WHEREAS, FOOT is seeking to improve the stormwater system including a drainage outfall along Indian Creek Drive; and WHEREAS, in order to obtain access to the waterway, a 217.2 square foot parcel easement is essential, located on the west side of Indian Creek Drive and north of 26th Street; and WHEREAS, as part of the outfall installation, FOOT is planning to perform repairs to a concrete seawall, and perform future maintenance of this item; and WHEREAS, the proposed FOOT new outfall stormwater pipe and drainage improvements will require execution of a Perpetual Easement Agreement in order to allow FOOT to construct and maintain the stormwater and seawall improvements on the west side of Indian Creek Drive and north of 261h Street. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the Mayor and City Clerk to execute a Perpetual Easement Agreement with the Florida Department of Transportation with regard to a 217.2 square foot parcel on the west side of Indian Creek Drive and north of 26 1h Street for a proposed stormwater outfall on Indian Creek Drive (SR A1A).
