Supporting Data (Surveys, Environmental Scan, etc.): The 2012 Customer Satisfaction Survey indicated that over 87% and 83% of City residents and businesses respectively, rated the appearance and maintenance of public buildings as excellent or and over 81% of residents rated Item Summary/Recommendation : On May 8,2013, resolution No. 2013-28199 authorized the Mayor and the city Clerk to execute a Pre-construction Services Agreement with Thornton Construction Company (TCC). On March 5,2014, resolution 2014-28527 approved and authorized the Mayor and the City Clerk to execute a Guaranteed Maximum Price (GMP) Amendment No. 1 with Thornton Construction Company, lnc. for Construction Management at Risk Services for the Scott Rakow. At this meeting, the Commission requested that staff look at the possible reconfiguration of interior spaces to include a party room, skate rental area and new shower facility. On June 11,2014, resolution No. 2014-28614 authorized the City Manager to negotiate and execute, in a not to exceed amount of $265,000, a Guaranteed Maximum Price (GMP)Amendment No. 2 to the pre-construction services agreementwith Thornton Construction Company, lnc., dated September 16,2013. TCC submitted a GMP proposal for the increase scope of work in the amount of $456,715. This amount exceeded the City's proposed budget. Negotiation with TCC took place in order to lower the construction amount. Several meetings were held and TCC submitted a revised GMP proposal in the amount of $394,562. Since the City and TCC were not able to negotiate a final GMP Amendment No. 2; and, in an effort to expedite the additional scope at Scott Rakow Youth Center lce Rink, the National Joint Power Alliance (NJPA) lndefinite Quantity Contract (lQC) contract was utilized to procure the necessary construction services, an alternate method of procurement. The IQC process is used extensively by the local, state and federal governmental agencies throughout the United States to expedite the delivery of construction projects. The City, as a governmental agency member, is authorized to utilize the IQC contract for construction services competitively awarded by the National Joint Powers Alliance (NJPA) to the Gordian Group. On September 12,2014, the City met with NJPA vendor, BDI Construction (BDl) at the Scott Rakow site to perform a scope meeting. On October 10,2014, BDI Construction submitted a bid proposal utilizing the NJPA cooperative contract system in the amount of $334,001.21. As a follow up meeting with BDI took place to review the proposal and minor revisions were observed. On October 23,2014, a revised proposal was transmitted to the City in the amount of $329,000. Therefore, the IQC proposal received exceeds the $250,000 threshold limit approved by the City Commission for projects through the NJPA IQC contract award. Accordingly, in order to move forward with the completion of this project and in efforts to meet the proposed completion goal of January 2015, approval is required to exceed the $250,000 project threshold limit by $79,000, for a project total amount not to exceed of $329,000. BACKGROUND On May 8,2013, the Mayor and the City Commission approved Resolution No. 2013-28199 authorizing the Mayor and the City Clerk to execute a Pre-Construction Services Agreement with Thornton Construction Company (TCC). These Services included review of the project requirements, existing on site conditions, preliminary budget evaluation, project scheduling and phasing, value engineering, and constructability recommendations to the design consultants. On March 5, 2014, Resolution 2014-28527 approved and authorized the Mayor and the City Clerk to execute a Guaranteed Maximum Price (GMP) Amendment No. 1 with Thornton Construction Company, lnc. for Construction Management at Risk Services for the Scott Rakow Youth Center lce Skating Rink, Mechanical Repairs and Building Renovations Project, in the amount of $1,175,220 plus a five percent owner's contingency in the amount of $58,761, for a grand total amount of $1,233,981. At this meeting, the Commission requested that staff look at the possible reconfiguration of interior spaces to include a Multi-purpose room, skate rental area and new shower facilities. At the meeting of June 11,2014, the Commission approved the additional scope at Scott Rakow Youth Center lce Skating Rink as follows: new women's and men's showers and locker rooms, with an approximate area of 595 SF., new multipurpose room, with an approximate area of 372 SF., and a new skate rental, with an approximate area of 353 SF. 4 Commission Memorandum - Scoff Rakow Youth Center lce Rink Additional Renovation October 29, 2014 Page 2 On June 11,2014, the City Commission approved Resolution No. 2014-28614 authorizing the City Manager to negotiate and execute, in a not to exceed amount of $265,000, a Guaranteed Maximum Price (GMP) Amendment No. 2 to the pre-construction services agreement with Thornton Construction Company, lnc., for the additional scope. Since the City and TCC were not able to negotiate a final GMP Amendment No. 2; and in an effort to expedite the additional scope at Scott Rakow Youth Center lce Rink, the NJPA IQC contract was utilized to procure the necessary construction services, an alternate method of procurement. As authorized by Florida Statutes, the Finance and City-Wide Projects Committee (the "Committee") endorsed a recommendation by the Administration to utilize the indefinite quantity contract (lOC) for construction services to expedite the delivery of construction projects under $250,000 or for emergency p@ects as approved by the City Manager. The Committee's endorsement of the IQC process for small and emergency projects was approved by the City Commission on April 23,2014. The IQC process is similar to the JOC process previously used by the City but with tighter controls, including a limit on design, additional competition on certain items and a small project threshold that limits exposure. The IQC process is used extensively by the local, state and federal governmental agencies throughout the United States to expedite the delivery of construction projects. The City, as a governmental agency member, is authorized to utilize the IQC contract for construction services competitively awarded by the National Joint Powers Alliance (NJPA) to the Gordian Group.
