Resolution 2025-33877 2025-33877 RESOLUTION NO. A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING AS A 2026 STATE LEGISLATIVE PRIORITY THE AUTHORIZATION OF LOCAL GOVERNMENTS TO EXERCISE GREATER CONTROL OVER THE REGULATION OF VACATION RENTALS TO ADDRESS WORKFORCE AND AFFORDABLE HOUSING SHORTAGES. WHEREAS, the City of Miami Beach is experiencing workforce and affordable housing shortages, which adversely affect the local economy and the quality of life for residents; and WHEREAS, the State of Florida is also facing a broader housing crisis, with increasing demand and limited supply driving up housing costs and making it difficult for many residents to find affordable housing; and WHEREAS, Section 509.032(7)(b), Florida Statutes, currently preempts local governments from banning vacation rentals or regulating their duration or frequency, thereby limiting the ability of local governments to address the unique housing challenges within their communities; and WHEREAS, vacation rentals, also known as short-term rentals ("STRs"), can exacerbate housing shortages by reducing the availability of long-term rental units and driving up rental prices; and WHEREAS, granting local governments greater control over the regulation of STRs would enable them to implement policies tailored to their specific housing needs and conditions, thereby helping to alleviate workforce and affordable housing shortages; and WHEREAS, the City of Miami Beach recognizes the importance of balancing the interests of property owners, vacation rental operators, and the broader community in addressing housing challenges. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby adopts as a 2026 state legislative priority the authorization of local governments to exercise greater control over the regulation of vacation rentals to address workforce and affordable housing shortages.
