
students in six(6)dual enrollment classes. Actual costs will be based on
the actual cost for the classes and instructional materials.

commencing any class at the High School or Middle School,an sdjuoct.instructor shall meet
with the principal of the High School or Middle School, as applicable to discuss and
nclmowledge any site specific policies and procedures of the High School or Middle School,
with which the adjunct instructor must comply including.without limitation,the Miami-lade
County public school attendance policies and proadwes.
2.06 Coarse S_r lM.and Sa&.. .tin_The High School or Middle School principal shall
select the dual enrollment courses to be taught at the High School or Middle School, as

applicable, provided that the courses are selected from the dual ecrolhnem courses identified
in the Articulation Agreement,and the selected comae arc do not require a prerequisite course
The High School is responsible for ensuing that the student placement variables are provided
to Miami Dade College prior to scheduling the dual enrollment course.These variables include
identifying qualified students and providing the adjunct instructor with the class schedule.The
dual enrollment courses shall be accessible to all university/college eligible students and may
not be restricted to students enrolled in a specific high school academy or program at the High
School. The adjunct imtructor shall strictly adhere to the 2019-2020 Miami-Dade County
Public Schools calendar and schedule, a copy of which is attached halm as Exhibit B. The
adjunct instructor shall provide instruction every available school day for the fall semester,
from Augus 19,2019 through January 16,2020,and for the spring semester,from January 17,
2020 through June 3,2020.
2.07 Nodes.When any of the Parties desire to give notice to the other,such notice must be
in wilting, sent by U.S. Mail, postage prepaid, addressed to the representatives designated
below by each Party(unless changed by written notice in compliance with the provisions of
this paragraph):

the capacity of independent contractors and not as an officer,employee or agent of one another.
No Party,nor its respective agents,anployeea,subcontractors or assignees,shall teprraat to
others that it has the authority to bind any other Pasty unless specifically authorized in writing
to do so. No employee of one Patty has the right to the retirement,leave benefits,or any other
benefits that may exist for the employees of another Party as a result of the performance of any
duties or responsibilities under this Agreement No Party shall be respomt'ble for social
security,withholding taxes,contributions to unemployment compensation funds or insurance
fir any other Party or their respective officers,employees,agars,subanaactors ot assignees.
3.03 If any Party defaults under the terms and
conditions of this Agreement,and such default is not cured by such Party within thirty(30)
days after receipt of written notice thereof,then the otter Parties shall be entitled to pursue any
and all remedies available et law or in equity.Any Party may terminate this Agreanal upon
thrty(30)days'prior written notice to the other Parties,for default

1. If said Agreement should be terminated for convenience by M-DCPS as
provide herein,M-DCPS shall only be required to pay MDC for the amount
for services paformed prior to termination of the Agreement and shall be
relieved of all obligations under this Agreement Accordingly, CMB shall
only be required to pay M-DCPS for the amount of services paforoed,
subject to the provisions of Section 2.03(B).
2. 1f said Agreement should be terminated for convenience by the CMB as
provide herein, CMB shall be required to pay the M-DCPS for the dual
enrollment three-credit courses taught through the end of the Spring 2019
semester,and CMB shall be relieved of all obligations under this Agreement
once the semester courses have hem completed and classes have concluded
Upon receipt of a notice of termination, the nomaminetmg Parties shall cease incurring
additional obligations under this Agreamt However, the terminating Party shall allow the
canterninatng Parties to incur all necessary and peeper costs which the nontarninating Party
cannot reasonably avoid during the termination process.
3.03 Anttal Ammronrtatios. The performance and obligations of all Parties under this
Agreement shall be contingent upon an annual budgetary appropriation by their respective
governing bodies and, in the case of M-DCPS, the allocation of funds for schools and state

finds to fulfill its obligations pursuant to this Agreement is insufficient, this Agreement may
be terminated by that Party et the end of the period for which fields have been appropriated or
allocated. That Party shall notify the other Parties at the earliest posable Cane before such
termination.
3.04 guar Fords. If M-DCPS determines that pursuant to this Agreement it a oncously
received or was overpaid finds from M-DCPS or CMB,respectively,then the recipient of such
firms agrees to promptly notify M-DPCS or CMB,respectively,upon the discovery of such
erroneous payment or overpayment. Any such exam funds shall be refunded to M-DCPS or
CMB,ere applicable.
7.05 Pubge li m&. Pursuant to Section 119.0701,Florida Statues,any Party commuting
with M-DCPS. MDC, or CMB is required to: (a) keep and maintain available for public
inspection any records that pertain to services remained under this Agreement for a period of
five(S)yeas:(b)provide such public records and at a cost in accordance with Chapter 119,
Florida Statutes,or as otherwise provided by law;(c)ensure that public records that are exempt
or confidential and exempt from public records disclosure requirements are not disclosed
except as authorized by law;end(d)meet all requirements for retaining public records,trait
records, et no cost, to M-DCPS, or CMB, as applicable, and destroy any duplicate public
records that are exempt or confidential and exempt from public records disclosure
requirements in accordance with State of Florida records retention law and regulations. Each

3.16 Preoaradon of Arveemigar The Parties acknowledge that they have sought and
obtained whatever competent advice and counsel as was necessary for them to firm a full and
complete understanding of all rights and obligations herein and that the preparation of this
Agreement has been their joint effort The language agreed to herein expresses their mutual
intent and this resulting Agreement shall not, solely as a matter of judicial construction, be
construed more severely against one of the Parties than the other.
3.17 Amendmeab. No modification,amaidrneat,or alteration in the terms or conditions
contained herein shall be effective unless contained in a written document prepared with the
same formality as this Agreement and executed by each Party hereto. The City Manager of
the City of Miami Beach, Florida, on behalf of CMB, shall be authorized to execute any
amendment or extension of this Agreement The Superintendent of Schools or his Designee of
the School Board of Miami-Dade County,on behalf of M-DCPS,shall be authorized to execute
any amendment or extension of this Agreement
3.111 Waiver. There shall be no waiver of the right of any Party to demand performance of
any of the provisions,terms and covenant of this Agreement nor stall there be a waiver of
any breach,default or nonperformance hereof by any Party,unless such waiver is explicitly
made in writing by the such Party.
3.19 Force Midair.. No fault,delay,or failure to perform on the part of any Party to this
Agreement shall be considered a default delay or failure to perform,if such a default,delay or
failure to peform is due to causes beyond the Party's raseoable control (e.g.,hurricane and
other sets of God, war, terrorist attacks). In the event of such default, delay, or failure to
perform, the performance of the provisions contained herein will be extended upon mutual
sgreememt of all Parties.

WHEREAS, the Education Compact with Miami-Dade County Public Schools ('M-
DCPS'), established on January 16, 2008 ('Education Compact"), includes the outcome to
Increase academic support and achievement and
WHEREAS, dual enrollment Is a program that allows eligible high school and middle
School students currently attending accredited Miami-Dade County public schools, private high
schools, or home schools, to enroll In a college course while attending high school or middle
school; and

WHEREAS, the credits that students earn in the dual enrollment program must be
applicable toward a high school diploma and postsecondary educational title, such as the college
associate,a baccalaureate degree,or a technical certificate; and
WHEREAS, students in 8", 9'", and loot grades that are enrolled in M-DCPS are eligible
to participate in dual enrollment programs and must meet specific criteria and
WHEREAS, due to state funding changes for dual enrollment courses, that occurred in
July,2013,M-DCPS is responsible for reimbursing colleges for instructor and administrative fees;
therefore, limiting the number of courses offered due to available funding and credentlaling
limitations of insbucbonal school staff; and
WHEREAS, Miami Dade College ('MDC) currently offers a dual enrollment courses in
approximately 34 out of 53 high schools and two(2)middle schools across Miami-Dade County,
and
WHEREAS, on March 5, 2014, the Mayor and City Commission adopted Resolution No.
2014-25525, establishing the Key Intended Outcome(KIO)In the Otye Strategic Plan to Induce
Public School Accountability Mainly at Middle School- and to 'Achieve Educational K-12
Excellence'; and
WHEREAS, the City of Miami Beach has supported dual enrollment at Miami Beach
Senior High School ("High School')sine Spring, 2015 for 11"and 12a graders through Florida
International University and
WHEREAS, the graduation rate at the High School In 2016 was 82.5%, a 16.2%Increase
from 2011; and
WHEREAS, prior to the City providing this enhancement,dual enrollment was not offered
by the High School or offered sporadically; and

WHEREAS, dual enrollment courses save students and parents money, as dual
enrollment students are exempt from paying application, registration, tuition, laboratory, and
special fees if the classes taken are being used toward high school graduation; and
WHEREAS, since the implementation of the program, in Spring 2015, there was a
financial savings, in the amount of$440,907.39(based on 2016-2017 Florida State tuition rates),
to Miami Beach families for those children choosing to enroll in dual enrollment courses; and
WHEREAS, on August 28, 2016, the Mayor and City Commission adopted Resolution
No. 2016-29537, accepting the recommendations of the Finance and Citywide Projects
Committee and the Neighborhoods/Community Affairs Committee, and authorizing the City to
execute an agreement with Miami Dade College and M-DCPS,to provide dual enrollment courses
taught at the High School, for 9th and 101"grade students attending the High School, and at the
Middle School,for 8th grade students attending the Middle School and Flenberg Fisher K-8 Center
during the 2016-2017 school year,and
WHEREAS,on January 4,2017,the City, M-DCPS,and Miami Dade College executed an
agreement to provide these dual enrollment courses, providing for a total City contribution of
$13,000 in fiscal year 2016-2017; and
WHEREAS, on December 10, 2018, the Clty and M-DCPS executed another Agreement
to provide these dual enrollment courses, providing for a total City contribution of$28,000 In fiscal
year 2018-2019; and
WHEREAS, on June 5, 2019, the Miami Dade County Public School Board adopted a
resolution relating to Item 087, renaming Biscayne Elementary School to Biscayne Beach
Elementary School;South Pointe Elementary to Miami Beach South Pointe Elementary; Nautilus
Middle School to Miami Beach Nautilus Middle School; and Fienberg Fisher K-8 Center to Miami
Beach Fienberg Fisher K-8; and
WHEREAS,on September 11,2019,the Mayor and City Commission adopted Resolution
No. 2019-30958, approving an agreement between the City of Miami Beech and Miami-Dade
County School Board to provide dual enrollment courses for the 2019-2020 School Year, through
MDC,for college credit for 8th grade student attending the Middle School, Miami Beach Flenberg
Fisher K-S center, and for 9th, 10th, 11th and 12th grade students attending the High School, in
an amount not to exceed$28,000('Ciys Contribution') and approving the funding of the Chits
Contribution for the 2019-2020 School Year from the Ctlys 2018-2019 FY budget and approving
the City's Contribution to the program for each subsequent school year, subject to funding
approval during the City's budgetary process and provided that the Citya contribution amount
does not exceed$28,000;and further authorizing the City Manager and City Clerk to execute any
and ail required agreements and documents to implement the program; and
WHEREAS, on November 8, 2019, the City and M-DCPS executed an agreement
('Agreement) setting forth the guidelines for the City to support the dual enrollment courses
offered at the High School and the Middle School; and
WHEREAS, the City and M-DCPS executed Amendment No. 1 to the Agreement,
extending the program for the Fall 2020 and Spring 2021 semesters; and

WHEREAS, Miami Dade College has not been able to accommodate the recent increased
demand for dual enrollment classes; and
WHEREAS, the Administration recommends authorizing the City Manager to execute
Amendment No. 2 to the Agreement, to include Florida International University (FIU) as an
addition& provider of dual enrollment courses, so that the City, through its partnership with M-
DCPS, may maximize the amount of dual enrollment courses that may be offered at the High
School and the Middle School, based upon the approved City Contribution,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission hereby amend Resolution No.2019-30958,which approved an agreement between

BACKGROUND/HISTORY
The Education Compact with Miami-Dade County Public Schools ("M-DCPS-), established

support and achievement The Education Compact reflects the desire of the Miami Beach
community to support excellence in the CBys public schools to improve educational
opportunities for youth
In order to increase academic support and achievement, the Education Compact seeks to
identity and pursues the implementation of best practices strategies to increase the
graduation rate at MBSHS. Dual enrollment is a program that allows eligible high school and
middle school students currently attending accredited Miami-Dade Casty public schools,
private high schools, or home schools, b enrol in a college course while attending high
school or middle school. The credits that students earn in the dual enrolment program must
be applicable toward a high school diploma and postseconday educational title, such as the
college associate,a baccalaureate degree,or a technical certificate. Students in tit`,9th,and
10th grades that are enrolled in M-DCPS are eligible to participate in dual enrolment
program and must meet specific criteria.

responsible for reimbursing colleges for insttcbr and admi ishative fees; therefore, limiting
the number of courses offered due to available funding and credentialing limitations of
instructional school staff. Mani Dade College rMDC') currently offers a dual enrolment
courses in approximately 34 out of 53 high schools and three (3) middle schools across
Mani-Dade County.

between the City, Miami Dade College, and Miami-Dade County Public Schools. At the July
13, 2016 City Commission meeting, a discussion relating to the expansion of dual enrolment
options at Nautilus Middle School and Miami Beach Senior High School, vas referred to the
Neighborhoods/Community Affairs Committee ('NCAC"). The NCAC unanimously
recommended the enhancement in the Ciys 2016-2017 fiscal budget and the FCWPC
unanimously recommended expanding the dual erro*mert program.
On August 26, 2016, the Mayor and City Commission adopted Resolution Number No. 2016-
29537, accepting the recommendations of the FCWPC and the NCAC, and alhortzhhg the
City to execute an agreement with Mani Dade College ad M-DCPS, to provide dual
enrolment courses taught at Miami Beach Senior High School (the"High School"),for 9th and
10th grade students attending the High School, and at Nautilus Middle School (the "Middle
School"), for 81h grade stiudents attending the Middle School and Fienberg Fisher K-8 Center
during the 2016-2017 school yew. The City, M-DCPS,and Miami Dade College executed an
agreement to provide these dual enrolment courses, providing for a total City contribution of
$13,000 in fiscal year 2016-2017. On December 10,2018, the City and M-DCPS executed
another Agreement to provide these dual enrollment courses, providing for a tots City
contribution of$28,000 in fiscal year 2018-2019.
O n September 11, 2019. the Mayor and City Commission adopted Resolution No. 2019-
30958, approving an agreement bet en the City of Marti Beach and Mani-Dade Conty
School Board to provide dual enrolment courses for the 2019-2020 School Yea, though
MDC, for college credit for eighth grade students attending Miami Beach Nautilus Middle
School, Miami Beach Ramberg Fisher K-8 center, and for 91h, 10th, 11th and 12Ih grade
students Mending Miami Beach Senior High School, in an amount rot to exceed $28,000
('Cups Contribution'); and approving the funding of the Ciys Cornbution for the 2019-2020
School Year from the Ctys 2018-2019 FY budget and approving the Ciys Contribution to the
program for each subsequent school yea, subject to funding approval during the Ciys
budgetary process and provided that the CRys contribution amount does rot exceed$28,000.
On November 8, 2019, to City and M-DCPS executed an agreement setting forth the
guidelines for the City to support the dual enrolment canes at the High School and the
Middle School. The City and M-DCPS executed Amendment No. 1 to the Agreement,

AUTHORIZING THE CITY TO EXECUTE AGREEMENTS FOR
FUTURE SCHOOL YEARS WITH THE UNIVERSITY OF
FLORIDA AND MIAMI-DADE COUNTY PUBLIC SCHOOLS,
SUBJECT TO ANNUAL BUDGET APPROVAL BY THE CITY
COMMISSION OF THE CITY'S CONTRIBUTION FOR EACH
SUBSEQUENT SCHOOL YEAR.
WHEREAS, the Education Compact ('Education Compact') with Miami-Dade County
Public Schools (M-DCPS), established on January 16, 2008, includes the outcome to increase
academic support and achievement and
WHEREAS,the Education Compact reflects the desire of the Miami Beach community to
support excellence In the City's public schools to Improve educational opportunities for youth;and
WHEREAS, the graduation rate at Miami Beech Senior High School was 94% in 2021,
which is a 18.9% increase from 2015, and 3.9% above the overall M-DCPS graduation rate of
90.1% in 2021; and
WHEREAS, M-DCPS climate survey data for the 2018-19 school year reflects 78% of
parents agree or strongly agree that children are receiving a good education at Miami Beach
Senior High School, a 3.7% decrease when compared to the 2010-11 school year; and 58% of
students agree or strongly agree that they are receiving a good education,a 21.7%Increase from
the 2010-11 school year, and
WHEREAS, an activity included in the Education Compact to increase academic support
and achievement is to identify and pursue the implementation of best practices strategies to
increase the graduation rate at Miami Beach Senior High School(MESH); and
WHEREAS, dual enrolknent programs enrich the course opponunttles for outstanding
high school students and save students and parents money,and
WHEREAS, Dual Enrollment Is a program Bret allows eligible high school students
currently attending accredited Miami-Dade County public or private high schools, or home
schools,to enroll in a college course and high school course simutaneousty, and
WHEREAS,the credits that students earn may be used toward a high school dlpbma and
are also acceptable toward a college Associate or Baccalaureate degree,or Technical Certificate;
and
WHEREAS,students in the 6", 7",8", 9", 10th, 11th, or 12th grades that are enrolled In
M-DCPS are eligible to participate in the Dual Enrollment programs and must meet specific
criteria;and

WHEREAS, the University of Florida (UF), a public university of the State of Florida,
currently offers dual enrollment courses across the State of Florida and zero courses in any of
the 65 Mlaml-Dade County Public High Schools in Miami-Dade County; and
WHEREAS, due to state funding changes for dual enrollment courses in July 2013,
Individual high schools are responsible for reimbursing colleges for instructor and administrative
fees; as such, the number of courses offered is limited due to available funding, along with
credentialing limitation of instructional school staff; and
WHEREAS,the City of Miami Beach proposes to enter into an agreement with UF to allow
for the credentialing of eligible teachers, City staff, as we as qualified residents, to increase the
number of dual enrollment courses available at Miami Beach Senior High School for upcoming
school years; and
WHEREAS, the City of Miami Beach partnership with UF would provide for the City to
fund the Instructor cost of approximately S8,716. per course per semester only for eligible and
credentialed teachers, City Staff and Miami Beach residents not to exceed two (2) Dual
Enrollment courses in the 2022-23 school year,with the expectation of increasing the number of
Dual Enrollment courses offered each subsequent school year, and
WHEREAS, the City Manager recommends authorizing the City to enter into an
agreement with the University of Florida and Mlaml-Dade County Public Schools, for the 2022-
2023 school year to provide Dual Enrollment courses for college credit for students at Miami
Beach Senior High School; and further authorizing the City to execute agreements for future
school years with the University of Florida and/or Miami-Dade County Public Schools, subject to
budget approval by the City Commission,during the Ctys annual budgetary process,of the City's
contribution for each subsequent school year.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA that the Mayor and City Commission
hereby authorize the City Manager to execute an Agreement with the University of Florida and
Miami-Dade County Public Schools to provide Dual Enrollment courses for college credit for
students at Miami Beach Senior High School; and further authorize the Cfly to execute
agreements for future school years with the University of Florida and Miami-Dade County Public
Schools, subject to annual budget approval by the City Commission of the Citys contribution for
each subsequent school year.

The purpose of this Letter to Commission is to provide information on the status of our partnership
wet Miemi•Dade County Pudic Schools (MDCPS), Florida International Unive city, and Miami-
Dade College to increase duel enrollment courses at Miami Beach Senior High School and Miami
Beach Nautilus Middle School.
The merest and success of students at our Mien Beach high school and middle school in dual
enrolment classes has resulted in a 310 pacalf Mauna in the number of classes from to
2015-1810 2020-21 school years. The chart below provides information on the number of coax
end den sections war ehle to students fo0owfng the implementation of the partnership in Fall
2014, as well as the financial savings to Wall Beach famines for those children choosing to
enroll in duel enrollment daises offered at Man Beach pub& schools funded by the sly n a
total amount since program inception of$2,771,839.00. Additionally,these classes support class
size reduction efforts.

accessing higher education; and
WHEREAS, the provision of funding for first generation college scholarships will help
ensure that Miami Beach residents have the opportunity to achieve their educational goals and
contribute positively to their community; and
WHEREAS, the Mayor and City Commission believe that investing in the education of
Miami Beach residents is a vital step in promoting social and economic mobility within the
community; and
WHEREAS, the City of Miami Beach intends to provide funding not to exceed $30,000
for the 2025-2026 school year and each subsequent school year thereafter, subject to
identification of funding for the 2025-2026 school year and annual approval by the City
Commission during the budget process for subsequent school years; and
WHEREAS, the City Manager is hereby directed to negotiate an agreement with the
Miami Dade College Foundation to provide this funding for first generation college scholarships
for Miami Beach residents, with such agreement being subject to the approval of the City
Attorney and the Mayor and City Commission prior to execution.

The purpose of this Letter to Commission is to provide information on the status of our palnership
with Miami-Dade County Public Schools(MDCPS).Florda International University(FIUI. Miami-
Dade College. and the Jnlversity of Florida iUF) to 'ncrease dual enrollment courses at Miami
Beach Senior H gh School(MBSHI and Miami Beach Nautilus Middle School(MBNM).
The chart below provides information on the number of courses and class sections available. as
well as the financial savings to Miami Beach families since program's inception of
$3,162.404 for those children choosing to enroll in dual enrollment classes funded by the City,
offered at Miami Beach public schools.

Funding to support and expand the partnership in the 2020-2025 school year includes an
estimated City contnbution of S68,086 for instructor salaries and MDCPS estimated contnbution
of$36.720 for textbooks This partnership also supports class size reduction
The dual enrollment program at MESH and MBNM School allows eligible students to enroll in a
college course and high school classes simultaneously. The credits the students earn are used
towards both a high school diploma and are acceptable towards a college Associate degree.
Bachelor degree or technical certificate. The benefits of offenng dual enrollment courses to high
school and middle school students include.
• Saves students and parents money,as dual enrollment students are exempt from paying
application.registration tuition.laboratory and special fees if the classes taken are being
used toward high school graduation
• Ennches the course opportunities for outstanding high school r middle school students
• Shortens the time to attain a college degree
• Provides students with college credit that is transferable to a college or university
• Allows grades earned to become part of the student's permanent transcripts
