This Amendment No. 2 to the Agreement is made and entered this _ day of
, 2025, by and between fhe CITY OF MIAM( BEACH, a municipal corporation
existing under the laws of the Stafe of Flarida (the "Cif�'), having ifs principal offices at
1700 Convention Center Drive, Miami Beach, Florida 33139, and WANNEMACHER
JENSEN ARCHITECTS, INC., a Florida Corporatian having its principa! o�ce at 132 Mirror
Lake Drive N, Unit 301, Saint Petersburg, Florida 33741 (the "Consuftant").
RECITALS
WHEREAS, on December 14, 2022, the Mayor and the City Commission authorized the
issuance of Request for QuaEifications(RFQ}No.2023-12'f-ND,for architectural and engineering
design services for the 72nd Street Communify Complex �n December 16, 2022 the RFQ was
issued; and
WHEREAS,on On March 27, 2023 the City Commission adopted Resoiution 2023-32559
authorizing the administration to enter into negotiations with Wannemacher Jensen Architects,
Inc. (WJA)and an September 25, 2023, the Cify executed an agreement wikh WJA in the amoun#
of$9,265,453; and
WHEREAS, WJA delivered a conceptual design in December 2023, which, following the
preparation of conceptual cost estimates, exceeded the $70M construcfion budget. As a result,
and in compliance with fhe terms of the Agreement, WJA was directed to re-design the project in
order to meet the construction budget; and
� WHEREAS, in February 2024, WJA submitted design concept B which still exceeded the
$70M construction budgef target Cer#ain value engineering (VE) strategies, representing cost
savings, were identified for implementation. confident that the project would be designed to
budget, City staff aufhorized the Consultant to proceed to the 30°!o schematic design; and
WHEREAS, in September 2024, WJA submitted the 30% schematic design inclu8ing
renderings. The resulting cost estimate submitted by the Canstruction Manager at Risk {CMR)
was approximately 14% over the $70M construction budget, VE strategies prevlously identified,
could potentiaAy resolve the budget concerns; and
WHEREAS, on December 11, 2024 the City Commission discussed and approved to
provlde the project and directed the Administration to provide an additional parking fevel and
explore activating the parking level by including picklebafl courts; and
WHEREAS,on February 26, 2025 City Commission adpopted Resolution No. 2025-33512
approving Amendment No.1 to provide additianal professiona! for additional parking level and
permanent picklebail courts for a not-to exceed amount of$486,812; and
WHEREAS, on Apri1 15, 2025, the Land Use and Sustainabiiity Committee (LUSC) held
a discussion regarding the possible locations which could accommodate the future installation of
the Glory of Old Glory a series of Murais (Murais); and
WHEREAS,City staff reported that they had reviewed various locatior�s including the 72nd
St. Community Complex, currently under design; and
WHEREAS, the LUSC passed a motion recommending that the City Commission direct
the Administration to consult with the 72nd Sf. Community Complex Project's design consultant
and construction manager on the feasibility of including the Murals af this location; and
WHEREAS, on May 21, 2025, the City Commission adopted Reso4ution No. 2025-33654
accepting the recommendation of LUSC during its April 15, 2025 meeiing to direct the
administration to consult with the design team and construction manager for the 72"� Street
Community Complex Project on the potential to include the Mura►s within the project; and
WHEREAS, on June 25, 2025, WJA submitted a feasibility study proposal, in the amount
of $39,230 to integrate the Murals inta their 3D model to fully evaluate the design and look for
creative creative ways to incorporate the Murals into the project's exterior walls; and
WHEREAS, City Staff has evaluated the proposal and found that fhe request for additional
compensation fair and reasonabfe
WHEREAS, Amendment No, 2 will revise the total contract amount to$9,791,495.
NOW, 7HEREFORE, the parties hereto, and in consideratian of the mutual promises,
covenants, agreements, terms, and conditions herein contained, and other good and valuable
consideration, the respect and adequacy are hereby acknowledged, do agree as follows:
1. ABOVE RECfTALS
The abave recitals are true and correct and are incorporated as a part of this
Amendment No. 2
2. MODIFICATIDNS
(a� The Agreement is ainended, as provEded h e r e i n a n d in Schedule
"A" attached hereto.
(b) In consideration for the services to be performed under this Amendment
No. 2, City shall pay Consultant the not-to-exceed amount of $39,230.00 as provided in
Schedule"A", attached hereto.
3. OTHER PROVlSIONS.
All other provisions of the Agreement, as amended, are unchanged and shall remain in
full force and effect.
4. RATIFICATION.
The City and Consultant ratify the terms of the Agreement, as amended by this
Amendment No. 2.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment No. 2 to be
executed in their names by their duly authorized officials as of the date first set forth

COMMUNITY C�MPLEX PROJECT, IN THE NOT-TO-EXCEED
AMOUNT OF $39,230.00, UTILIZING PREVIOUSLY APPROPRIATED
PROJECT FUNDING.
WHEREAS, on December 14, 2022, the Mayor and the City Commission
authorized the issuance of Request for Qualifications (RFQ) No. 2023-121-ND, for
architectural and engineering design services for the 72nd Street Community Complex
On December 16, 2022 the RFQ was issued; and
WHEREAS, on June 22, 2022, the Mayor and City Commission adopted
Resolution No. 2022-32204 directing the Administration to take all steps necessary to
assist with the efforts to remove and store the "The Glory of Old Glory" (Murals) created
in 1971 by Italian artist and sculptor Enzo Gallo ; and
WHEREAS, said Resolution accepted the owner's donation of the Murals to the
City, and referred the foregoing to the Art in Public Places ("AiPP") Committee for an
advisory recommendation as ta potential locations for the placement of the Murals; and
WHEREAS,on March 27, 2023, the Mayor and City Commission adopted
Resolution No. 2023-32559 authorizing the administration to enter into negotiations with
Wannemacher Jensen Architects, Inc. (WJA}and for architectural and engineering design
services for the 72nd Street Community Complex and;
WHEREAS, on September 25, 2023, the City executed an agreement with WJA in
the amount of$9,265,453; and
WHEREAS, on May 15, 2024, the City Commission referred item C4 AJ,
sponsared by Commissioner Alex Fernandez, to the Land Use and Sustainability
Committee (�USC)to discuss and identify potential sites for the installation of the Murals;
and
WHEREAS, the facilities and Fleet Management Department and Office of Capital
Improvement Projects ("CIP") considered City facilities with upcoming construction
projects for which designs have not been finalized and that may be of acceptable size
and location to accommodate the Murals in a prominent fashion; and
WHEREAS, several locations were identified and discussed, among them, the
Bass Museum expansion the Art Deco Museum expansion, and the 72nd St. Community
Complex; and
WHEREAS, on Feb 15, 2025, the City Commissian refeRed item C4 O, sponsored
by Commissioner Alex Fernandez, to the LUSC to discuss an expanded list of potential
sites for the Murals, and to include the 72nd St. Community Complex currently under
design; and
WHEREAS, on February 26, 2025, the Mayor and City Commission adopted
Resolution No. 2025-33512, approving Amendment No. 1 to WJA for additional
professional services to add a parking level and permanent pickleball courts for a not-to
exceed amount of$486,812; and
WHEREAS, on April 22, 2025, WJA was asked to perform a basic review to identify
if the murals could be installed inside the library space, and in the instance the murals
could not fit, they were asked to propose patential exterior locations which might be able
to accammodate the murals; and
WHEREAS, on May 21, 20�5, the Mayor and City Gommission adopted Resolution
No. 2025-33650, accepting the recommendation of LUSC during its April 15, 2025
meeting to direct the Administration to consult with the design team and const�uction
manager for the 72nd Street Community Cornplex Project; and
WHEREAS, on June 1 Q, 2025, the LUSC discussed the desirability and
appropriateness of incorparating the Murals into the 72nd Street Community Complex
Project, and adopted a motion recommending that the City Commission direct staff to
complete a feasibility study and prepare a cost estimate for the inclusion of the Murals at
the 72nd Street Comm�nity Complex; and
WHEREAS, on June 25, 2025, WJA submitted a proposal for the preparation of a
feasibility and cast estimate, in the amount of $39,230, to integrate the Murals into their
3D model in order to fully evaluate the design and look for creative ways to incorporate
the Murals into the project's exte�ior walls; and
WHEREAS, City Staff have evaluated the proposal and found that the request for
additional compensation is fair and reasonable, and commensurate with the effort
required, this Amendment No. 2 (Exhibit A) will revise the total contract amount to
$9,791,495.

NOW, THEREFCIRE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission of the City of Miami Beach, Flarida hereby approve and authorize the City
Manager and City Clerk to execute Amendment No. 2 to the Professional Services
Agreement for architectural and engineering services for the 72nd Street Community
Complex, between the City of Miami Beach, Florida and Wannemacher Jensen
Architects, Inc., for additional professional services associated with the preparation of a
feasibility study to incorporate the "Glory of Old Glory," a series of murals by artist Enzo
Gallo, into the 72 Street Cammunity Complex project, in the not-to-exceed amount of
$39,230.00, utilizing previously appropriated project funding.
