THE CITY, MIAMI BEACH CHAMBER EDUCATION FOUNDATION, INC.,
NORTH BAY VILLAGE, THE TOWN OF BAY HARBOR ISLANDS, THE TOWN
OF SURFSIDE,AND BAL HARBOUR VILLAGE FOR THE PROVISION OF THE
NURSE ENHANCEMENT INITIATIVE IN FISCAL YEAR 2026 IN AN AMOUNT
NOT TO EXCEED $19,250.00; AND (IV) AUTHORIZING THE CITY MANAGER
AND CITY CLERK TO EXECUTE ANY AND ALL REQUIRED AGREEMENTS
AND DOCUMENTS TO IMPLEMENT THE PROGRAM, INCLUDING SAID
AMENDMENT NO. 8.
WHEREAS, in January 2008, the City of Miami Beach (the "City") entered into an
Education Compact with the Miami-Dade County Public Schools ("MDCPS")to enhance learning
opportunities for youth; and
WHEREAS, the Education Compact reflects the desire of the Miami Beach community to
support excellence in the City's public schools and enhance the health and well-being of the City's
youth; and
WHEREAS, in the 2012-2013 school year, five of the eight schools in the City's
educational feeder pattern had Health Connect in Our Schools ("HCIOS") suites which were
supported by The Children' s Trust ("The Trust") and which provided a full-time Medical Assistant
and a shared Registered Nurse on campus; and
WHEREAS, for students who do not require routine medications, the HCIOS suites were
used for nursing assessments, administration of first aid, and other purposes such as consulting
with parents and caregivers; and
WHEREAS, the City, North Bay Village, the Town of Bay Harbor Islands, the Town of
SurFside, and Bal Harbour Village (collectively, together with the City, the "Participating
Municipalities") determined that a program to provide healthcare services to students attending
underserviced public schools is in the best interests of the health and public welfare of the
Participating Municipalities; and
WHEREAS, following the Participating Municipalities'determination that students at North
Beach Elementary, Treasure Island Elementary, and Ruth K. Broad Bay Harbor K-8 Center (the
"Participating Schools") did not have full-time on-site healthcare services and were, thus,
underserved as compared to other public schools in the feeder pattern that falls within the City,
the Participating Municipalities and Miami Beach Chamber Education Foundation, Inc. ("MBCEF"
together with the Participating Municipalities, the "Parties")entered into the following agreements:
(i)an MOU on August 19, 2013 for a Nurse Initiative, and (ii)an MOU on April 23, 2014, to provide
healthcare services to the Participating Schools during the 2013-2014 and the 2014-2015 school
years; and
WHEREAS, the Parties implemented an enhanced Nurse Initiative (the "Nurse
Enhancement Initiative") for the Participating Schools because the basic healthcare services
previously funded in the Nurse Initiative by the Parties were provided by The Trust via the new
School Health Programs; and
WHEREAS, Resolution No. 2016-29345 authorized the appropriation of $15,400.00 (the
"City Contribution") for the Nurse Enhancement Initiative for the 2016-2017 school year from the
Miami Beach Education Compact Fund; and
WHEREAS, Resolution No. 2016-29468 approved a new Memorandum of Understanding
for the implementation of the Nurse Enhancement Initiative during the 2016-2017 school year;
and
WHEREAS, Resolution No. 2017-29806 approved a new Memorandum of Understanding
for the implementation of the Nurse Enhancement Initiative during the 2017-2018 school year;
and
WHEREAS, on May 17, 2018, the Parties entered into a new Memorandum of
Understanding (as amended by Amendment No. 1 through Amendment No. 7, the "MOU")for the
implementation of the Nurse Enhancement Initiative for the 2018-2019 school year; and
WHEREAS, Resolution No. 2019-30956 approved a City Contribution in an amount not to
exceed $13,887.00 for the Nurse Enhancement Initiative for the 2019-2020 school year and a
City Contribution in an amount not to exceed $15,400.00, for each subsequent school year, on a
recurring basis, subject to funding approval during the City's budgetary process; and
WHEREAS, the Participating Municipalities executed Amendment No. 1 through
Amendment No. 7 to the MOU to continue funding the Nurse Enhancement Initiative at the
Participating Schools for subsequent school years; and
WHEREAS, the benefits of this program have expanded to include comprehensive mental
and behavioral health services, which have proven to be a critical component of student well-
being and academic success; and
WHEREAS, based on the success of the program and the increased demand for mental
health support, it has become necessary to increase the funding to maintain and enhance these
critical services; and
WHEREAS, accordingly, the City Manager requests that the Mayor and City Commission
do the following: (i) approve an increase in the City Contribution for the Nurse Enhancement
Initiative from an amount not to exceed $15,400.00, as set forth in Resolution No. 2019-30956, to
an amount not to exceed $19,250.00; (ii) approve an increase of the City Contribution to an
amount not to exceed $19,250.00 for each subsequent school year, on a recurring basis, subject
to funding approval during the City's budgetary process; (iii) approve, in substantial form,
Amendment No. 8 to the MOU, attached to the City Commission Memorandum accompanying
this Resolution, for the provision of the Nurse Enhancement Initiative for FY 2026 in an amount
not to exceed $19,250.00; and (iv) authorize the City Manager and City Clerk to execute any and
all required agreements and documents to implement the program, including said Amendment
No. 8.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission
hereby (i) approve an increase in the City Contribution for the Nurse Enhancement Initiative from
an amount not to exceed $15,400.00, as set forth in Resolution No. 2019-30956, to an amount
not to exceed $19,250.00; (ii) approve an increase of the City Contribution for the Nurse
Enhancement Initiative to an amount not to exceed $19,250.00 for each subsequent school year,
on a recurring basis, subject to funding approval during the City's budgetary process; (iii)approve,
in substantial form,Amendment No. 8 to the Memorandum of Understanding dated May 17, 2018
among the City, Miami Beach Chamber Education Foundation, Inc., North Bay Village, the Town
of Bay Harbor Islands, the Town of Surfside, and Bal Harbour Village for the provision of the Nurse
Enhancement Initiative in Fiscal Year 2026 in an amount not to exceed $19,250.00; and (iv)
authorize the City Manager and City Clerk to execute any and all required agreements and

RECOMMENDATION
The Administration recammends approving Amendment No. 8 to the Memorandum of
Understanding (MOU) between the City of Miami Beach, North Bay Village, The Town of Bay
Harbor Islands, The Town of Surfside, Bal Harbor Village, and The Miami Beach Chamber
Education Foundation to implement a Nurse Enhancement Initiative. This amendment revises the
City's contribution to an amount not to exceed $19,250 for the Fiscal Year 2026.
The Administration also recommends approving this same contribution on a recurring basis for
subsequent years, with the amou�t not to exceed $19,250 per year, subject to funding approval
in each fiscal year's budget.
BACKGROUND/HISTORY
In January 2008, the City of Miami Beach ("the City")entered into an Education Compact with the
Miami-Dade County Public Schools ("MDCPS"). This compact was created to enhance learning
opportunities for youth and reflected the Miami Beach community's desire to support excellence
in its public schools and the health and well-being of its youth.
During the 2012-2013 Schoal Year, five of the eight schools in the educational feeder pattern had
Health Connect in Our Schools ("HCIOS") suites. These suites were supported by The Children's
Trust ("The Trust") and provided a full-time Medical Assistant and a shared Registered Nurse an
campus. For students who did not require routine medications, the HCIOS suites were used for
nursing assessments, first aid, and consultations with parents and caregivers.

The City of Miami Beach, North Bay Viilage, the Town of Bay Harbor Islands, the Town of
Surfside, and Bal Harbour Village ("Participating Municipalities") determined that a program to
provide healthcare services to students attending underserved public schools was in the best
interests of the health and public welfare of the Participating Municipalities. They realized that
students at North Beach Elementary, Treasure Island Elementary, and Ruth K. Broad Bay Harbor
K-8 Center did not have full-time on-site healthcare services and were, therefore, underserved
compared to other public schools in the feeder pattern.
To address this, the parties entered into a Memorandum of Understanding (MOU) on August 19,
2013, for a Nurse Initiative, and a second MOU on April 23, 2014, to provide healthcare services
to these schools during the 2013-2014 and 2014-2015 School Years.
Following that initial determination, the parties implemented an enhanced Nurse Initiative to
provide the basic healthcare services previously funded by the Participating Municipalities, the
Miami Beach Chamber Education Foundation, Inc., and The Trust, were now being provided by
The Trust via the new School Hea�th Programs.
Resolution 2016-29345 (Attachment A) authorized an appropriation of $15,400 from the Miami
Beach Education Compact Fund for the City's proportionate share of funding for the Nurse
Initiative. A new MOU for the 2016-2017 School Year was then approved by Resolution 2016- •
29468 (Attachment B), and another new MOU for the 2017-2018 School Year was approved by
Resolution 2017-29806 (Attachment C). On May 17, 2018, the Participating Municipalities entered
into a new MOU for the 2018-2019 through the 2024-25 School Years per Resolution 2019-30956
(Attachment D).
The Participating Municipalities executed amendments 1 through 7 (Attachment E) to the MOU
to continue funding mental and behavioral health services for students in the pa�ticipating schools.
The benefits of this program have expanded to include comprehensive mental and behavioral
health services, which have proven to be a critical component of student well-being and academic
success.
ANALYSIS
Mental health support was sustained in 2025 with 252 youth receiving a total of 1,370 sessions,
up from 131 youths and 779 sessions in the previous year. Several schools received telehealth
services through a partnership with Hazel Health. The table below indicates the number of
sessions provided to youth at on-site at select Miami Beach feeder schools receiving senrices
during the 2024-2025 school year through a partnership with neighboring municipalities,
Borinquen Medical Centers, The Children's Trust and the Miami Beach Chamber Education

For the 2025-26 school year, The Children's Trust has selected Jesse Trice Community Health
Services as the provider for the Miami Beach public schools. As such, the city will execute
agreements with the Miami Beach Chamber Education Foundation and our neighboring
municipalities to continue these much needed and heavily utilized mental health services with our
new provider. Each partner municipality has agreed to a 25 percent increase annually as the
program is heavily utilized by students throughout the school year.
Anticipated contributions for this partnership for a total of$66,670 are as follows:

• North Bay Village $8,250
• Town of Surfside $10,140
• Town of Bay Harbor Islands $10,140
• Village of Bal Harbor$10,140
• Miami Beach Chamber of Commerce $8,750
FISCAL IMPACT STATEMENT
FY 2026 - $19,250 which is a $3,850 increase from prior years due to increase costs as no
increase to program has been made since 2012. Neighboring municipalities all increased
contributions by 25%.

CONCLUSION
Based on the program's success and the increased demand for mental health support, it has
become necessary to increase the funding to maintain and enhance these critical services. The
Administration now recommends approving Amendment No. 8 to the MOU (Attachment F), which
would provide for a revised City contribution of an amount not to exceed $19,250 in FY 2026. The
Administration further recommends approving this City contribution on a recurring basis for
subsequent years, in an amount not to exceed $19,250 per year, subject to funding approval
during the City's fiscal year budgetary process.

is internationally recognized as a benchmark for education excellence and also fosters student

WHEREAS, in the 2012-13 school year, five of the eight schools in our educational
feeder pattem had Health Gonnect in Our Schools (HCIOS) suites which are supported by The
Children's Trust and which provide a full-time Medical Assistant and a shared Registered Nurse
on campus; and
WNEREAS, for students who do not require routine medications, the HCIOS suites are
used for nursing assessments, administration of first aid, and other purposes such as consulting
with parents and caregivers; and
WHEREAS, the City of Miami Beach, North Bay Village, the Town of Bay Harbor
Islands, the Town of Surfside, and Bal Harbour Village ("Participating Municipalities") have
determined that a program to provide healthcare services to students attending underserviced
public schools is in the best interests of the health and public welfare of youth; and
WHEREAS, in the 2013-14 school year, a municipal Nurse Initiative was implemented
pursuant to a Memorandum of Understanding between the Participating Municipalities to
provide a HCIOS team of professionals including a shared Registered Nurse, a full-time Medical
Assistant, and a social worker which is already funded by Miami-Dade County Public Schools
for the 2013-14 School Year and 201415 School Year; and

WHEREAS, the benefits of HCIOS health teams include: a coordinated level of school-
based healthcare, expanded heafth screenings, and assessments with access to follow-up care,
mental and behavioral health services to identify and so(ve student health and educational
issues, nutrition and health counseling, heath services for uninsured students with no other
option for access to health care, emergency first aid/CPR, and chronic disease management;
and
WHEREAS, utilization of the HCIOS heatth teams remained high throughout the 2014
15 school year, with 52 percent of 3,044 unduplicated students utilizing the services an average
of eleven visits per day per school resulting in 3,836 visits in the school year; and
WHEREAS, by approval of Resolution 2015-42 on February 9, 2015, The Children's
Trust Board of Directors approved the release of RFP 2015-17: School Health Programs to
fund improved access to quality health care through providers delivering comprehensive
services in the public schools to 145 pre-selected schools for School Years 2015-16, 2016-17,
and 2017-18; the programs which are the subject of the RFP include all three (3) Miami Beach
schools in the City's original Nurse Initiative; and
WHEREAS, due to the success of the Nurse Initiative during the 2013-2014 School Year
and the 2014-15 School Year, the City of Miami Beach authorized an enhanced nurse initiative
("Nurse Enhancement Initiative")for the 2015-16 School Year per Resolution No. 2015-29004 to
include behavioral health services; and
WHEREAS, the City's proportionate share for the Nurse Enhancement Initiative is
approximately $15,400 for the 2016-17 School Year and will not be due to be paid until October
31, 2016; and
WHEREAS, the funds for the City's proportionate will be subject to approval in the FY
2016/17 Annual Budget; and
WHEREAS, the The Children's Trust has committed to fund the School Health Programs
at all Miami Beach feeder schools through the er►d of the 2017-18 School Year; and
WHEREAS, the Miami Beach Chamber Education Foundation (MBCEF) shall provide
funding for the 2016-2017 Nurse Enhancement Initiative from unused funds ($14,000) provided
by the Aetna Voices Health award pursuant to the 2013-14 Nurse Initiative Memorandum of
Understanding, such funds shall be carried over for an additional two years at $7,000 per year
through the 2017-18 School Year; and
WHEREAS� as of April 2016, each of the Participating Municipalities has committed
approximate funding for the Nurse Enhancement Initiative fo� the 2016-2017 school year as
follows: City of Miami Beach $15,400, Town of Surfside $3,667, Town of Bay Harbor Islands
$3,667, Bal Harbour Village $3,667, and North Bay Village $6,600; and
WHEREAS, the Miami Beach Chamber of Commerce will serve as the fiscal agent to
collect the funds from the Participating Municipalities and the City of Miami Beach and will
disperse the funds to The Children's Trust; and
YYHEREAS, on or before October 31, 2016, the PaRicipating Municipalities shall provide
their proportionate share of funds for the 2016-2017 Nurse Enhancement Initiative to MBCEF,

which funds MBCEF shall hold in escrow pending the execution of its agreement with The
Children's Trust; and,
WHEREAS, it is anticipated that a Memorandum of Understanding will be entered into
between the City of Miami Beach, the Miami Beach Chamber Education Foundation, Inc., North
Bay Village, the Town of Surfside, the Town af Bay Harbor Islands, and Bal Harbour Village,
with the Participating Municipalities contributing their proportionate share of the costs to support
the Nurse Enhancement Initiative program for the 2016-17 School Year; and
WHEREAS, the MOU may be extended for up to one additional School Year in 2017-18,
pending available funding from the Participating Municipalities.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
CDMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission hereby authorize the Mayor and City Clerk to execute a Memorandum of
. Understanding, substantially in the form attached to this Resolution, between the City of Miami
Beach, the Miami Beach Chamber Education Foundation, Inc., North Bay Village, the Town of
Bay Harbor Islands, the Town of Surfside, and Bal Harbour Village, to support and enhance the
Nurse Enhancement Initiative for the 2016-2017 School Year and authorizing the appropriation
of $15,400 from the Miami Beach Education Compact Fund for the Ciry of Miami Beach's
proportionate share of funding for the Nurse Enhancement Initiative subject to approval in the
City's FY 2016/17 Annuai Budget.

SCHOOL; SAID MOU PROVIDING FOR INITIATIVE SERVICES
FOR THE 2016-2017 SCHOOL YEAR, WITH POSSIBLE
' RENEWAL OPTIONS, UPON MUTUAL AGREEMENT OF THE
PARTIES, FOR THE 2017-2018 AND 2018-2019 SCHOOL
YEARS, WITH THE CITY'S CONTRIBUTION BEING SUBJECT
TO CONSIDERATION IN THE BUDGET DEVELOPMENT
PROCESS FOR EACH RESPECTIVE FISCAL YEAR; AND
FURTHER AUTHORIZING THE CONSIDERATION OF 553,600
IN FUNDING FROM THE CITY'S 2016-2017 FISCAL YEAR
ANNUAL BUDGET FOR THE CITY'S CONTRIBUTION TO THE
INITIATIVE FOR THE 2016-2017 SCHOOL YEAR.
WHEREAS, in January 2008, the City of Miami Beach ('City") entered into an Education
Compact with Miami-Dade County Public Schools to enhance leaming opportunities for youth;
and
WHEREAS, the Education Compact reflects the desire of the Miami Beach community
to support excellence in the City's public schools and enhance the health and well-being of our
City's youth; and
WHEREAS, the City Commission has determined that a program to provide healthcere
services to students attending underserviced public schools is in the best interests of the health
and public welfare of the City of Miami Beach; and
WHEREAS, due to the success of Nurse Initiatives in School Years 2013-2014 and
2014-2015, and the Enhanced Nurse Initiative in School Year 2015-2016, which were
established at North Beach Elementary, Treasure Island Elementary, and Ruth K. Broad K-8
Center, Commissioner Steinber� made a motion at the April 13, 2016 Commission meeting
(Item R9AA), which passed unanimously, to continue and expand behavioral health services for
public schools within the City by providing for a licensed clinical social worker one day a week at
Miami Beach Senior High School, Nautilus Middle School, Feinberg-Fishe� K-8 Center,
Biscayne Elementary School, and South Pointe Elementary School (the "Participating Schools")
for the 2016-2017 School Year; and
WHEREAS, a Miami Beach Nurse Enhancement Initiative for Behavioral Health
Services ("Initiative") should be established at the Participating Schools for School Yea� 2016-

2017 as provided in the attached Memorandum of Understanding ("MOU"), and pursuant to a
sepa�ate agreement to be entered into between the Miami Beach Chamber Education
Foundation, Inc. (MBCEF) and The Children's Trust (TCT) to provide for the staffing and the
payment of certain costs associated with lnitiative; and
WHEREAS, MBCEF shall enter into an agreement with TCT whereby TCT, through its
contractor gorinquen Heaith Care Center ("Bonnquen"), shall provide the following in-kind
services, valued at $22,U00, and whereby TCT shall provide the following in-kind funding valued
at $13,400, at the Participating Schools:
a. Promote a wellness approach within each Participating School by training various
school staff members:
b. Conduct school-wide behavioral screenings that will lead to early identification of
at-risk students;
c. Implement protocols that ensure behavioral screenings are administered briefly,
e�ciently, and respectfully;
d. Support identified students and their families by linking them to appropriate
clinical intervention and supportive services;
e. Collaborate with various clinical teams at the Participating Schools and in the
community;
f. Deliver culturally competent services and support systems; and
g. In-kind funding, valued at $13,400, for a full-time licensed clinical social worker in
the Participating Schools for the months of August and September, 2016; and,
WHEREAS, TCT will provide monthly reports dacumenting the percent of students
returning to class after all visits relative to the services provided by the licensed clinical social
worker at the Participating Schools; and
WHEREAS, the City's contribution of funding for the Initiative to MBCEF in the amount
of $53,600 for Initiative services from October 1, 2016 to July 31, 2017 is subject to budget
approval by the City, which funds MBCEF will hold in escrow pending the execution of its
agreement with TCT; and
WHEREAS, the MOU may be extended for up to two additional School Years in 2017-
2018 and 2018-2019, subject to funding approval by all parties.

NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF TNE C{TY OF MIAMI BEACH, FIORIDA that the Mayor and City
Commission hereby approve and authonze the Mayor and City Cierk to execute the attached
Memorandum of Understanding between the City of Miami Beach and the Miami Beach
Chamber Education Foundation, Inc., to implement a Miami Beach Nurse Enhancement
Initiative for Behavioral Health Services for School Year 2016-2017 for Miami Beach Senior
High School, Nautilus Middle School, Fienberg-Fisher K-8 Center, Biscayne Elementary School,
and South Pointe Elementary School, with possible renewal options upon mutual agreement of
the Parties for the 2017-18 and 2018-19 School Years, with the City's contribution being subject
to consideration in the Budget development process for each respective fiscal year, and further
authonzing the consideration of $53,6Q0 in funding from the City's 2016-17 Fiscal Year Annual
Budget for the City's contribution to the Initiative for the 2016-2017 School Year.

is internationally recogni2ed as a benchmark for education excellence and also fosters student
participation in community service; and
WHEREAS, in the 2012/13 School Year, five of the eight schools in our educational
feeder pattern had Health Connect in Our Schools (HCIOS)suites which were supported by The
Children's Trust and which provided a full-time Medical Assistant and a shared Registered
Nurse on campus; and
WHEREAS, for students who do not require routine medications, the HCIOS suites used
for nursing assessments, administration of first aid, and other purposes such as consulting with
parents and caregivers; an.i
WHEREAS, the City of Miami Beach, North Bay Village, the Town of Bay Harbor
Islands, the Town of Surfside, and Bal Harbour Vllage ('Participating Municipalities")
determined that a program to provide healthcare services to students attending underserviced
public schools is in the best interests of the health and public welfare of youth; and
WHEREAS, in the 2013/14 School Year, a municipal Nurse Initiative was implemented
pursuant to a Memorandum of Understanding between the Participating Municipalities to
provide a HCIOS team of professionals including a shared Registered Nurse, a futl-time Medical
Assistant, and a social worker which was funded by Miami-Dade County Public Schools; and

WHEREAS, the benefits of HCIOS health teams include: a coordinated level of schooi-
based healthcare, expanded health screenings, and assessments with access to follow-up care,
mental and behavioral health services to identify and solve student health and educational
issues, nutrition and health counse(ing, heath services for uninsured students with no other
option for access to health care, emergency first aid/CPR, and chronic disease management;
and
WHEREAS, utilization of the HCIOS remained high throughout the 2014/2015 School
Year, with 52 perce�t of the 3,044 unduplicated students utilizing the services from August 2014
through February 2015, an average of eleven visits per day per school resulting i» 3,836 visits;
and
WHEREAS, by approval of Resolution 2015-42 on February 9, 2015, The Children's
Tn.ist Board of Directors approved the release of RFP 2015-17: School Health P�ograms to
fund improved access to quality health care through providers delivering comprehensive
senrices in the public schools to 145 pre-selected schools for School Years 2015-16, 2016-17,
and 2017-18; the programs which are the subject of the RFP include all three (3) Miami Beach
schools in the City's original Nurse Initiative; and
WHEREAS, due to the success of the Nurse Initiative during the 2Q13/2014 and
2014/2015 Schoof Years, the Parties implemented an enhanced nurse initiative ("Nurse
Enhancement Initiative"} for the 2015/2016 and the 2016/2017 Schoo! Years for the
Participating Schools because the basic healthcare senrices previously funded in the Nurse
Initiative by the Participating Municipalities, the Miami Beach Chamber Education Foundation,
Inc., and The Children's Trust, were provided by 7he Children's Trust via the new Schaol Health
Programs; and
WHEREAS, the Nurse Enhancement Initiative established at the Participating Schoots
for Schoo( Years 2015/2016 and 2016/2017 was a success and the Parties wish to provide for
an enhanced nurse initiative for the 2017/2018 Schaol Year; and
WHEREAS, the City's proportionate share for the Nurse Enhancement Initiative is
approximately $�5,400 for the 2017/2018 School Year and will not be due to be paid until
October 31, 2017; and
WHEREAS, the funds for the City's proportionate share will be subject to approval in the
City's FY 2015/2016 Annual Budget; and
WHEREAS, The Children's Trust has committed to fund the School Health Programs at
all Miarni Beach feeder schools through the end of the 2017/2018 School Year; an�
WHEREAS, the funding provided by the Participating Municipalities will enhance The
Children's Trust Schoo! Health Programs for North Beach Elementary, Treasure Island
Elementary, and Ruth K. Broad Bay Harbor K-8 Center (the "Schools"), to include services such
as behavioral health each week during the 20�7/2018 School Year at each of the Schools; and
WHEREAS, funding from The Children's Trust will provide for a full-time registered
nurse andlor licensed practical nurse at each of the Schools for the 2017/2018 School Year,
and
WHEREAS, each of the Participating Municipalities will contribute approximate funding
for the Nurse Enhancement Initiative for the 2017/2018 School Year, subject to their respective

budget approvals, as foilows: City of Miami Beach $15,400, Town of Surfside $3,667, Town of
Bay Harbor Islands $3,667, Bal Harbour Village $3,667, and North Bay Ullage $6,600, which
amounts will be offset by unused funds from the 2016/2017 Nurse Enhancement Initiative for
the Town of Surfside, the Town of Bay Harbor Islands, Bal Harbor �Ilage, and North Bay
Village; and
WHEREAS, the Miami Beach Chamber of Commerce will serve as the fiscal agent to
collect the funds from the Participating Municipalities and will disperse the funds to The
Children's Trust; and
WHEREAS, on or before October 31, 2017, the Participating Municipalities shall provide
their proportionate share of funds for the 2017l2018 Nurse Enhancement Initiative to MBCEF,
which funds MBCEF shall hotd in escrow pending the execution of its agreement with The
Children's Trust; and
WHEREAS, it is anticipated that the attached Memorandum of Understanding ("MOU")
will be entered into between the City of Miami Beach, the Miami Beach Chamber of Commerce,
Narth Bay Village, the Town of Surfside, the Town of Bay Harbor Islands, and Bal Harbour
Village, with the Participating Municipalities contributing their proportionate share of the costs to
support the Nurse Enhancement Initiative program for the 2017/2018 School Year; and
WHEREAS, the MOU may be extended for up to one additional year pending available
funding and the commitment of current funding levels from the Participating Municipalities.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MI14M1 BEACH, FLORIDA that the Mayor and City
Commission hereby authorize the Mayor and City Clerk to execute a Memorandum of
Understanding, in a form acceptable to the Ciry Manager and the City Attorney, between the
City of Miami Beach, the Miami Beach Chamber of Commerce, North Bay Village, the Town of
Bay Harbor Islands, the Town of Sur�side, and Bal Harbaur Village to support the Nurse
Enhancement Initiative for the 2017/2018 School Year, and authorizing the appropriation of
$15,400 from the Miami Beach Educatian Compact Fund for the City of Miami Beach's
proportionate share of funding for the Nurse Enhancement Initiative subject to approval in the
City's FY 2017/2018 Annual Budget.

Village, w�h the Participating Municipalities contributing their proportionate share of the
costs to support the Nurse Enhancement Initiative program for the 2018-2019 School
Year; and
WHEREAS, on December 24, 2018, the Participating Municipalities executed
Amendment No.1 to the 2018-2019 MOU, each of the Participating Municipalities
contributing funding for the Nurse Enhancement Initiative for the 2018-2019 School Year,
and
WHEREAS, the Administration recommends approving Amendment No. 2 to the
MOU, in the form attached to this Resolution, approving a City contribution in an amount
not to exceed $13,887 ("City Contribution") for the 2019-2020 School Year, and
approving, on a recurring basis, the C�ty"s Contribution to the program for subsequent
years, subject to funding approval during the City's fiscal year budgetary process,
provided that the City Contribution does not exceed $15,400 per year.

33139 (coltect�vely, ihe 'Parties"� Eo amend the Memorandum of U�cierstanding entered into on
May 17. 2018 ( MOU"), as amencied by Amendments No. 1 through No 6, as follaws.
RECITALS
WHEREAS, the Parties have determined that a program to prov�de healthcare services to
students attending �nderserviced pub�ic schoois �s in the best interests of the heaith arxi publ�c
welfare of the C�ty of M�am� Beach, North Bay Viliage. the Town of Bay Harbor isiands, the Town
ot Su�ts�de and Bal Harbour Vitia� (the �Participating Munictpalitias"'); and
WHEREAS tolloanng the Parties determmation that students at Miami Beach North
Beach Elementary, Treasure Isiar�d ElemeMary, and Ruth K. Broad Bay Harbor K-8 Center(the
�PaRicipatir� Schools } db not have fuil-bme on-site healthcare services and were, thua,
underserved as compared to other pubfic schools i�the feedef pattern that falls with�n the C+ty of
Miam� Beach, the Pa�t�es entered into a Mernorandum o1 Understanding on August 19, 2013 for
a Nurse Irntiat�ve, and another Memorandum of Understanding on Apnl 23. 2014, to provide
heatthcare serv►ces to the Partic�pating Schoois dunng the 2013/2014 and the 2014/2015 Schooi
Years; and
WHEREAS, due to the success of Nurse IrnUaUves dunng the 2013�2014 and 2Q14l2015
Schoo� Years. the Parties imp�me�ted an anhanced r�urse irntiat►ve ( Nurae Enhancament
Initistive") for Fhe 2015l2016, 2016/2017, and tlie 2Q17l2018 School Years for the Part�apabng
Schaois because ttie basic hea�thcare services prev�ously funded in the Nurse ind�abve by the
Part►cipating Municipal�t�es, the MBCEF, and the Chitdren's Trusi ("TCT'), were provided by TCT
via the new School Heaith Programs; and

RECITALS
WHEREAS, the Parties have determined that a program to provide healthcare services to
students attending underserviced public schools is in the best interests oi the heaNh and public
welfare of the Gty of Miami Beach, North Bay Village, the Tawn of Bay Harbor Islands, the Town
of Surfside, and Bal Harbour Viliage(the"Participating Municipalitiea"); and
WHEREAS, following the Parties' determination that students at Miami Beach North
Beach Elementary, Treasure Island Elementary, and Ruth K. Broad Bay Harbor K-8 Center(the
'Pnrticipating Schoola") did not have fulbtime on-site healthcare services and were, thus,
underserved as compared to othe�public schaols in the feeder pattem that falls within the City of
Mfami Beach, the Parties entered into a Memorandum o( Understanding on August 19, 2013 for
a Nurse Initiaiive, and another Memorandum of Understanding on AQril 23, 2014, to provide
heatthcare services to the Participating Schools during the 2013/2014 and the 201M2015 School
Years; and
WHEREAS, due to the success of Nurse Initiatives during the 2013/2014 and 2014l2015
School Years, the Parties implemented an enhanced nurse initiative ("Nurse Enhancement
Inittative°) for the 2015/2016, 2016/2017, and the 2017/2018 School Years for the Participating
Schools because the basic healthcare servicss previously funded in the Nurse Initiative by the
Participating Municipalities, the MBCEF, and the Children's Trust('TCT"), were provided by TCT
via the new School Heatth Programs; and

WHEFtEA5, on Msy 17, 2018, CMB, NBV, TBHI, TS, BHV, and MBCEF exec�ted the
MOU for the continuation of the Nurse Enhancement Initiative for the PaRicipating Schools for the
2018-2019 School Yea�; and
WHEREAS, the Parties executed Amendment No. 1 to the MOU, dated �ecember 24,
2018, adding an additianal day of service at Ruth K. Broad Bay Harbor K-8 Center; and
WHEREAS, on September 11, 2019,the Mayor and City Commission adopted Resolution
No. 2019-30956, approving Amendment No. 2 to the MOU and approving funding of CMB's
contribution for each subsequent School Yea�, on a recurring basis, subject to funding approval
during CM8's budgetary p�ocess and provided that CMB's contribution amount does not exceed
$15,400.00; and
WHEREAS, the Parties executed Amendment No. 2 to the MOU, dated Seplember 19,
2019, extending the Nurse Enhaneement Initiative for the Participating Schools far the 2019-20
School Year; and
WHEREAS, the Parties executed Amendment No. 3 to the MOU, dated August 19, 2020,
extending the Nurse Enhancement Initiative for the Participating Schools for the 2fl2Q-21 School
Year; and
WHEREAS, the Pa�tiss executed Amendment No. 4 to Ihe MOU, dated July 21, 2021,
extending the Nurse Enhancement Initiative for the Participating Schools for the 2021-22 School
Yesr; and
WHEREAS, the Pa�ties executed Amendmeni No. 5 to the MOU, dated July 26, 2022,
extendi�g the Nurse Enhancement Initiative for the Participating Schools for the 2022-23 School
Year, and
WHEREAS, The MOU and Amsndments No. 1 through No. 5 to the MOU shall be
collectively referred to herein as the"MOU"; and
WHEREAS, due to the success of►he Nurse Enhancement Initiative senrices, the Parties
wish to provide the Nurse Enhancement Initiative for the 2023-2024 School Year; and
WHEREAS, a Nurse Enhancement Initiative should be established at the Participating
Schools for School Year 2023-2024 as herein provided and pursuant to a separate agreement
between MBCEF and 7C7; and
WHEREAS, MBCEF shall provide funding to TCT for the 2023-2024 Nurse Enhancement
Initiative in the amount of$7,000.00.
NOW, THEREFORE, in conside�ation of the mutual conditians and promises contained
herein, the Parties agree to amend the MOU as follows:

WHEREAS, the Parties have determineci that e program to provide healthcare senrices to
studer�ts ettending underserviced public schools is in the best interests vt the health and puWic
welfare of the City of Miami Beach, Narth Bay Vfllage, the Town of Bay Harbor Istands,the Town
of Surfside, and Bal Narbaur�Ilage(the"Participating Muntcipelitles"); and
WHEREAS, foNowing lhe Panies' determinalion that students a! Miami Beach North
Besch Elementary, Treasure island Elementary, and Ruth K. 8road Bay Harbor K-8 Center(the
"Pa�ticipating Schoals"} d� not have full-time ar�-site heafthcare services and ware, thus,
underserved as compared to other public schools in the feeder pattern that(alls wilhin the City of
Miami Beach, lhe Parties entered into a Memorandum of Understanding on August 19, 2013 for
a Nurse Initiative. and another Memorandum ot Understa�ding on April 23, 2014, !o provide
healthcsre services to the Ps�tictpatin9 Schools dunng the 2013t2014 and the 2014/2015

WNEREA3, due to the success of Nurse Initiatives during the 2013/2014 and 2014/2015
Schoai Years, the Parties implemented an enhanced nurse m+tiative (`Nurse Enhancemont
Initiative")tor the 2Q15/2018, 2016/2017, and the 2017J2018 SG�ool Years For the Participating
Schoola because the basic healthcare services previously funded in the Nurse Initiative by fhe

extending the Nurae Enhancement Initiative tor the Participattng Schoola For the 2020-21
Schaoi Year; and
WHEREAS, due to the succ�ss of the Nurse Enhancement Initirtive services, ihe
Parties wish to provide the Nurse Enhancement Initiative for Ihe 2021i2022 School Year; and

Amendment Na. 3 ("Amendment") is made and ente�ed into this 19 day of
Augusr �a20, by and between the City ofi Miaml Beach, Fiorida, a municipal
corporation organized and existing under the laws af the State af Fiorida, having its
principal place of business at 17p0 Convention Center Drive, Miami Beach, Flonda 33139
("CMB"}, North Bay Village ("NBV"), the Town of Bay Harbor Islands �"TBH{")t the
Town of Surfside ("TS"), g,al Narbour Villape ("BHV"), and the Miami Beach
Chsmbqr Education Foundation, Inc. ("MBCEF") (caliectively, the "Parties") to amend
the Memorandum of Understanding entered into on May 17, 2018 ("MOU"), as amended
by Amendment No, 1 to the MOtJ, dated December 24, 2018 a�d as amended by
Amendmen! No. 2 ta the MOU, dated September 19, 2019 (coliectively, the "'MOU"), as
follows:
RECITALS
WHEREA5, the PaRies have determined that a p�ogram to provide healthcare
services to students attending underserviced public schools is in the best inte�ests of the
health and public wel�are of the City of Miami Beach, North Bay Village, the Town of Bay
Harbbr Islands, the Town of Surfside, and Ba1 Harbaur Village (the "Participating
Mu�icipatities"); and
WHER�AS, foliowing the Parties' determinatian that students at Miami Beach
North Beach Elementary, Treasure Island Elementary, and Ruth K. Broad Bay Harbor K-
8 Center(the "Participating Schools") did not have full-time on-site healthcare services
and were, thus, ur�erserved as compared to ather pubfic schaols in the fesder pattem
that faps within the City of Miami 8e�ch, the Parties entered into a Memorarxium of
Understanding on August 19, 2013 for a Nurse Initiative, and another Memorandum of
Understanding on April 23, 2014, to provide healthcare services to the Pardcipating
Schools during the 2013/2014 and the 2014/2015 School Years; and
WHEREAS, due to the success of Nurse Initiatives during the 2013l2014 and
2014/2015 School Years, the Parties implemented an e�hanced nurse initiative ("Nurs•
Enhanceme�t Initfative") for the 2015/2016, 2016/2017, and the 2017/201$ School
Years for the Participating Schools because the bas�c healthcare services previous{y
funded in the Nurse Initiative by the Participating Municipalities, the MBCEF, and the
Children's Tnast("TCT"), were provided by TCT via the new Schaol Health Programs; and

WHEREAS, an May 17, 2018, CMB, NBV,TBHI, TS, BMV, and MBCEF executed
the MC)U for the cantinuatian of the Nurse EnhancQment I�ltiadve for the Pariicipating
5choots for the 2018-2019 Schoo) Yea�; and
WHEREAS, the Parties executed Amendment No. 1 to the MOU, dated December
24, 2U18, adding an additional day of service at Rutfi K. Broad Bay Harbor K-8 Center;
and
WNEREAS, on September 11, 2019, the Mayar and Ciry Commission adopted
Resolution No. 2019-30956, approving Amendm�ant No. 2 to ihe MOU and approving
femding of CMB's contribution for each subsequent scttooi year, on a recurring basis,
subtect ta funding approvai during CMB's budgetary process and provided that CMB's ,
contribution amount does not exceed $15,400.00; and
WHEREAS,the Partias executed Ame�dment Na. 2 to the MOU, dated September
19, 2019, extending the Nurae Enhancament initiative for the PaKlcipating Schools
for the 2019-20 School Year; and
WHEREAS, tt�e Parties wish to provide for another Nurse Enhancement
Initlative for the 2020/2021 School Year; and
WHEREAS, a Nurse Enhancement Initlative should be established at the
Participating Schools for School Year 2020/2021 as herein provided and pu�uant to a
separate agreement between MBCEF and TCT.
WHEREAS, MBCEF shall provide funding to TCT for the 202Q-2021 Nurse
Enhancement Injtjativs in the amount of$7,000.00.
NOW, 7HEREFORE, in cansideration o� the mutuat condit►ons and promises
contained herein, the Parties agree to amend the MOU as follows:
1. ABOVE RECITALS,
The above recitals are true and correct and are incorporated as part of this
Amendment.
2. M�DIFICATIONS.
Paragraph 3 of the MOU is hereby deleted in �ts enfirety and replaced with the
follawing:

4. RATIFICATION.
Except as amended herein, ali other terms and canditians of the MOU shali remain
in full force and effect. In the event there is a conflicf between the provisions of this
Amendment and the MBU, the provisions of th�s Amendment shatl govem.

Medical Asslstant and s �fiered Registered Nurse on r.�mp�s; and

Nurse, a full-dme Medlcal Assfstant, and a sociai w+orlcer which was funded by Miemi-
Dade County Publk Sctwots; and
WHEREAS, the benef�s of HCIOS heatth teams include: a coordinated level of
schooi-baaed healthcare, expanded health screenings, and assessments with access to
fotlow-up care, meMal and behaviaral heal� services ta kientify and aolve student health
and educational issues, nutritfon and health counselfng, hesth services for uninsured
studeryts with no other optlon for access to health care, emergency �� aidJCPR, and
chronic disease management; and
WHEREA3, utilizatbn of the HCIOS remained tr�h throuphout tt►e 20142015
Schooi Year, with 52 per�cent af the 3,044 unduplicated stude�ts utiilzing the servlces
from August 2014 through February 2015, an average of eleven vtsits per day per schoo)

servioea to studertts attending underservioed public �chools is in the best interssts of
the heal� and public welfare of the City of Miami 8each, North Bay Vflla�e, the Town of
Bay Harbor Islands, the Tawn of Surfside, and Bei Harbour Village (the `Partkipatln9
Muntcipaliti�s'�; and
WHEREAS, f�lowing the Parties' detenni�etion thai students at North Beach
Elementary, Treasure Istend Elementgry, and Ru� K. 3road Bay Harbof K-8 Certter
(the "Participatlnp Schoois") �id not have full-time on-stta hesithcare services and
were, thus, underserved as compared to othe� pubiic schoots in the teeder pattern that
fatls within tt�e City of Miami Baach, the Parties entered into a Memorandum of
Understanding on August 19, 2013 for a Nu�se In'rtiative, and ano#t�er Memorandum of
Understanding on Apn1 23, 2014, to provide healthcare services ta tfie Particip�tinp
Schools during the 201�Q14�nd the 201412015 School Ye��; and
WHEREA3, due to the success af Nurse Initi�t�ve dUring the 201312014 and
201412015 ScFroal Years, the Par�es imp{emented an enhanced nurse iniNative ("Nurse
Enh�nc�ment tni�ative') for the 2015/2018, 2018/2017, and the 2017/2018 School
Years fo� the Particlp�ting Schools because the basic healthcare services previous(y
funded in the Nurse Initiative by the ParBcipa�ng Municlpalities, the MBCEF, and the
Children's Trust, were provided by the Chiidren's Trust via the new School Heatth
P�ograms; and
WHEREA3, tt�e Parties executed Amendmertt No. 1 to ihe Mt�U, dated
Gecember 24, 2018, extending the Nurse Enhancemertt Initiative fo� the Partfcineting

This i� a Merrrorandum of Understanding (hMOU") made and entered into this

("CMB"), North-�Ilage ("NBV"), the Tvwn of Bay Narbar {stands ("TBHt"�, the
Town of Surfside ("TS"j. Bal Harbour Village ("BHV"), and the Miami BQach
Chamber Education Foundation, Inc. ("MBCEF") (collect;vefy, the "Parties"} to
provide for funding and �ar the implementation of a Nurse Enhancement Initiative as
• provided here�n, and as to be prvvided in an agreement between MBCEF and The
Chiidren's Truat("TCT").
WITNESSE7H
WHEREAS, the Parties have determined that a �rogram to prov�de heatthcare
services to students attending underserviced public schools is in the best interests of
the health ar�i public welfare af the City of Miami Beach, No�th 8ay Village. the Town of
Bay Harbor Isfands, the Town of Surfside, and Bal Harbour Village (the `Particfpating
MunicipalitiQs"); and
WHEREAS, fatlowing the Parties' deteRnination that students at North Beach
Eleme�tary, Treasure Island Elemerttary, and Ruth K. Broad Bay Harbor K-8 Center
(tt►e "Participating Schools") did not have full-time on-site heatthcare services and
were, thus, underserved as campared to othe� public schools in the feeder pattem that
falls within the City of Miami Beach, the Parties entered into a N1�morandum of
= Understanding an August 19, 2013 far a Nurse Initiative, and another Memorandum of
Understanding an April 23, 2014, to provide healthcare services to the Participating
Schoola dunng the 2013J2014 and the 2014/2015 Schaol 1�ears; and
WNEREAS, due to the success of Nurse Initiatives during the 7013/2014 and
2014/2015 Schaol Years, the Parties impiemented an enhanced nurse iniflative ("Nurse
Enhancer►�er�t Initiative") for tt�e 2015l2016, 201612017, and the 2017/2018 School
Yea� for tF�e Participating Schoois because the basic healthcare services previousiy
f��ded in ttte Nurse Initiative by the Participating Municipalities, the Miami Beach
Chamber Education Foundation, Inc., and the Chi�ren's Trust, were provided by the
Children's Trust via the netiv School Heatth Programs, and
WHEREAS, the Nurse Enhancement I�itiative established at the Participating
Schools for School Ye�rs 2015J2016, 2016l2017, and 2017/2018 was a success and
the Parties wish to provide for anather nurse enhancement initiative for the 2016/2019

WHEREA3, a Nurse Enhancement Inidetive should be established at the
Participating Schools far Schoo! Year 2018I2019 as herein provided a�d pursuant to a
separate agreement to be entered into between MBCEF and TCT.
NOW, TNEREFORE, in cansideration of the mutual terms, conditions, promises,
covenar�ts, and payments heref�after set fa�th, the Parties agree to provide for a Nurse
Enhanr.ement initiative for the Pa�ticipating Schaols dunng the 201$/2019 School Year
as fallows:
1. MBCEF shail enter into an agreement with TC7 whereby TCT shafl prvvitle
services for behavioral hea(th and TCT sha(i provide certain schedules and
reports as fallows�
a) A morathty report of senrices provided at each of the ParticipaUnq
Schaola shail be provided to the Participating Schools and to MBCEF;
�nd
b} A monthly and an annual report shaN be provided to the Partkipating
AAunicipalitles and to MBCEF documenting the percent of students
retuming to class after all visits relative to the above services at the
Partictpating Schools.
2. On or before Novembe� 10, 2018, MBCEF shall prov�de funding to TCT for
the 2018/2019 Nurse Enhancement initiative in the amount of$7,000
3. On of before O�tober 31, 2Q18, the Participatin� Municipatitivs shall
provide their propo�tionate sha�e of funds for the 2018/2019 Nurse
Enhancement Initiative to MBCEf, sub�ect to budget approval by tt�e
Partfcipati�q Municlpslitisa, which funds MBCEF shall hold in escrow
pentling the execution of its agreament w"rfh TC� referenced in psragraph 1.
The Particip�tinq Municipalities' proportionate remaining share of fundi�g
for the 2018/2o i 9 Schooi Year shall be paid by Octaber 31, 2018 in the
fatbwing amaurrts:
i)CMB shali provide fundin� in the amou�of$15.400.00:
ii) NBV shall prov�e funding in the amaunt of$6.800.00;
iii) TBHI shall provide funcii�g ir�the amount af$3,687.Q0;
iv) TS shall provide funding in the amount of$3,667.Q0;
v} 8HV shall provide funding in the amount of$3,667.00;
4. MBCEF �hatl serve as the flscal agent b collect the funds to be paid as
provided m paragraph 3 abave and shall disperse such funds to TCT after

entering into the agresment with TCT refer�rnced in parag�aph 1 and upo�
receipt of invoices from TCT
5. MBCEF shaU indemnify and hald harmiess !he Participating Mu�icipalitles
and'their respective officets empbyees, agents ar►d instrumentalities from
any and all iiability, �sses, or dam�ges, inciuding attorneys' fees and costs o(
defense, v►fiich the Participatinfl Municipaliti� or tt�eir ofiicers, empbyees
agents or instrumentalit�es may incur as a result of claims, demands, su�ts.
causes ot actians or proceedings of any kinti ar nature ansinQ out of, relating
to, or resu�ing from the performance af this MOU by MBCEF o� its
employees. agents, servants, partners. principa�s, or subcontraetors MBCEF
shall pay claims and iasses in eonnection therewith and shall investigate and
defend all ciaims suits �r actions of any kind o� nature in the name of the
Participatin� Municipatiti�a, whQre applicabi�, including appeilate
proceedings, anci shall pay all costs, judgemertts, and atmmey's fees which
may issue thereon
6. In the event that one or more of ihe P�rtkipatinq MunicipaliUes �s nnt able
b secure funds for their respective proportionate share of funding as provided
in paragraph 3, the� the remain�ng cantributmg Pa�ticipaNng Municipalitiss
may, in coortiination with the M9CEF agree in writing to adjust the services to
be provided through the Nurse Enhancement Init�etive.
7 In the event that any of tha provisions in th�s MOU are not perf�rmed. or if the
2018/2019 Nurse Enhancement tnitistive is terminated aftar fur�ds have been
dispersed to MBCEF as provided �n pafagraphs 3 and 4, then MBCEF shall
promptly r�imburse each of the ParticipatM9 Municipallties their
p�oportionate share nf urwsed funds tf any �ambination or a!t of the
Participadn� Municipalki�s agree to in�plem�nt a Nurse Enhancement
Initiative fo�the 2019/2020 School Year, then MBCEF inay, as directed by tt�e
Part�cipating MuniGpaGties ►rr wnting, twld any unused iunds in escrow to be
applied tawa�d the 2419/2020 Nurse Enhancement Initiative. Any unused
funds shall be credited toward each of the Pa�ticipstln+a Muntclpallti�s'

This Amendment No. 8 (the "AmendmenY') is made and entered into this day of

corporation organized and existing under the laws of the State of Florida, having its pr�ncipal place
of business at 1700 Convention Center Drive, Miamf Beach, Florida 33139; North Bay Village

having its principal place of business at 1666 John F. Kennedy Causeway, #3, North Bay Village,
Florida 33141; the Town of Bay Harbor Islands ("TBHf'), a municipal corporation organ�zed and

RECITALS
WHEREAS, the Parties have determined that a program to provide healthcare services to
students attending underserviced public schools is in the best interests of the health and public
weifare of CMB, NBV, TBHI, TS and BHV (individually and/or collectively, the "Participating
Municipalities");
WHEREAS, following the Parties' determination that students at Miami Beach North
Beach Elementary, Treasure Island Elementary, and Ruth K. Broad Bay Harbor K-8 Center
(individualiy and/or collectively, the "Participating Schools") did not have full-time on-site
healthcare services and were, thus, underserved as compared to other public schools in the
feeder pattern that falls within the City of Miami Beach, the Parties entered into a Memorandum
of Understanding on August 19, 2013 for a Nurse Initiative, and another Memorandum of
Understanding on April 23, 2014, to provide healthcare services to the Participating Schools
during the 2013/2014 and the 2014l2015 School Years;

WHEREAS, on May 17, 2018, each of the Participating Municipalities and MBCEF
executed the MOU for the continuation of the Nurse Enhancement Initiative for the Participating
Schools for the 2018-2019 School Year;
WHEREAS, the Parties executed Amendment No. 1 to the MOU, dated December 24,
2018, adding an additional day of service at Ruth K. Broad Bay Harbor K-8 Center;
WHEREAS, on September 11, 2019, the Mayor and City Commission adopted Resolution
No. 2019-30956, approving Amendment No. 2 to the MOU and approving funding of CMB's
contribution for each subsequent School Year, on a recurring basis, subject to funding approval
during CMB's budgetary process and provided that CMB's contribution amount does not exceed
515,400 00;
WHEREAS, the Parties have extended the Nurse Enhancement Initiative for the
Participating Schaols thraugh a series of amendments: (a) Amendment No. 2, dated as of
September 19, 2019, for the 2019-2020 School Year, (b) Amendment No. 3, dated as of August
19, 2020, for the 2020-2021 School Year, (c) Amendment No. 4, dated as of July 21, 2021, for
the 2021-2022 School Year, (d)Amendment No. 5, dated July 26, 2022, for the 2022-2023 School
Year, (e) Amendment No. 6, dated July 28, 2023, for the 2023-2024 School Year, and (�
Amendment No. 7, dated as of July 10, 2024, for the 2024-2025 Schoal Year;
WHEREAS, due to the continued success of the Nurse Enhancement In�tiative services,
the Parties wish to provide the Nurse Enhancement Initiative for the 2025-2026 School Year;
WHEREAS, a Nurse Enhancement Initiative should be established at the Participating
Schaols for School Year 2025-2026 as herein provided and pursuant to a separate agreement
between MBCEF and TCT; and
WNEREAS, MBCEF shall provide funding to TCT for the 2025-2026 Nurse Enhancement
Initiative in the amount of 58,750.00.
NOW, THEREFORE, in consideration of the mutual promises and conditions contained
herein, and� other good and valuable consideration, the sufficiency of which is hereby
acknouvledged, the Pa�ties agree to amend the MOU as follows:
1. ABOVE RECITALS. The above recitals are true and correct and are incorporated as
part of th�s Amendment.
2. MODIFICATIONS. The MOU is hereby amended (deleted items st��edg#� and
inseRed items underiined) as follows:
(a) Paragraph 3 of the MOU is hereby amAnded to read as follows:
On or before October 31, 2025, the Participating Municipalities shall provide
their proportionate share of the funds for the '�'��2025-2026 Nurse Enhancement Initiative
to MBCEF, subject to budget approval by the Participating Municipalities, which funds MBCEF
shall hold in escrow pending the execution of its agreement with TCT, referenced in paragraph 1
of the MOU. The Participating Municipalities' proportionate share of funding for the '�'�'�
2025-2026 Schaol Year shall be paid by , October 31, 2025, in the follawing

amounts for 44 weeks, from 9�iebe�-�, 2�2 October 1. 2025 to June 5, 2026
and , , August 1, 2026 to September 30, 2026:
i) CMB shali provide funding in the amount of$19,250;
ii) NBV shall provide funding in the amount of $8,250;
iii) TBHI shall provide funding in the amaunt of $10,140 for 2 days of service at
Ruth K. Broad Bay Harbor K-8 Center;
iv) TS shail provide funding in the amount of$10,140 for 2 days of service at Ruth
K. Broad Bay Harbor K-8 Center; and
v) BHV sha44 provide funding in the amount of $10,140 for 2 days of service at
Ruth K. Broad Bay Harbor K-8 Center.
(b) The follawing Paragraphs 8-11 are hereby added to the Agreement:
$. MBCEF aqrees to comply with Section 787.06, Florida Statutes, as mav be amended from time
to time, and has executed the Anti-Human Traffickinc] Affidavit, containinq the certification of
compliance with anti-human traffickinq laws,�as required bv Section 787.06(13), Florida Statutes,
a copv of which is attached hereto as Exhibit "A".
9. MBCEF warrants and represents that it is not currently engaqed in, and will not engage in, a
bovcott, as defined in Section 2-375 of the City Code. In accordance with Section 2-375.1(2)(a)
of the City Code, MBCEF herebvi certifies that MBCEF is not currently enqaged in, and for the
duration of the Aqreement, will not enqaQe in a bovcott of Israel.
10. MBCEF warrants and represents that, within two(2�vears prior to the Effective Date, MBCEF
has not received compensation for services performed for a candidate for City eiected office, as
contemplated by the prohibitions and exceptions of Section 2-379 af the City Code.
For the avoidance of doubt, the restrictions on contractinq with the City pursuant to Section_2-
379 of the Citv Code shall not applv to the fo!lowinq:
(a) Any individual or entity that provides goods to a candidate for office.
{b) Any individual or entitv that provides services to a candidate for office if those same
services are reqular4v performed by the individual or entity in the ordinary course of
business for clients or customers other than candidates for office. This includes, without
limitation, banks, telephone or ;nternet service qroviders, printing comqanies, event
venues, restaurants, caterers, transportation providers, and o�ce supplv vendors.
(c) Anv individual or entitv which performs licensed professional services (including for
example, leqal or accountinq services�.
11. MBCEF herebv aQrees to comply with Section 287.138, Florida Statutes, as mav be
amended from time to time, which states that as of January 1, 2024, a governmental entity mav
not accept a bid on, a proposal for, or a reply to, or enter into, a contract with an entitv which
would qrant the entitv access to an individual's personal identifyinq fnformation (P11), unless the
entitv provides the governmental entitv with an affidavit siqned bv an officer or representative of
the entitv under penalt of perjury attestinq that the entity does not meet any of the criteria in
Paraqraphs 2(al-�c) of Section 287.138, Flonda Statutes: (a) the entity is owned bv a
qovemment of a foreiqn country of concern; (b) the qovernment of a foreiqn country of concern
has a contro{linq interest in the entity; or (c1 the entitv is orqanized under the laws of or has its
principal place of business in a foreiqn country of concern (each a "Prohibited Entity"). A
foreiqn country of concern is defined in Section 287.138 t 1){c�, Flonda Statutes, as mav be

amended from time to time, as the People's Republic of China, the Russian Federation, the
Islamic Republic of Iran, the Democratic People's Republic of Korea, the Republic of Cuba, the

anv other entitv of siqnificant control of such foreian countnr of concern. Additionallv, beqinninq
July 1, 2025� a governmental entity may not exter� or renew a contract with a Prohibited EntitY�
MBCEF warrants and represents that it does not fall within the definition of a Prohibited Entitv,
and as such, has caused an authorized representative of MBCEF to execute the "Prohibition
�Aqainst Contractinq with Entities of Foreiqn Countnes of Concern AffidaviY', incorc�orafed herein
bv reference and attached hereto as Exhibit "B".
(c) Exhibit "A" attached hereto is hereby attached to the Agreement.
(d) Exhibit "B" attached hereto is hereby attached to the Agreement.
3. RATIFICATION. Except as amended herein, all other terms and conditions of the
MOU shall remain in full force and effect. In the event there is a conflict between the
provisions of this Amendment and the MOU, the provisions of this Amendment shall
govem.
