OF MIAMI BEACH, FLORIDA, CONSIDERING AND APPROVING FOR
REMITTANCE TO THE FLORIDA DEPARTMENT OF HIGHWAY SAFETY
AND MOTOR VEHICLES, AFTER PUBLIC HEARING AT THE SEPTEMBER
3, 2025, CITY COMMISSION MEETING,THE RESULTS AND INFORMATION
SET FORTH IN THE FISCAL YEAR 2024-2025 TRAFFIC INFRACTION
DETECTOR REPORT (ATTACHED AND INCORPORATED HEREIN AS
EXHIBIT "A"), TO INCLUDE THE WRITTEN SUMMARY CONTAINED
WITHIN THE REPORT WHICH WAS READ ALOUD IN CONJUNCTION WITH
THIS ITEM AT THE SEPTEMBER 3, 2025, MEETING, IN COMPLIANCE
WITH FLORIDA STATUTE §316.0083(4).
WHEREAS, the State of Florida, pursuant to Florida Statute §316.0083(4), requires each
county and municipality that operates a red-light camera system to submit an annual report
("Annual Report")to the Florida Department of Highway Safety and Motor Vehicles ("FLHSMV");
and
WHEREAS, the City of Miami Beach ("City"), by and through the Miami Beach Police
Department ("MBPD"), currently operates a red-light camera system; and
WHEREAS, since 2012, Florida Statute §316.0083(4) has mandated that certain red-light
camera system results and information be included within the Annual Report; and
WHEREAS, commencing in 2024, Florida Statute §316.0083(4) requires that the
governing body of the City consider and approve the Annual Report prior to submission; and
WHEREAS, the newly amended Florida Statute §316.0083(4) also requires that a public
hearing be provided, which allows interested members of the pubtic to comment regarding the
Annual Report, and that the meeting at which the Annual Report is considered/approved may not
be considered as part of the consent agenda; and
WHEREAS, Florida Statute §316.0083(4)further requires that the Annual Report contain
a written summary that is read aloud, and that the written summary contain, for the same time
period pertaining to the Annual Report, the number of notices of violation issued, the number that
were contested, the number that were upheld, the number that were dismissed, the number that
were issued as uniform traffic citations, the number that were paid, and how collected funds were
distributed and in what amounts; and
WHEREAS, in the City's Fiscal Year 2024-2025 Annual Report, for the time period from
July 1, 2024, to June 30, 2025, written summary sets forth that the City issued 7,838 notices of
violation, two (2) violations were contested, one (1) violation was upheld, two (2) violations were
dismissed, 2,597 violations were issued as uniform traffic citations, 3,861 violations were paid,
and collected Florida State funds were distributed in accordance with Florida Statute
§316.0083(4) in the amounts of$307,860.00 to the General Revenue Fund ($70.00 per violation),
$43,980.00 to the Health Emergency Medical Services Trust Fund ($10.00 per violation), and
$13,194.00 to the Brain and Spinal Cord Injury Trust Fund ($3.00 per violation); and
WHEREAS, the above written summary was read aloud at the regularly scheduled
September 3, 2025, City Commission meeting; and
WHEREAS, the Annual Report and signed Resolution will be provided to FLHSMV in
order to comply with the Florida statutory requirements.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby consider and approve for remittance to the Florida Department of Highway
Safety and Motor Vehicles, after public hearing at the September 3, 2025, City Commission
meeting, the results and information set forth in the Fiscal Year 2024-2025 Traffic Infraction
Detector Report(attached and incorporated herein as Exhibit"A"), to include the written summary
contained within the report that was read aloud in conjunction with this item at the September 3,
2025, meeting, in compliance with Florida Statute §316.0083(4).

(2) violations contested, one (1) violation upheld, two (2) violations dismissed, 2,597 violations issued as
uniform traffic citations, 3,861 violations paid, and where collected funds were distributed in accordance with
State Statute 316.0083(4) in the amounts of $307,860.00 to the General Revenue Fund ($70.00 per
violation), $43,980.00 to the Health Emergency Medical Services Trust Fund ($10.00 per violation), and
$13,194.00 to the Brain and Spinal Cord Injury Trust Fund ($3.00 per violation).

RECOMMENDATION
The Administration recommends the approval of the Tra�c Infraction Detector Report via
Resolution and the formal submission to the Florida Department of Highway Safety and Motor
Vehicles.
BACKGROUND/HISTORY
The official public record and approval of the Traffic Infraction Detector Report is a new request
from the Florida Department of Highway Safety and Motor Vehicles (FLHSMV). Beginning in
2024, the FLHSMV enacted the requirement for jurisdictions who participate in the Red-Light
Camera Program to present their official data at a regular or special meeting of their governing
body (city council, county commission, etc.) in order to add or renew cameras. The governing
body must approve the use of the cameras based on traffic data or other evidence supporting the
use of cameras in areas where needs for additional traffic safety measures are warranted.
The report required under Florida Statute §316.0083(4)(a), must include a written summary to be
read out loud at the regular or special meeting, and the summary must contain, for the same time
period pertaining to the annual report the number of notices of violation issued, the number that
were contested, the number that were upheld, the number that were dismissed, the number that
were issued as uniform traffic citations, and the number that were paid and how collected funds
were distributed and in what amourts.
ANALYSIS
For the period from July 1, 2024, to June 30, 2025, the City of Miami Beach recorded 7,838
notices of violation issued, two (2)violations contested, one (1)violation upheld, two(2) violations
dismissed, 2,597 violations issued as uniform traffic citations, and 3,861 violations paid. The
collected funds were distributed in accordance with Florida Statute §316.0083(4) in the amounts
of $307,860.00 to the General Revenue Fund ($70.00 per violation), $43,980.00 to the Health
Emergency Medical Services Trust Fund ($10.00 per violation), and $13,194.00 to the Brain and
Spinal Cord Injury Trust Fund ($3.00 per violation).

The signed Resolution which includes the above summary and report (Exhibit A) as attached will
be formally submitted to the FLHSMV in fulfilment of Florida Statute §316.0083(4)(a)2.
FISCAL IMPACT STATEMENT
The collected State funds were distributed in accordance with Florida Statute §316.0083(4) in the
amounts of$307,860.00 to the General Revenue Fund ($70.00 per violation), $43,980.00 to the
Health Emergency Medical Services Trust Fund ($10.00 per violation), and $13,194.00 to the
Brain and Spinal Cord Injury Trust Fund ($3.00 per violation).
CONCLUSION
The Administration recommends the approval of the Traffic Infraction Detector Report via
Resolution and that its dissemination to the Florida Department of Highway Safety and Motor
Vehicles through proper channels be authorized.
