Z02533836 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, WAIVING, BY 5/7T" VOTE, PURSUANT TO SECTION 7.1.10.5(A) OF THE RESILIENCY CODE, THE EXTENDED REVIEW PROCESS APPLICABLE TO PROPOSED FAR INCREASES, IN CONNECTION WITH A PRIVATE APPLICATION FILED BY THE OWNER OF THE PROPERTY AT 3425 COLLINS AVENUE (THE "VERSAILLES") TO AMEND THE LAND DEVELOPMENT REGULATIONS FOR THE RM3 ZONING DISTRICT; PROVIDED THAT ANY WAIVER SHALL BE LIMITED TO LEGISLATIVE AMENDMENTS THAT RESULT IN AN INCREASE IN FLOOR AREA THAT IS NO MORE THAN 10% OF THE ALLOWABLE FLOOR AREA FOR AN INDIVIDUAL PROPERTY OR SITE, NOT TO EXCEED A TOTAL OF 5,000 ADDITIONAL SQUARE FEET OF FLOOR AREA PER PROPERTY OR SITE. WHEREAS, Section 7.1.10.5(a) of the Miami Beach Resiliency Code authorizes the City Commission, by an a�rmative 5/7th vote, to waive the extended review requirements of Sections 7.1.10.1 through 7.1.10.4 for any proposed FAR increase that does not exceed ten percent of a property's allowable Floor area, nor five thousand (5,000) square feet per individual site; an WHEREAS, the owner of the property at 3425 Collins Avenue (the "Property"), known as the Versailles and totaling 73,640 square feet, has submitted a private application seeking amendments to the Land Development Regulations for the RM-3 zoning district to accommodate a limited increase in FAR; and WHEREAS, under Section 7.2.6.3 of the Resiliency Code, oceanfront lots over 45,000 square feet in RM-3 are entitled to a maximum FAR of 3.0, which forthe Versailles equates to 220,920 square feet, of which ten percent equals 22,092 square feet; and WHEREAS, the applicant's request contemplates an FAR increase that does not exceed ten percent of the Property's allowable floor area, and proposes no more than five thousand (5,000) square feet of additional floor area; and WHEREAS, the City Commission finds that the proposed amendment is limited in scope, will not result in a substantial increase in overall development capacity, and is therefore consistent with the exception criteria set forth in Section 7.1.10.5(a). NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission waive, by 5/7'" vote, pursuant to Section 7.1.10.5(a) of the Resiliency Code, the extended review process applicable to proposed FAR increases, in connection with a private application filed by the owner of the property at 3425 Collins Avenue (the "Versailles") to amend the Land Development Regulations for the RM-3 zoning district; provided that any waiver shall be limited to legislative amendments that result in an increase in floor area that is no more Ihan 10% of the allowable floor area for an individual property or site, not to exceed a total of 5,000 additional square feet of floor area per property or site.
