LAND USE AND DEVELOPMENT
A Land Use and Development Committee meeting was held on May 7, 2014. Land Use
Committee Members in attendance were Commissioners Joy Malakoff, Deede Weithorn,
and Michael Grieco. Members from the Administration, including, Joe Jimenez, Thomas
Mooney, Raul Aguila and Gary Held, as well as members of public, were also in attendance.

The meeting was called to order at 3:05 pm.
1. DISCUSSION FOR CONSIDERATION OF ESTABLISHING ACCEPTABLE
ACCESSORY USES PERMITTING RESTAUMNTS IN GONTRIBUTING HISTORIC
STRUCTURES WITHIN THE RM.2 CULTURAL ARTS NEIGHBORHOOD OVERLAY
DISTRICT.

AFTER-ACTION:
Alfredo Gonzalez addressed the Committee and requested that the matter be continued to
the June meeting. The members of the Committee expressed some reluctance with the
request, given that the matter has been on the agenda since last year, but agreed to one
more continuance.

2. DISCUSSION ON TELECOMMUNICATIONS ORDINANCE.

AFTER.ACTION:
Gary Held and the City's outside counsel provided an overview of the item. Mitch Bierman,
counsel for Crown-Castle, addressed the Committee.
The Committee discussed the item. Comm. Weithorn expressed concern with the
proliferation of street furniture needed to accommodate telecommunication equipment.

LUDC meeting for further discussion and a report on the feedback from the Planning and
Public Works Departments.
3. DISCUSSION ON AN ORDINANCE TO PERMIT ADDITIONAL HEIGHT FOR
GARAGES IN THE RtU.2 DISTRICT, AND TO PERMIT CERTAIN GARAGES
WITHOUT COMMERCIAL OR RESIDENTIAL UNITS.

AFTER-AGTION:
Thomas Mooney provided an overview of the item. Commissioner Grieco asked a question
regarding the overall height of the buildings and Comm. Malakoff expressed a need for first
level activation along the street and sidewalk. Attorneys Mickey Marrero and Steve Wernick
spoke in favor of the proposed legislation.

Referred the item to the Planning Board as an Ordinance Amendment, with the
recommendation that retail or other active uses be required at the street level.
4. ADD]TIONAL DISCUSSION ITEMS
. Sea Level Rise and Building Heights. The LUDC discussed a proposal at the
Mayors Blue Ribbon regarding the measuring of building heights and creating
potential FAR exceptions for below grade areas activating a street or sidewalk.
The LUDC voted to continue the discussion to the June 12, 2014 meeting.
. Upcoming LUDC ltems. The Committee requested a status report on the St.
Patrick's School ROW Parking and Traffic Analysis item.
