Resolution 2025-33750 RESOLUTION NO. 202533750 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, URGING THE CITY'S MARINE PATROL TO REQUIRE VESSELS ANCHORED OR MOORED IN OR ADJACENT TO CHANNELS, OR IN A MANNER WHICH OTHERWISE UNREASONABLY OR UNNECESSARILY CONSTITUTES A NAVIGATIONAL HAZARD OR INTERFERES WITH ANOTHER VESSEL, TO ENDEAVOR TO HAVE SUCH VESSELS RELOCATE IN ORDER TO ENSURE SAFETY IN THE CHANNELS AND ON THE CITY'S WATERWAYS, IN ACCORDANCE WITH FLORIDA LAW, INCLUDING SECTION 327.44 OF THE FLORIDA STATUTES. WHEREAS, the City of Miami Beach ("City") is a coastal municipality with extensive navigable watenvays used by residents and visitors for personal, recreational and commercial boating, tourism, and waterborne transportation; and WHEREAS, the safety, accessibility, and ordedy use of these waterways is essential to the welfare of residents, visitors, and the local economy; and WHEREAS, vessels that are anchored or moored in or adjacent to navigalional channels, or in a manner that unreasonably or unnecessarily interferes with navigation or the safe passage of other vessels, can create hazardous conditions that threaten public safety and disrupt the intended use of these public watenvays; and WHEREAS, Florida Statute § 327.44 provides that a vessel may not be anchored or moored in a manner that unreasonably or unnecessari�y constitutes a navigational hazard or interferes with another vessel; and WHEREAS, the City's Marine Patrol is charged with enforcing applicable state and local laws on the waler and ensuring safe navigation within the City's jurisdictional waterways; and WHEREAS, the Mayor and City Commission support proactive and consistent enforcement of these navigational safety measures, including requiring the relocation of improperly anchored or moored vessels, in order to protect the public, reduce maritime conflicts, and promote safe boating practices. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby urge the City's Marine Patrol to require vessels anchored or moored in or adjacenf to channels, or in a manner which othenvise unreasonably or unnecessarily constitutes a navigational hazard or interferes with another vessel, to endeavor to have such vessels reloca[e in order to ensure safety in the channels and on the City's waterways, in accordance with Florida law, including Section 327.44 of the Florida Statutes.
