RESOLUTION NO.
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AN ADDITIONAL WAIVER OF
SPECIAL EVENT PERMIT FEES FOR THE SOUTH BEACH WINE AND
FOOD FESTIVAL(SOBEWFF) 2025 ANNUAL EVENT, IN THE AMOUNT OF
$79,776.03, AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE
AMENDMENT NO. 2 TO THE SPONSORSHIP AGREEMENT DATED MAY
'16, 2023 BETWEEN THE CITY AND THE FLORIDA INTERNATIONAL
UNIVERSITY BOARD OF TRUSTEES, FOR THE BENEFIT OF THE
SOBEWFF AND THE FIU CHAPLIN SCHOOL OF HOSPITALITY AND
TOURISM MANAGEMENT TO REFLECT THE INCREASE; AND FURTHER,
AUTHORI2ING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE
AMENDMENT SUBJECT TO FORM APPROVAL BY THE CITY ATTORNEY.
WHEREAS, the annual Food Network South Beach Wne & Food Festival
("SOBEWFF"), is a national, star-studded, four-day destination event showcasing ihe talents
of the world's most renowned wine and spirits producers, chefs and culinary personalities;
and
WHEREAS, SOBEWFF has become one of the largest and most well-known festivals
of its kind in the country, attracting visitors worldwide, underlining the reputation of the City
of Miami 8each as a worid-class culinary destination, with the proceeds directly benefiting
the Florida International University (FIU) Chaplin School of Hospitality and Tourism
Management; and
WHEREAS, for SOBEWFF 2021, 2022, 2023, and 2024 festivals, the City of Miami
Beach agreed to provide the Festival with financial support totaling $163,333, $215,849,
$245,102, and $213,337, respectively; and
WHEREAS, the City and SOBEWFF executed a new 5-year sponsorship agreement
on May 16, 2023 (the "AgreemenY'); and
WHEREAS, the Agreement includes a fee waiver for the following permit costs which
were estimated to be valued at approximately $150,000:
i. Special Event-Application Fees
ii. Special EvenhPermit Fees
iii. Special Event-Vehicle Beach Access Pass Fee
iv. Special Event-Square Footage Fee
v. Special Event-Lummus Park User Fee
vi. Police Off-duty Administrative Fee
vii. Signage Permits— as needed, estimated at $2,483
viii. Banner Permit Fee
ix. Mini Billboard Permit Fee
x. 20% Concession Fee
xi. Rental Waiver for use of the Miami Beach Bandshell for two (2)days; and
WHEREAS, the fee waiver was capped at $15Q000, with annual escalations during
the term based on the lower of CPI or 5%; and
WHEREAS, Resolution No. 2024-32921 authorized Amendment No. 1 to the
Agreement to increase the permit fee waiver cap from $150,000 to $213,337 in respect of
the 2024 Festival; and
WHEREAS, after application of the CPI escalation, the permit fee waiver cap for the
2025 Festival was $154,350.00; and
WHEREAS, the actual cost of the permit fees for the 2025 Festival was $234,126.03
and SOBEWFF has requested that the City increase the permit fee waiver cap to cover the
deficit of $79,776.03 so as not to negatively impact the Festival's contribution to the FIU
Chaplin School of Hospitality and Tourism Management; and
WHEREAS, the proposed amendment would increase the $154,350 cap for permit
fees for the 2025 Festival to$234,�26.03 on a one-time basis, to cover the$79,776.03 deficit;
and
WHEREAS, the SOBEWFF combined 2025 sponsorship request including special
event fee waivers and reimbursable amounts for certain City services would, pursuant to the
proposed amendment, be capped at $414,20�.03.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve an additional waiver of special event permit fees for the South
Beach Wne and Food Festival ("SOBEWFF") 2025 annual event, in the amount of
$79,776.03; and further, authorize the City Manager to negotiate Amendment No. 2 to the
Sponsorship Agreement dated May 16, 2023 between the City and the Florida International
University Board of Trustees for the benefit of the SOBEWFF and the FIU Chaplin School of
Hospitality and Tourism Management; and further, authorizing the City Manager and City
Clerk to execute the Amendment subject to form approval by the City Attorney.
