Please place a referral to our Neighborhoods Committee and Legal for discussion as how to deal with Noise Abatement issues relative to overhead flights that do not follow the standard set by FAA. Also I would like a referral to legal as to whether small single engine aircrafts with signs are permitted to fly through the center of the city or if it is required that they fly on coastline to avoid potential for danger should a sign come off a plane or the plane otherwise have a problem. Morales, City Manager Mr. Jose Smith, City Attorney Mr. Rafael Granado, City Clerk Commissioner Deede Weithorn October 15, 2013 Referral to Neighborhood Committee Trespass Sign Program for Buildings Under Construction MEMORANDUM In sections 810.08 and 810.09, the Florida State Statutes state that law enforcement must be provided with a written authorization by a property owner (or an order from court) to enter a private property to communicate an order to leave or to conduct an arrest. Often times, uninhabited structures under construction are abused by trespassers and criminal offenders who take refuge in these properties to engage in illegal activity or even hide from pursuit by law enforcement. In an effort to continue enhancing the public safety, Commissioner Weithorn would like to refer an item to the Neighborhoods Committee to develop potential legislation which would require that all commercial and residential structures (which are intended to remain uninhabited during construction) issue the Miami Beach Police Department with an authorization to enforce sections 810.08 and 810.09 of the Florida Statutes. This authorization could potentially be issued as part of the permitting process and the property owner would receive a Miami Beach Police Department No Trespass Sign for display at the property. Commissioner Weithorn would like to refer this item to be placed on the agenda for the Neighborhoods Committee. These property owners have expressed concern over the medians and design for Alton Road being proposed by the Florida Department of Transportation. As such, Commissioner Weithorn would like to request a discussion item regarding economic impact on local businesses, the proper functioning of the roadway, potential traffic intrusion into adjacent residential neighborhoods, and pedestrian safety. Commissioner Weithorn would like to refer this item to be placed on the City Commission agenda for October 16, 2013.
