Z�2533841 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA GRANTING, FOLLOWING A DULY NOTICED PUBLIC HEARING PURSUANT TO SECTION 2.2.4.1 OF THE RESILIENCY CODE, A WARRANT PURSUANT TO SECTION 2.7.1 OF THE RESILIENCY CODE TO REDUCE THE MINIMUM REQUIRED SUM OF THE SIDE YARDS SETBACK BY EIGHT FEET IN ORDER TO PROVIDE A SUM OF THE SIDE YARDS SETBACK OF TWENTY-FOUR FEET FOR THE PROPERTY LOCATED AT 3617, 3621 AND 365'I COLLINS AVENUE. WHEREAS, in accordance with Section 2.7.1 of the Land Development Regulalions of the City Code (LDRs), the City Commission may grant a warrant to provide relief from the application of certain requirements of the LDRs to a specific project, where the warrant improves the design of the project but does not (i) increase its floor area ratio or density from that which is allowed by the LDRs; (ii) allow a use not othenvise allowed by the LDRs; or (iii) modify by more than 25 percent the building bulk requirements applicable to the subject property; and WHEREAS, the applicant, MDEV6 LLC R Beach House 8 Condominium Association, Inc., has submitted an application requesting a warrant to reduce the minimum required sum of the side yards setback by eight(8)feet in order to provide a sum of the side yards setback of twenty- four(24)feet; and WHEREAS, on April 22, 2025, the Historic Preservation Board reviewed and approved a Certificate ofAppropriateness for a new residential and hotel development located at 3611 &3621 Collins Avenue (HPB24-0610); and WHEREAS, satisfaction of all conditions contained within the Historic Preservation Board Final Order dated April 22, 2025, which is attached hereto as Exhibit "A," is required prior to the Planning Department approval of a full building permit for the project; and WHEREAS, on July 23, 2025, the City Commission held a duly noticed public hearing pursuant to Section 22.4.� of the LDRs to consider granting the Warrank and WHEREAS, based on the evidence presented, including the application, Planning Department staff analysis, testimony, and other information and materials presented at or prior to the public hearing, the City Commission hereby determines that the warrant application satisfies the review criteria for the granting of a warrant as set forth in section 27.1 of the LDRs; and WHEREAS, the grenting of the requested warrant will result in a project that achieves a greater level of compatibility with the existing residential building located at 3651 Collins Avenue. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE qTY OF MIAMI BEACH, FLORIDA, based upon the foregoing findings of fact and the evidence presented, including the application, Planning Department s[aff analysis, testimony, and other information and materials presented at or prior to the public hearing, all of which are part of the record of this proceeding, that the Mayor and City Commission hereby (i) accept and adopt the Planning DepartmenPs staff report and analysis, including staff's recommendations, (ii) find that the application satisfes the review criteria for the granting of a warrant as set forth in Section 27.1 of the LDRs, and (iii)grant a warrant to reduce the minimum required sum of the side yards setback by eight(8)feet in order to allow a sum of the side yards setback of twenty-four(24)feet for the project located at 3611, 3621 and 3651 Collins Avenue. BACKGROUNDIHISTORY On April 6, 2025, the applicant, MVEV6, LLC and Beach House 8 Condominium Association, Inc, submitted the attached Letter of Intent (LOI) and appliration for a City Commission warrant pursuant to Section 27.1 of the Land Development Regulations of the City Code (LDRs). The purpose of the proposed wartant is to reduce the minimum required sum of the side yards setback from thirty-two (32') feet to twenty-four (24') feet for a recently approved development project located at 3611 & 3621 Collins Avenue. On April 22, 2025, the Hisloric Preservation Board revfewed and approved a Certificate of Appropnateness for a new residential and hotel development entitled "Casa Cipriani", located at 3611 8 3621 Collins Avenue. Warrant Analysis In accordance wdh Section 2.7.1 of ihe LDRs, the City Commission may grant a warrant from the application of certain requirements of the LDRs lo a specifc prqect. The warrant shall be granted by resolution of ihe City Commission, and an affrtnative vote of fve- sevenths of all members of the City Commission shall be necessary to approve the resolution. The proposed warrent pertains to a unified development site that is located within the RM-3 zoning district and contains the following building parcels: 1. The Coral Reef Holel sile located at 3611 Collins Avenue. 2. The PaVician Hotel site located al 3621 Collins Avenue. 3. The Beach House 8 Condominium located at 3651 Collins Avenue. The proposed scope of work is limited to the 3611 and 3621 Collins Avenue portion of the site and includes the consvuction of a new mixed-use residential and hotel development projed. No work is proposed for the Beach House 8 Condominium portion of the site. The proposed wartant is being requested from Section 72.6.3 of the LDRs, which requires the sum of the side yards to be a minimum of 16% of the lot width. In this instance, based on a lot widM of 200 feet, the minimum required sum of lhe side yards is 32'-0" and 24' is proposed. Attached is a site plan and elevation analysis, which Illustrates the scope of the proposal. Pursuant to Section 27.1 of the LDRs, the City Commission may approve a warrant to improve the design of a projecl if the applicant can demonshate the following: 1128 of 1791 1. No increase in FAR or density is propo5ed. 2. The wariant dces not allow a use othenvise prohibited by the Code. 3. The warrant request does not modify a standard by more than 25°/a. The Administration has delermined that the subject applicatlon is consistent with these thresholds. The following is an analysis of the subject application m relation to the review cntena set forth in Section 2.7.1 of the LDRs for a warrant: 1. Whether the p�oposed warrant is consistent and compatib/e with the comprehensive plan and any app/icable nerghborhood or redevelopment plans. Tbe proposed warrant is wnsistent and compatible with the Comprehensive Plan. It does not impact the contemplated densiry, intensiry or uses in Policy RLU 1.17. of the Comprehensive Plan for the RM3 land use category. 2. Whether the proposed warrant would create an isolated development unrelated to the adjacent neighbofiood The proposed warrant does not create an isolated development unrelated to ihe adjacent neighborhood. The proposed south side setback of 16'•6" along 36'" SVeet and ezisting 7'-6" setback along 37'" Street is consistent with the development pattem within lhe hislonc district. 3, Whether the proposed warrant is out of scale with the needs o/the neighborhood or the city. The proposed warrant is not out of the scale with the needs of the neighborhood or the City. The grenting of the warrant will allow for a greater separation between the existing residential building and the new tower addition. Additionally, the wartant will allow the new development to provide enhanced light and air corridors to surrounding residential units, as well as preserve view corridors to the ocean for pedestrians along Collins Avenue. 4. Whether the proposed wanant will adversely influence living conditions in the neighborhood. The requested warrant will not adversely influence living conditlons in the neighborhood. The reduction of the sum of the side yards setback will allow for the new tower atldition to be located closer to 36'" Street resulting in the preservation of light and air to the existing residential building on the northem portion of the site and will have no adverse impact on the city-owned parking located on the south side of 36'" Street. 5. Whether the proposed warrant will senously reduce light and air to adjacent areas. The granting of the subject warrant will resWt in an increase in light and air to the existing residenlial condominium builtling located on the northem parcel of the site. 6. Whether the proposed warrant is consistent with the sea /evel rise and 2siliency review cntena in chapter 7. article 1, as applicable. The Applicant is requesting a Commission Warrant pursuan[to Sec. 2.71.of the Code[o reduce the sum of[he side yard se[back requirement from 32'to 24'in order to improve the design of the projen. The Code provides that, in the Property's RM-3 zoning distriR, side setbacks and the sum of the side yards is calculated based on a property's lot width. 5pecifically, the Code requires a minimum side setback of 8%of the lot width and that the sum of the side yards be 16%of the lot width.This presumes that ideally the 16% sum of the side yards will be distributed equally at 8% between the side setbacks. Compliance with a 32' sum of the side yards requirements would require that Caso Cipriani be substaotially shifted north towards 8H8, reducing the separation between the towers from 30'-6" to 22'-6". This would negatively impact BH8's residents by subs[antially reducing the light and air availabie to their homes and pedestrians along Collins Avenue by decreasing v"iew corridors toward the ocean. Additionally, providing a 16'-6" setback to 36`^ Street promotes a more vibrant, urban, and pedestrian-oriented environment compared [o a 24'-6" setback. 7his shallower distance creates a more defined and enclosed streetscape, enhancing the overall City fabric and reinforcing a strong City-block feel. It also supports the success of Cosa Cipriani by maintaining visibiliry and accessibility to building entrences, while still allowing room for an ample pedestrian path, bike racks, and landscaping. In contrast, a deeper 24'-6` setback can result in a disconnected or inactive street edge and may compromise the human scale and proportion as it disrupts [he development pattem in the area. Further, the south side of 36°M1 Street is a Ciry-owned surface parking lot, so neighboring structure is negatively impacted by permitting the 16'-6" setback via this Warrant. Pursuant ro Section 271 of the Land Development Regulatlons("LDRs`),the City Commission may grant a warrant to improve[he design of a specific project, as long as the warrant daes not(i�increase the Floor area ratio�"FAR")or density of the project beyond what is allowed by the LDRs; (ii)permi[a use not otherwise allowed 6y the LDRs;or(iii) modify by more than 25%the building bulk requirements(height,setbacks,etc.)for the subject property. The approval of a warrant is"quasi-judicial;' rather than legislanve,in nature.ln otherwords,the Ciry Commission's role is similar to the role of the land use boards in reviewing property-specific development applications. 1.
