A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, DIRECTING THE CITY ADMINISTRATION TO
CONDUCT A COMPREHENSIVE REVIEW OF THE CITY'S REGULATORY
FRAMEWORK AS IT AFFECTS SMALL BUSINESSES WITHIN 120 DAYS; TO
IDENTIFY ORDINANCES, RULES, AND PROCESSES THAT ARE UNDULY
BURDENSOME—INCLUDING THOSE GOVERNING PERMITTING, BUSINESS
TAX RECEIPTS, ENVIRONMENTAL REVIEW, AND ONGOING
OPERATIONS—AND TO RETURN TO THE MAYOR AND CITY COMMISSION
WITH RECOMMENDED REFORMS THAT REDUCE COST, TIME, AND
COMPLEXITY WHILE MAINTAINING PUBLIC SAFETY AND COMPLIANCE
WITH STATE AND COUNTY LAW; AND TO PRESENT A STATUS REPORT AT
THE SEPTEMBER 3, 2025 CITY COMMISSION MEETING.
WHEREAS, small businesses constitute the backbone of the City of Miami Beach's
economy, representing a majority of storefronts and service providers; and
WHEREAS, many local entrepreneurs report that the cumulative effect of City, County,
and State regulations—spanning zoning approvals, building permits, Business Tax Receipts,
environmental (DERM) clearances, and recurring operational requirements—creates significant
barriers to opening and sustaining a business; and
WHEREAS, although Code Compliance diligently and faithfully enforces the rules, many
of the ordinances on the books—long-layered, redundant, or simply outdated—impose
disproportionate hardship on small businesses with limited administrative resources; and
WHEREAS, the Mayor and City Commission are committed to fostering an environment
in which small businesses can thrive without unnecessary procedural or financial burdens, while
still ensuring public safety, environmental stewardship, and neighborhood quality of life; and
WHEREAS, a data-driven review—conducted in partnership with affected stakeholders—
will enable the City to modernize its regulatory framework, streamline internal processes, reduce
compliance costs, and enhance Miami Beach's overall economic resilience; and
WHEREAS, the Administration is hereby directed to undertake, within one hundred
twenty (120) days, a comprehensive review of the City's ordinances, administrative rules, and
inter-agency processes that govern (a) opening a business, (b) obtaining and renewing required
licenses and permits, and (c) day-to-day operations, with a specific focus on impacts to small
businesses; and
WHEREAS, the review shall evaluate redundancies, outdated provisions, conflicting
requirements, and processing timelines involving, but not limited to, Planning, Building, Fire,
Code Compliance, Finance (Business Tax Receipt), and Public Works; and
WHEREAS, the Administration should be prepared to present a status report to the
Commission at its September 3, 2025 meeting; and
WHEREAS, at the conclusion of the 120 day period, the City Manager then shall present
to the Mayor and City Commission a report containing (a) findings, (b) recommended repeals or
amendments to City ordinances, (c) proposed administrative or technological improvements, and
(d) estimated fiscal impacts with Letter-to-Commission.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby direct the City Administration to conduct a comprehensive review of the City's
regulatory framework as it affects small businesses within 120 days; to identify ordinances, rules,
and processes that are unduly burdensome—including those governing permitting, Business Tax
Receipts, environmental review, and ongoing operations—and to return to the Mayor and City
Commission with recommended reforms that reduce cost, time, and complexity while maintaining
public safety and compliance with State and County law; and to present a status report at the
September 3, 2025 City Commission meeting.
