ALTON BEACH BAYFRONT OVERLAY DISTRICT - COMPREHENSIVE PLAN, LDR
AMENDMENTS AND RESOLUTION BY MAGAZINE
CREATES THE ALTON BEACH BAYFRONT OVERLAY LAND USE CATEGORY, PROVIDING FLOOR
AREA RATIO BONUSES FOR DEVELOPMENTS THAT INCLUDE CERTAIN PUBLIC BENEFITS
(PRIMARILY INTENDED TO FACILITATE DEVELOPMENT OF 1250 WEST AVE)
Miami Beach United can support this project only under the following conditions: (1) FAR
not to exceed 4.75 and height not to exceed 300 feet as recommended by the City’s
Planning Department, (2) public benefits package equal to at least approximately 20-30%
of the final third party estimate provided by the appraiser hired by the City of the increased
profits resulting from upzoning (to include at a minimum the completion of certain
segments of the Baywalk and the transfer or ownership of the Bikini Hostel property to the
City) and (3) a reasonable rental assistance program for the tenants currently residing at
1250 West Avenue.
MBU wants to emphasize that our conditional support is based in part on the apparent
strong support by a large majority of neighboring residents and the special situation facing
the 1250 West Avenue condominium building, where the aging structure and an obsolete
design places an untenable financial burden on the owners to comply with the new state
regulations for structural integrity. We also recognize the value of eliminating the
homeless shelter at the Bikini Hostel, but do not believe that this alone justifies the
approval of long lasting zoning changes when there are other alternatives to deal with this
situation such as increased police protection.

WITHIN THE NORTH BEACH RESORT LOCAL HISTORIC DISTRICT
Miami Beach United understands the years of suffering inflicted upon the North Beach
community due to the willful neglect of this property so prominently located in the
neighborhood. We also acknowledge the residents of North Beach are not satisfied with
such a large vacant lot in the middle of their neighborhood and want to see the property
redeveloped as soon as possible. However, we do not know the specifics of current zoning
incentives being considered.
Nonetheless, MBU agrees this particular property is unique and warrants greater FAR and
height than is currently allowed. We are pleased the proposed project has been downsized
since it was originally presented to the community. We also understand further tweaks to
the development incentives are currently being discussed. Therefore, before opining on it,
we would like to better understand how the settled upon FAR and height incentives will
play a role in the design of the project.

AMENDMENT TO “NOISE” ORDINANCE TO PROVIDE EXEMPTION ALLOWING COMMERCIAL
ENTITIES TO UTILIZE PRESSURE WASHING EQUIPMENT UNTIL 11:59 PM ON THE FIRST FRIDAY OF
EVERY MONTH TO ENHANCE CLEANLINESS IN THE CITY
Miami Beach United recognizes the need for large commercial grocery establishments to
power wash their facilities outside of their operating hours, which often extend beyond the
permitted hours for such activity. We would like to see this extension of hours be limited to
large commercial facilities, perhaps greater than 5,000 SF, and stipulate a minimum
distance from residential. We also think it would be good to do it on a trial basis for one
year.

CONSUMER PROTECTION ORDINANCE AMENDMENTS TO PROTECT RESIDENTIAL OWNERS OF
CONDOMINIUM UNITS FROM PREDATORY PRACTICES BY DEVELOPERS BY REQUIRING
PROSPECTIVE BULK OWNERS OF RESIDENTIAL CONDOMINIUM UNITS TO PROVIDE NOTICE OF
THEIR ACQUISITION OF INTERESTS IN CONDOMINIUM PROPERTIES AND BY DEFINING
"PROHIBITED CONTACTS FOR SOLICITATIONS,” AND PROVIDING FOR CIVIL PENALTIES AND
ENFORCEMENT.

with the City Attorney and Inspector General, to protect Condominium owners from
aggressive or predatory buyout practices.

ORDINANCE AMENDMENT TO INCREASE THE WATER IMPACT FEES AND SEWER IMPACT FEES
IMPOSED BY THE CITY
Miami Beach United SUPPORTS this amendment as we believe in recalibrating and
enforcing development project impact fees to meet today's costs associated with support,
repair and replacement of critical public infrastructure. For nearly three (3) decades, the
City of Miami Beach has not increased the fees and in many cases waived them all
together for new projects. These impact fees must be adjusted to cover costs associated
with repair and replacement.
