RESOLUTION NO. 97-22512
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA AUTHORIZING THE CITY MANAGER TO EXECUTE
THE FIRST AMENDMENT TO THE PALM AND HIBISCUS ISLANDS
SECURITY GUARD SPECIAL TAXING DISTRICT INTERLOCAL AGREEMENT
WHEREAS, the City and Metropolitan Dade County entered into an Interlocal
Agreement to provide off-duty police officers for security services for the Palm and
Hibiscus Islands Special Taxing District; and
WHEREAS, at the time the Agreement was signed, the hourly rate paid to an off-
duty police officer was established at $20.00 per hour; and
WHEREAS, this hourly rate was increased to $22.00 in February 1997; and
WHEREAS, the attached Amendment to the Interlocal Agreement is required in
order for Metropolitan Dade County to pay the increase in the hourly rate.
NOW THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY 0 F MIAMI BEACH, FLORIDA that the City Manager is
herein authorized to execute the attached Amendment to the Palm and Hibiscus
Islands Security Guard Special Taxing District Interlocal Agreement.

BACKGROUND
The City and Metropolitan Dade County executed an Interlocal Agreement to provide off-
duty police officers to perform security services for the residents of the Palm and Hibiscus
Islands. The off-duty police officers are paid from monies raised through the Palm and
Hibiscus Islands Special Taxing District. The Dade County Public Works Department
administers the Special Taxing District.
In February 1997, the Chief of Police authorized an increase of the hourly rate paid to an
off-duty police officer to $22.00. The Interlocal Agreement established the hourly rate at
$20.00 as it existed at the time of the signing. The Interlocal Agreement has no provision
to automatically adjust the hourly rate should it be changed by the Chief of Police.
The residents of the Palm and Hibiscus Islands have consented to this increase and
requested that the Dade County Public Works Department amend the Interlocal
Agreement.
When the Interlocal Agreement was originally executed, Dade County provided a reserve
fund equal to two weeks expenses. The purpose of the reserve fund is to ensure there are
always funds available to meet expenses due to the time it takes to invoice and produce
checks.

The reserve fund and all monies for this off-duty job are the responsibility of the appointed
police Job Coordinator. The funds are maintained in a separate bank account authorized
by the City Commission and created for this purpose. Both the City and Dade County audit
the books and records of this off-duty job.
This reserve fund has been paying the difference in the hourly costs. Upon executing the
Amendment, the County will reimburse the Police Department, retroactively to February
1997, the two dollars per hour difference.
When the hourly rate was increased, the Police Department notified the Dade County
Public Works Department. Unfortunately, a misunderstanding occurred between members
of the Police Department and their counterparts in the Public Works Department. This
misunderstanding caused a delay in the preparation of the Amendment to the Interlocal
Agreement. When they rectified the misunderstanding, the Public Works Department
requested the County Attorney's Office prepare the Amendment. The County Attorney's
Office did not prepare the Amendment until late July 1997. The Police Department did not
receive the amendment from the County Attorney's Office in time to be placed on the
Commission's July Agenda.
ANALYSIS
By executing the Amendment, the City can continue this service to the residents of this
area and compensate the off-duty police officers working there the same hourly rate as
those off-duty police officers who work other off-duty jobs.
If the Mayor and Commission chose not to execute the Amendment, the City probably
cannot continue to provide the services of off-duty police officers to the residents of the
Palm and Hibiscus Islands. Due to the discrepancy in the hour wage, police officers would
not volunteer to work this off-duty job.
CONCLUSION
The execution of this First Amendment to the Interlocal Agreement will enable the City to
provide this much wanted service to the citizens of the Palm and Hibiscus Islands.

AGREEMENT
THIS FIRST AMENDMENT to the INTERLOCAL AGREEMENT, made and entered into this

1997, by and between DADE COUNTY, FLORIDA (the "COUNTY"), a political
subdivision of the State of Florida, and the CITY OF MIAMI BEACH, FLORIDA (the "CITY"), a municipality
organized and existing under the laws of the State of Florida.
WHEREAS, pursuant to City Resolution 88-19257 the CITY entered into an interlocal agreement
(the "Agreement") providing for the securing of off-duty City of Miami Beach Police Officers to perform
security services for the Palm and Hibiscus Security Guard Special Taxing District; and
WHEREAS, the parties wish to amend the Agreement to provide for revised fees. Now, therefore,
in consideration of the mutual covenants herein, and other good and valuable consideration, the receipt
of which is hereby acknowledged, the parties hereby agree as follows:
1. Paragraph 3, of the Agreement is hereby amended to revise the hourly rates with the words to be
deleted indicated by strikeout and the words to be added indicated by underline:
3. Effective February 3, 1997, the COUNTY agrees to pay a fixed hourly rate of
tvvenj dollars f$-2e.OO7 twenty two dollars ($22.00) per hour for the actual number of
service hours performed, except that on the following days the COUNTY agrees to
pay foft dollars f$4e.OO7 forty four dollars ($44.00) per hour.

The COUNTY agrees to pay a fixed hourly rate of tweny dollars f$Z6.00}
twenty two dollars ($22.00) per hour for hourly services, not to exceed eight (8) hours
per week, as provided by the job coordinator. Effective February 3, 1997.
The COUNTY agrees to pay a fixed rate surcharge of eight (8) dollars ($8.00)
per shift worked.
The COUNTY agrees to pay a fixed rate of seven dollars ($7.00) per shift
worked for administrative c~sts associated with this interlocal agreement.
Realizing the competitive market for off-duty police officer services, the
COUNTY agrees upon execution of the agreement, to deliver $7,000 to insure a
minimum of two weeks service at 24 hours service per day. The prepaid funds will
be recouped as a credit against the CITY invoices received within the last 30 day
period of this contract or any extension thereof.
2. The parties hereby ratify and confirm all other terms and conditions of the Interlocal Agreement
which remain unchanged.
