A meeting of the Neighborhood/Community Affairs Committee was held on Friday,
November 21, 2014 at 3:00pm in the Commission Chamber, 3rd Floor of City Hall.
Commissioners in attendance: Commissioners Micky Steinberg, Deede Weithorn, Joy
Malakoff, and Ed Tobin. Members from the Administration and the public were also in
attendance.

L Discussion Regarding An Ordinance Amending Chapter 18 Of The City Gode, Entitled
"Businesses," To Provide Regulations And Standards For Nude Dance Establishments.

Aleksandr Boksner, First Assistant City Attorney began the discussion on the background on this
item. Providing this Ordinance is the first step in combating this issue. Nude dance
establishments will be required to obtain photo identification for their dancers that prove they are
of age and one additional form of identification in order to prevent counterfeit identification cards.
ln addition, there is a requirement for an attestation stating that they agree to perform at their own
will without the threat or cohesion of another. These are all items thatthe establishments need to
be able to provide. There will also be a check in, check out process to verify who is in the
establishment and when they leave. The requirements are set forth in the Ordinance. The first
offense $2,500, the second offense is $10,000 and anything afterthe second offense would
require ceasing of the operation for a set period of time.
Commissioner Malakoff inquired if the fines could be doubled.
Commissioner Tobin inquired if the City Attorney's Office needs additional time to revise the
proposed Ordinance with recommendations from the Committee.
Commissioner Weithorn suggested that if the establishment is not complying, they assume the
cost of paying for the enforcement that was issued to that establishment.
Alek Boksner stated that cost recovery has been banned by a court opinion about 8 years ago.
This prohibits the City from recouping the employee costs. However, a fine is something the City
can implement.
Commissioner Weithorn the fine can correlate to the costs associated with sending enforcement
out there for a noncompliant establishment.
Commissioner Tobin suggested bringing this back to the Neighborhood/Community Affairs
Committee meeting the following month.

Commissioner Tobin to review the Ordinance and bring it to the December Commission meeting
for first reading.

2. Discussion Regarding Long Term Problems That Need To Be Addressed At 17th Street
And Alton Road lntersection

Jose Gonzalez, Transportation Director began the discussion regarding this item. Miami Beach
United identified five areas of concern.
Commissioner Tobin stated that he would like to have list that has all the intersections that have a
failing grade. lnquired where Administration is with compiling a list of all the intersections that fall
below grade.
Jose Gonzalez stated that should be completed by June of next year and this is part of the
transportation master plan.
Commissioner Tobin stated the issue with waiting for an outside contractor to compile this
information is the intersections are progressively getting worse. The intersections that are
currently at D or E grade should be prioritized.
DIRECTION: By Commissioner Tobin to repair now the intersections that are currently at or near
failure grade instead of waiting until June 2015 for the study and bring back recommendations on
how to expedite the process of repairing the intersections to the Neighborhoods/Community
Affairs Committee meeting in December. ln addition, bring back a list of all intersections that are

3. Discussion Regarding The Civil Forfeiture Policy Of The City Of Miami Beach.

AFTER-ACTION
Police Chief, Daniel Oates explained that Administration is here to answer any questions the
Committee may have regarding the Civil Forfeiture Policy. Chief Oates explained to the
Committee that he has provided them a memo with the current policy in place as well as graphs
outlining the forfeitures from October 1,2012- September 30,2013 and October 1,2013-
September 30,2014. Chief Oates stated that he believes the current policy in place is sound and
there is a good process in place.
Commissioner Tobin recused himself from this discussion due to his pending application with the
Police department.
Aleksandr Boksner, First Assistant City Attorney stated the forfeitures the City engages in are in
strict compliance with Florida law. The issues that are happening throughout the country
regarding civil forfeitures are issues that are not happening here at the City of Miami Beach.
NO ACTION TAKEN.
Commissioner Tobin suggested moving item 4 and 5 to the following Neighborhood/Community
Affairs Committee meeting due to the short period of notification for the public.
4. Discussion Regarding Stray Cats ln Miami Beach.

5. Discussion Regarding The Annual Review Of The City's List Of Deserving Organizations
And/Or Groups Eligible To Receive Complimentary Tickets As Per The City's
Gomplimentary Ticket Policy Pursuant To Resolution No. 2014-28638.

Commissioner Weithorn suggested having Administration list the Organizations' Miami Beach
addresses or the communities within Miami Beach that they serve because several addresses on
the eligible organizations list are outside of the City limit.
To be brought back to the December 19th, 2014 Neighborhood/Community Affairs Committee
meeting.
