APPROXIMATELY 4,732.74 SQUARE FEET (EASEMENT AFtEA),
LOCATED WITHIN A PORTION OF THE SUBMERGED LANDS OF INDIAN
CREEK, UNDERNEATH 41ST STREET, FOR THE PURPOSE OF
RELOCATING, AT THE REQUEST OF THE FLORIDA DEPARTMENT OF
TRANSPORTATION(FDOT�,THE CITY'S WATERMAIN FACILITIES FROM
TME 47ST STREET BRIDGE TO THE EASEMENT AREA, AND
THEREAFTER CONTINUING TO OPERATE AND MAINTAIN THE
WATERMAIN FACILITIES WITHIN THE EASEMENT AREA.
WHEREAS,on December 13, 2023,the Mayor and City Commission apDroved a request
to award a conhact, pursuant to Invitation To Bid (ITB) 2024048-JP For Watai Main Aedal
Crossing Along West 4P' Street Bndge Between Pine Tree Dnve and Indian Creed Drive
Replacemenl; and
WHEREAS, tfie scope ot work fw t�is project was outlined in the Citys Water System
Master Plan (Master Plan)Cated Odober 2019, projed W39: and
WHEREAS,the work induded Ihe wmplete replacement of the then existing 16-inch cast-
�ron aerial water main crossing that was aKached to the 41" SVeet Bridge between Indian Creek
and Collins Avenue; and
WHEREAS, the then exlsting water main was approximately seventy (70) years old and
was pnontized in the Master Plan due to the high pro6abiliry and consequence of failure�, and
WHEREAS,in addition, the hydraulic modeling Oerformed by the Ciry tletertnined that
upsizing me sys[em ro a 20-inch diameter ductile iron pipe, would provide the reQuired flow
rapacity to support lhe aNicipated growth and increasing demands along Collins Avenue in the
mid-beach area; and
W HEREAS,the water main was replaced and moved to the 41"Street Bntlge,wiN a route
that had approximately 1,280 linear teet(LF) in length, with 920 LF HOPE DR i t Pipe (20-inch),
300 LF Ductile Iron Pipe(20-inch), and 60 LF Ductile Iron Pipe(16-inch); and
WHEREAS, theFlorida Department of Transportation (FDOT) thereafter planned a
comDlete bridge rehabilitation project, requiring the comple�e removal and relocation of the
existing overhead water main; and
WHEREAS, the Fbrkla Dflpartment of Enviroomental Protection(FDEP)has detertnined
thai the replacement qualtlies ior and requires a public Suvereignty Submerged Lands
Easement("EasemenY') in order to move lhe existing water main to an Easement Area localed
within a portion of the submerged lands of Indian Creek, undemeath 4P` Street, lying in the
Southwest s: of Section 23, TownShip 53 Sovth, Range 42 East, in IMian Creek, Miami-Dade
Cou.^.ty, f!onda, as more panicuiarly described in the Easemeni(Easement No. 43019), a copy
nf whirh is attachetl to this Resotution as Exhibit A: and
WHEREAS, the Easement describes an Easement Area haviog approximately 4,733
square feet antl use of the Easement Area for a larm of 50 years, commencing reVoac[ively from
June 5. 2024;and
WHEREAS, Ihe City has reviewed all documents provWed and has determined that the
Cit�/s property interests are not adversely alfected, and Ihat ihe Easement would serve an
important public purpose.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OP THE qTV OF MIAMIBEACH, FLORIDA, thatthe MayorarM City Commission
hereby approve and authoriza the Mayor and City Clerk lo execute. m the form attached to
this Resolution as Ezhibit A. the Sovereignry Submerged Lands Easement (Easement No.
43019), by and between the Cdy (Grantee) and the Boaro ot Trustees of The Internal
Improvement irust hunG ot ihe State of FbrWa (Grantud. for a lerm of fAty (50) years.
cqmmencing retroactively on June 5. 2024, for use ot an easement area having
approximately 4,732.74 square feet (Easement Area). located wrthin a portion of the
submerged lands of Indian Creek, underneath 47°' Street, for tbe purpose oi relocating, at
tbe request ot the Florida Department of Transportation (FDOT), the City's watermain
facilities from the 41"Street brdge to the easement area, and thereaker wntinuing ro operete
and maintain the watermain facilities within the easement area.
