The Commission directed the Office of the City Attorney to research the history of the co-naming of the road, and to determine what action the City must take to remove the "Arthur Godfrey Road" co- name. The Miami Beach City Council, petitioned by a group of property owners along 41st Street, introduced an ordinance renaming 41st Street as Arthur Godfrey Road at its meeting on February 1, 1956. The property owners sought to add the name "in tribute to Arthur Godfrey, whose enthusiasm and interest in Our City has stimulated and publicized the many virtues of South Florida." The City Council passed the ordinance unanimously on first and second readings at the February 1 , 1956 meeting, and passed and approved the ordinance (Ordinance No. 1201) on third reading on February 15, 1956. (See Exhibit'A', attached hereto). Forty-First Street is maintained by the State and designated by the Florida Department of Transportation ('FDOT') as State Road 112. Typically, the State legislature must approve the addition or removal of a co-name for a State road. However, the State legislature has never designated 41st Street as "Arthur Godfrey Road." FDOT has no record of a roadway designation named "Arthur Godfrey Road." As such, the City Commission may remove the "Arthur Godfrey Road" co-name merely by repealing Ordinance No. 1201.
