Thank you for taking the time to see Jason and myself last week.
I just want to make it very clear that I am all for these new requirements heing
required by Public Works I
This is an urgent matter that needs to be coordinated with Planning and Zoning and Public
Works as this will cause a domino effect on other items that will be required to be
implemented , ineluding a Variance hearing to get a Master permit. This will hold up elu

Ijust need and want to understand how these 3 items described below must be implemented in the design and
construction of a single family home in Miami beach and how it will effect the neighboring properties. See
attached drawings to show how this will effect the property owners on either side of the
new single farnily home
These items describe below are going to be or are already being required by Public Works. I have and others
have submitted several single family homes for permit since the July 23rd Commission meeting.
Please find the list of properties(permits applied for after 0712312014 resolution date) that have new 7.26 NGVD
seawall requirement and those that do not . lt seems totally selective as to enforcement of a resolution that
needed thorough understanding and agreement by all Departments that are involved.

#1 Public Works has reviewed several of my homes for permit in the last few weeks and a comment was made
that the I must rebuild my existing seawall up to 7.26 NGVD. The grade in the rear of these homes is at 3 ' - 4.
NGVD. The top of the seawall will be almost 4 ft higher then my grade. So when you are in the back yard of your
home you wilt be looking at a wall and not the water. Which means I will have to raise my grade on of the
property and will need to install retaining walls to keep my rain water on my property. AISO RemOVe all
existing landscape and privacy hedge between the neighbor and the new
hOme. There is a code in Planning and Zoning which limits the amount you are allowed to raise your grade on
the property, based on existing grade. The property owner will have to get a variance to
raise grade
#2 Public Works has reviewed several of my homes for permit in ihe last few weeks and a comment was made
that the city will be raising the side walks 9 to 12 inches and they want the property io meet this future
requirement of raising the city sidewalks. Which means I will have to raise my grade in the front of the property
and will need to install retaining walls to keep my rain water on my property. AISO RemOVe all eXisting
Iandscape and privacy hedge between the neighbor and the new home. rhere is
a code in Planning and Zoning which limits the amount you are allowed to raise your grade on the property,
based on exisring srade. The home owner will be required to get a variance to raise
the grade
#3 Bruce Mowery mentioned in a meeting I had with him several weeks ago, that Publiu works is going to l
require that new homes will have to built 3 ft. above Base flood NGVD . This requirement would raise all new ? /ctb

homes 3 ft. highe( for example. if the Base flood NGVD on star lsland is 10 ft. then the homes first floor slab
will be buitt at13 ft NGVD) . i need to understand how the height of the roof will be established by Planning and
Zoning for the height of the homes roof. Will they go by Base flood NGVD or the 3ft. above base flood NGVD?
Will the home loose 3 ft. of height or will the homes roof get 3ft. higher?
I am just looking to undersland the rules and whal is required to do.
Until the city coordinales these requirements will all Deparlments , I do not see how you can require home
owners to raise the seawatt , when no one { not even Public Works is requiring these items
to be implemented during their review process. See list above , out of 7 single
family homes submitted after July 23,2A14. Only 3 of the 7 homes were
required the raising on the seawall) seems to know how it will effect the surrounding neighbor
hoods and will require the home owner to get a Variance.
My suggestion is we figure out what is required as a package and have
homeowner work shops and then set a date on compliance !
Until then, the minimum required $eawall heights on all new single family homes and renovations of 50% of a
home should be brought up to a 5.4 NGVD. This is a height That Bruce Mowery stated if your exist seawall is at
or above this height then you do not have to raise it. He felt this height was good for the next 30 years. At least
there is a movement to get the seawall raised
