6. AMOUNT OF GRANT AND PAYMENT SCHEDULE: The total amount of the Grant is set forth
in Article I, subject �o the res�nctions set (ort� �erein. In awarding �his Grant the City assumes no

overruns are the sole pnncipal responsibiliry of Ihe Grantee. The Grent IunOs wdl only be remitte0 lo

funtled by Ihis G2nt, �o observe Grantee's programs, procedures, and operalions, or to discuss the
Grantee's programs with G�anlee's personnel;aMbr requests forsuDmiflal ol adtlitional tlocumen[ation
or written reports, pnor to the Project Completion Date, evitlencing Grantea's p�ogress on ihe Proiect.
10. BANK ACCOUNTS ANU BONDING• Grantee shall mamtain all monles recervetl pursuant �o
Ihrs Ag2ement in an account with a�ank or savings antl loan association that is located in Miami-Datle
County. The Grantee shall provitle ihe City with Ihe name of�he bank or savings antl loan association.

Grantee coste or earnings clalmed under this Agraement may rrot alao be claimed under

15. ASSIGNMENT: The Grentee shall not be permilted to assign t�is G�ant, antl any purportetl

16. COMPLIANCE WITH LAWS:The Grantee agrees to abitle by antl be govemetl Dy all applicable
Fecerel, State, Counry antl Cay laws, including bat not limrtetl to Miami-Oade County's ConFlict of
Interest antl Cotle o! Ethics Ordinance, as amentled. which is incorporeteC herein by reference as if

31. FORCE MAJEURE:
A. A'Force Majeure" even[is an event that(i) in fact causes a delay in the perfortnance o(
Ihe Grantee or the Ciry's oGligalions under the Agreement an0(ii)is beyon0 the reasonable conVol of
such party unable to perform (he obligation, antl(iii) is not Eue to an intentional act, error, omission, or
negligence of such party, and (iv)coultl not have reasonably Deen foreseen antl prepare0 for by suU
party at any ume pnor to the occurrence oi the event Subject to the foregoing critena. Force Majeure
may include events such as war, civil insurcection, not, fires, epidemics, pantlemics, lerronsm,
sabotage, explosions, emDargo restrictions, quaranline restrictions, transportalion accideMs, stnkes,
slrong hurncaires or tomadoes, eaM1hquakas, or other acts of Gotl which prevent pertortnance. Force
Majeure shall not ioclude technological impossibility, inclement weather, or(ailure to secure any o!t�e
reqWretl permits pursuant to Ihe Agreement.
B. If the City or Grantee's pedormance of its contractual ohligations is preventetl or aelayetl
by an evenl believed co De Porce Majeure.such party shall immeaiately, upon leaming o(the occurtence
of the event or of the commencement of any such delay, but in any case within ffleen (15) business
tlays thereo(. provide notice ("Force Majeure NOUce') The Force Majeure Notice shall inclutle the
following�. (i)ihe occuvence of en evenl of Force Majeure, (ii) the nature of the event and the cause
thereof, (iii) the anticipeted impact on the Agreement (Iv) Ihe enticipatetl periotl oF the tlelay. antl (v)

The timely Eelivery of (he Force Majeure Notice is a condition precedent to allowance of any relief

schools aaive on The �ualiry Etlucatlon Committee (QEC). Each eligible Mlami Beach private and
charter school received a recurrirg annual funding allocation for various etlucational enhancements of
Iheir choice with their approved annual budget As part of that allocation, [he pmatelcharter school
has optetl to participate in the City's STEAM Plus program for ihe applicable school year. �'
PROGRAM DESCRIPTION
The Bass takes STEAM as an educational approach to leaming that uses Science, Technology,
Engineering, the Arts, and Mathematics as access points for guiding student inquiry, dialogue, crilical
thinking, anU ueativiry. T�rough this O�o9ram, students will engage with exhibhions at Ihe Bass and
expand on what is 6eing taught in Ihe classroom.As a result,students will take thoughtful nsks.engaqe
in espenential leaming, persist in problem-solving, embrace collaboration, and work through Ihe

needetl for lhe upcomrtg school year to the ECucation antl PeAormance Initiatives Division ('EPI")

Bulk Ortlering Pariotl�. EPI will place bulk oiCers fw most Supplias antl EquiDment benveen October
15 and October 30, provided Grantee selects Iheir supplies from t�e City approve0 venaor lisl.
Delivery Timeline. All bulk ortlers placed within the specified period will be delivered to lhe Grentee on
or after Novembe� 1st of lhe same calendar year, unless Aelayetl by delivery services.
Partner Responsibilities. Upon delivery, Grantee shall be solery responsible for.

Retums Process If a return is necessary due to tlamaqe, incorrect items, or other valitl reasons, the

and reason for reWm. (2)once(he return is appro�ed by EPI. Grantee is then responsible for packaging

WHEREAS, in January 2008, the Ciiy oi Miami Beach entered into an Educatlon
Compact wkh the Miami-Dade County Public Schoois to Enhance Leaming Opportunities
for Vouth; and
WHEREAS, the Education Compacl reflects the desire of the Miami Beach
cnmmunity to support excellence in the Citys pu6lic schools and enhance the health and
well- being of our Cdy's youth; and
WHEREAS, the City of Miami Beach's advisory Committee for�uality Educatbn
in Miami Beach ScFrools was establlshed in 1999 to make recommendations to the Ciry
Commission and to investigate, develop, and carry out plans to promote and ensure the
provision of quality educalion in Miami Beach schools; and
WHEREAS, the CRy of Miami Beach thmugh the Office of Education and
Performance Iniliatives provides programminq to studeMs enrolled In slx local Miami-
Dade County Public Schools: Biscayne Beach Elementary. North Beach Elementary,
Miami Beach Fienberg Fisher K-8 Center, Mlami Beach Nautilus Middle, Miami Beach
South Pointe ElemeMary, and Miami Beach Sr. High; and
WHEREAS, Ordinance 2023-0540, coC�ed in Sections 2-�90.134 through 2-
190.138 of lhe City Code, was recently expanded to indude twenty-six (26) voting
members, including eleven private/chaRer Miami Beach schools who have inquired about

WHEREAS, this Rem was referrad for a discussion at the Finance and Economic
Resiliency Commlttee by Commissloner Rosen Gonzalez at the July 26, 2023
Commission Meeting,to discuss funding for educatbnal enhancements; and
WHEREAS, the kem wes preserrted at the February 23, 2024 Ffnance and
Economic Resiliency Committee meeting and retumed to the March 22, 2024 meeting
with additbnal information from the private/charter sctaols who have adive Qualky
Education Committee (�EC) members regarcJing their interest in existing educational
enhancement programs devebped, implemented. funded and managed by the Citys
Education and Performance InRiatives Division; and
WHEREAS, the City of Miami Baach Chief Education officer met with
private/charter Miami Beach schools belween February 29, 2024 and March 8, 2024 to
discuss current educational enhancements available to youth in Miami Beach through
various partnerships, Including the public schools. Following each meeting, individual
school quality Education Commtttce representatives provided a ranking of wrrerrt
educational enhancemenls of interast for thefr school; and
WHEREAS, accortling to school administration-provided enmllment infortr�atbn,
Mere are curtently 2,612 youth from early childhood to grade �2 ariending seven (7)
privatelcharter schools in Miami Beach of which 54%(1,419)are Miami Beach residents;
and
WHEREAS, curtanlly, there are 8,148 Miami Beach K-12 youth attending public
schools across Miami-Oade County. As of March 2024, 4,839 or 78.7% are attending
public achools in Miami Beach; and
WHEREAS, an estimated $908.508 Is allocated annually to various city tunded
and implemented educational enhancements; and
WHEREAS, at lhe March 19, 2024 meeting, a 15-0 moUon was passed
unanimousiy by the Committee for Qualiry Educatlon membere for to request the Mayor
arW Commission conlinue to sustain current public school educational enhancements and
support the newly prioritized educatlonal enhancements for tha pnvate and chartar
