MIAMI BEACH, FLORIDA, ADOPTING THE CITY OF MIAMI BEACH OCEAN
DRIVE SIDEWALK CAFE DESIGN GUIDELINES.
RECOMMENDATION
The Administration recommends that the City Commission adopt the resolution.
ANALYSIS
ln May, 2A15, Mayor Levine appointed the Ocean Drive Task Force. The purpose of the Task
Force was to review conditions on Ocean Drive and make recommendations to the Mayor and
City Commission regarding improvements to enhance the experience of those urtro visit Ocean
Drive.
The Task Force set a goal of preparing recommendations that would aid in making Ocean Drive
a better experience for visitors, as well as a place that residents wculd be comfortable visiting
and retuming regularly. ln addition, the Task Force sought to do this while keeping in mind the
ongoing concems of Ocean Drive business operators and their needs,
The Task Force met a total of ten (10) times between June 2015 and November 2015 to
discuss relevant issues, as well as meet with experts, residents, business owners, property
owners, and City officials. The Task Force discussed a number of issues including, but not
limited to, the following:
. Sidewalk caf6s;
. Lummus Park activation;
. Visibility of police officers;
. Noise in the area;
. The dimensions of the sidewalks;
. Appropriateness of City codes and compliance with the Code;
. lssues related to homeless in the area.
The issue pertaining to sidewalk caf6 conditions was of great importance to the task force and
the Chair created an "Umbrella and Appearance" Subcommittee. This sub-committee met a total

of six times to fully investigate issues such as umbrella design, common code compliance
issues, sidewalk caf6 fumiture, as well as the interaction between pedestrians and sidewalk
caf6s, and the available space for each. The sub-committee made recommendations to the full
Task Force that were discussed and became the basis for many of the recommendations in the
Task Force's final repod.
On January 13, 2016, the Final Report of the Mayor's Ocean Drive Task Force, including
recommendations for consideration, was presented to the Mayor and City Commission. The
Commission refened further discussion of the recommendations of the task force to the Land
Use and Development Committee and requested that the Committee present its findings to the
City Commission by March 9, 2016.
On February 3, 2016, the Land Use and Development Committee (LUDC) discussed the Final
Report of the Mayor's Ocean Drive Task Force and transmitted a favorable recommendation for
most of the Ocean Drive Task Force proposals to the full Commission. These
recommendations include the transfer of aesthetic review of sidewalk caf6 permits to the
Planning Department and development of a City-specified low profile umbrella design. On
March 9,2016, the Mayor and City Commission accepted the recommendation of the LUDC.
At the July 20, 2016 City Commission meeting, Commissioner Aniola was asked to work with
the Ocean Drive businesses and other stakeholders to negotiate a comprehensive proposal for
improvements to Ocean Drive. Aten point plan evolved from these discussions.
On October 12,2016, the Ocean Drive Task Force reviewed and recommended the adoption of
the attached 10 Point Plan prepared by CommissionerArriola in conjunction Wth several Ocean
Drive hotel and restaurant owners. The 10 Point Plan includes recommendations for the
following:
. Removalof the "gauntlet' along Ocean Drive
. Significant reduction in music and loud noise
. lncreased safety measures, including the installation of lights along the alleys on Ocean Court
. Restricting/prohibiting ceftain types of businesses on Ocean Drive and the MXE District
. lncreased Police and security presence
. The creation of an Ocean Drive BID (Business lmprovement District), among other measures.

On September 27,2016, the Mayor and City Commission accepted the recommendation of the
Ocean Drive Task Force regarding the 10 Point Plan.
HISTORIC PRESERVATION BOARD REVI EW
On July 12,2A16, the Historic Preservation Board reviewed a draft of the Ocean Drive Sidewalk
Caf6 Design Guidelines prepared by the Planning Department and recommended further
development of umbrella and fumiture criteria to include more varied shapes, sizes and types.
The Board also recommended that the City Commission explore possible amendments to the
Sidewalk Cafe Ordinance to allowfor greater flexibility with regard to permitted planter materials
and the ability to zip umbrellas together.

On August 9,2016, the Historic Preservation Board reviewed a revised draft of the Ocean Drive
Design Guidelines and approved a motion which included the following recommendations:
1. Existing street fumiture, such as signage and parking pay stations, should be moved from the
eastern portion of the west sidewalk to the east sidewalk.
2. The existing palm trees that are planted in front of the buildings should be removed, and the
palm trees located within the building setbacks should remain.
3. Allowforthe maximum umbrella and table size within the permitted sidewalk caf6 area.
4. Shift of sidewalk caf6 seating area to the urest portion of the sidewalk, allow for sidewalk caf6
seating to be placed on the east podion of the sidewalk to be reviewed on a case-by-case basis
and not allow the split seating plan that cunently exists for many cafes.
5. Street lighting should be implemented as a lighting master plan for the entire length of Ocean
Drive.
6. Seating should be limited to chairs that allow only one person; upholstered chairs, benches,
booths, sofas should not be permitted.
7. An Amendment to Section 82-366 of the City Code to allow for'misters'during certain times
of the year, in addition to the cunently permitted heaters and fans.
Attached is a copy of the Ocean Drive Sidewalk Caf6 Design Guidelines, as revised in
accordance with the recommendations contained within the 10 Point Plan for Ocean Drive. The
'10 Point Plan recommends the adoption of the Ocean Drive Sidewalk Cafe Design Guidelines
in accordance with the recommendations of the Historic Preservation Board at its August 9,
2016 meeting, and amended to include the following:
1. To the extent that moving furniture to the west would not be feasible due to the layout of a
particular property or related factors, furniture will not be required to be located on the westem
portion of the sidewalk as long as an altemate plan for the seating area is approved by the
Planning Department.
2. Certain existing trees that are in conflict with an unobstructed 5'-0" pedestrian path shall be
relocated and the City shall fill the tree pits with concrete to match the sidewalk.
3. The width of umbrellas and awnings shall be the width of the west sidewalk minus 5'-0". The
west sidewalk is general 14'-6" in width, resulting in a maximum umbrella width of 9'-6".
4. The maximum height of the umbrellas shall be 9'-0".
5. Tables shall be the width of the west sidevualk minus 7'-0". The west sidewalk is general 14'-
6" in width resulting in a maximum table width of 7'-6".
6. Stronger illumination shall be allowed within the sidewalk caf6 seating area.
7. Sidewalk caf6 umbrellas shall be allowed to be bolted or similarly attached to the sidewalk.
8. Umbrellas shall be allowed to be zipped togetherwith gutters.
9. Umbrellas shall be allowed to have rolldown transparent tarps to be utilized during rain or
wind events.
It is important to note that amendments to the Sidewalk Caf6 Ordinance (Chapter 82 of the City
Code) will be required in orderto implement recommendations 7 through 9. Additionally, in order
to maintain a 5'-0" unobstructed pedestrian path along the eastem portion of the sidewalk the
following elements will need to be addressed:

2. Valet stands
3. Parking pay meter stations
4. Future street lighting
CONGLUSION
The Administration recommends the following:
1. The City Commission adopt the Resolution and the attached Ocean Drive Sidewalk Caf6
Design Guidelines, as prepared and revised by the Planning Department.
2. The Commission direct the City Manager and the City Attomey to draft all necessary
amendments to Chapter 82 of the City Code, as it pertains to sidewalk caf6 umbrellas.

GUIDELINES.
WHEREAS, the Mayor and City Commission accepted the recommendations
contained within the Final Report of the Mayor's Ocean Drive Task Force including the
transfer of aesthetic review of sidewalk caf6 furnishings to the Planning Department and
the development of a City specified low profile umbrella design; and
WHEREAS, Ocean Drive is a unique, historic and highly significant promenade
containing hotels, restaurants and retail establishments, which serve tourists and
residents alike; and
WHEREAS, the Ocean Drive Sidewalk Cafe Design Guidelines offer design
standards that will create a more balanced approach that will accommodate sidewalk
caf6 seating, pedestrian circulation and services; and
WHEREAS, the need to maintain a careful balance between the operational
needs of businesses and the architectural character and integrity of the streetscape is
critical for the long term success of Ocean Drive; and
WHEREAS, the design standards contained within the Ocean Drive Sidewalk
Caf6 Design Guidelines will improve pedestrian safety, security and ADA access
serving the health, safety, and welfare of the City's residents and visitors.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby adopt the attached City of Miami Beach Ocean Drive Sidewalk
Cafe Design Guidelines.

BACKGROUND
ln 2003 - 2004, the Miami-Dade Metropolitan Planning Organization (MPO) prepared
environmental and engineering studies as part of the Bay Link (Miami - Miami Beach
Corridor Transportation Study). The Draft Environmental lmpact Statement (DEIS) for
the Bay Link Study recommended a light rail transiVmodern streetcar system powered
by overhead catenary wires to connect Miami Beach and Miami via dedicated right-of-
way along the MacArthur Causeway.
ln October 2013, pursuant to requests from the cities of Miami Beach and Miami, the
MPO commenced a planning-level study that refreshed and updated the decade-old Bay
Link study in partnership with Miami-Dade Transit (MDT), Florida Department of
Transportation (FDOT), and the cities of Miami Beach and Miami, entitled the Beach
Corridor Transit Connection Study (the "MPO Study'').
The MPO Study was compleled in June 2015 and reaffirmed the MacArthur Causeway
as the preferred alignment to connect Miami Beach and Miami. The MPO Study
recommended an off-wire or "wireless" light rail transiVmodern streetcar system for the
portion within each urban area as the preferred vehicle technology for propulsion, as well
as the use of exclusive lanes for the transit vehicles to provide reliable service.
Phase 1 of the recommended route alignment within the South Beach portion of Miami
Beach consists initially of 5'n Street and Washington Avenue Corridors to provide a direct
connection to the Miami Beach Convention Center (the "Direct Connect Projecf'). The
MPO Study recommended a second phase of the Beach Corridor Transit Connection
Project that includes an alignment along Alton Road and 17th Street, operating as a local
route solely within Miami Beach and complernenting the initial regional cross-bay route
to Downtown Miami. The light rail system is proposed to operate on exclusive rights-of-
way and travel lanes and not in mixed traffic to provide efficient and reliable mass transit
service.

The Policy Executive Commitlee (PEC), a committee created to, among other things,
give direction for the development of the Beach Corridor Transit Connection Project, and
comprised of elected officials lrom Miami-Dade County, the City of Miarni Beach, and the
City of Miarni, endorsed moving forward with the Direct Connect Project on an expedited
basis, via a public-private partnership (P3) delivery method and endorsed expediting the
Miami Beach and Miami portions of the project (to the extent that this does not impact
the rest ol the project). The P3 method of delivery was recommended as a means to
shift technology and design risk, and to shorten the proposed project delivery schedule.
ln June 2015, pursuantto Section 287.05712 of the Florida Statutes, the City received
an Unsolicited Proposal from Greater Miami Tramlink Partners, a consortium, for a P3
project with the City to implement an off-wire light rail transiUmodern streetcar systern in
South Beach based on the conceptualalignment in the 2015 MPO study.
On December 9,2015, the City Commission adopted Resolution No.2015-29236,
approving an Agreement with Kimley-Horn for preparation of an environmental analysis
for the South Beach component of the Beach Corridor Transit Connection project. The
Kimley-Horn scope of work for the Miami Beach Light Rail/Modern Streetcar Project
("Project") includes development of the project funding plan.
ln July 2016, Miami-Dade County, the City of Miami Beach, the City of Miami, and the
Florida Department of Transportation entered into a Memorandum of Understanding
(MOU) for moving the project forward while expediting the Miami Beach project.
The MOU reflects the FTA (Federal Transit Administration) New Starts Program's
accelerated delivery process {or the Direct Connect Project in compliance with NEPA
standards. The NEPA phase of the Direct Connect Project is anticipated to take 2 years
and cost approximately $t O Million with funding from the following agencies: FDOT - $5
Million; Citizens' lndependent Transportation Trust (CITT) - $3.75 Million; Miami-Dade
County - $417,000; and Miami and Miami Beach - $417,000 each.

To further advance this process, in July 2016, the MPO amended the Miami-Dade
County 2040 Long Range Transportation Plan (LRTP) to advance the Beach Corridor
Transit Connection project (formerly Baylink) to a Priority 1 Funded Project in the LRTP
for project development.
Once the NEPA document is completed, Miami-Dade County would apply for lederal
funding under the federal accelerated project delivery approach such that the project can
enter the design/build phase in advance of receiving a Full Funding Grant Agreement
from FTA. Miami Beach is fully cooperating to advance the NEPA study for the
MacArthur Causeway connection as quickly as possible.
Parallel Procurement Process
On December 16,2015, the Mayor and Commission adopted Flesolution No.2015-
29247, accepting receipt of the unsolicited proposal, and authorizing the Administration
to solicit alternative proposals tor a P3 project, in accordance with Florida Statute
287.05712, for an off-wire or "wireless" light rail/modern streetcar system. As a result,
the City published a Public Notice in accordance with Florida Statute 287.05712 for
alternative proposals.
The scope of the Project includes a two-phased route alignment to provide full
circulator/loop within South Beach, with Phase 1 consisting of Sth Street and Washington
Avenue tothe Miami Beach Convention Center ("Phase 1") and Phase 2 consisting of
17rh Street and Alton Road, to Sth Street ("Phase 2") as a sample project area.
The scope of the Project, il ultimately approved by the Commission, contemplates a full
"turn-key" delivery approach that consists of and includes the design, construclion,
financing, operation, and maintenance of the Project, including vehicles and associated
power, Communications, signalization, and other systems required for the functiona'lity of
the Project ("Vehicle/Systems Technology"); operation and maintenance facilities,
related civil infrastructure, including "curb-to-curb" road reconstruclion, permitting, and
related services pertaining to the Project.
At the July 13, 2016 Commission meeting, the Mayor and Commission authorized the
Administration to enter into negotiations with the top ranked proposer, Greater Miami
Tramlink Partners (GMTP) for developrnent of an lnterim Agreement. Should
negotiations with the top ranked proposer not be successful, the Cornmission directed
the Administration to negotiate with the second ranked proposer, Connect Miami Beach.
The lnterim Agreement provides for commencement of development activities and the
process and timeline for obtaining fixed price for delivery of the Project and negotiating a
comprehensive agreement, subject to Commission decision to proceed to a
comprehensive agreement.
Negotiations between the City and GMTP for the lnterim Agreement are still underway.
MIAMI BEACH PROJECT STATUS
At the July '13, 2016 Commission meeting, the following concepts were presented
subject to additional review.
. Operation of the project as a bi-directional loop along 5h Street, Washington

Avenue, either 17th Street or Dade Boulevard, and along Alton Road with
operational headways of 6 to 7.5 minute frequency. Hours of operation are
anticipated to be between 5:30 am and 2:00 am.. Stops will be located approximately three (3) stops per mile, with full ADA
accessibility at every stop.. Stop amenities that blend into the overall streetscape.. Stop platforms between 120 and 180 feet in length with level boarding to all
vehicle doors.o f, Vehicle Storage Maintenance and Operating Facility (VSMOF) to
accommodate a fleet of 12-14 light rail/modern streetcar vehicles, vehicle
maintenance and storage, traction-power substation, Operations Control Center
(OCC), maintenance of parts and equipment, employee parking, and ancillary
operations facilities (equipment storage, etc,), to be located at the current Public
Works Yard site north of Dade Boulevard.
The Commission requested additional information regarding the Washington Avenue
alignment, as well as information on traffic impacts.
Cost and Fundino
Development of cost estimates continue to be refined as well as the associated potential
funding sources. The latest cost estimates are shown in the following table:
Potential funding sources for the capital costs of the project include:t 25o/" from Miami-Dade County. Up to 25o/" from the State. 50o/" from the City
The City has set aside $36 million in potenlial lunding for the project, and the FDOT
Secretary o{ Transportation has already committed to place 125% in the FDOT FY 2017
Work Program, subject to endorsement by the Miami-Dade Metropolitan Planning
Organization.
Operations costs would be funded by the City.

Proposed Phased lmplementation
Staff at this point is recomrnending that the continued study of the Project and the terms
being negotiated for the lnterim Agreement focus only on Phase I ol the Project with an
additional stop at Miami Beach Senior High School. The factors leading to this
recommendation include:
a. Significantly reduced capital and O&M costs
b. Eliminates need lo utilize funding sources like tolling or special assessments
c. Eliminates the need to do road work on Alton Road soon after the previous
roadway project was cornpleted
d. Consistent with the modest approaches taken in other cities
Further, in addition to working with Miami-Dade County to expedite the Downtown
Miami-MacArthur Causeway rail connection, we are also in discussion with Miami-Dade
County and FDOT for an interim solution with an "enhanced bus" type of service.

RESILIENCY NEEDS
ln addition to the project costs, the City, as part oi its resiliency program for sea-level
rise, intends to raise the level ol many streets, install pumps, and make other required
irnprovernents. As part of the Miami Beach Light Rail/Modern Streetcar Project, the
concessionaire would be responsible for all resiliency-related work at specified
geographical areas impacted by lhe alignment, with such areas to be determined by the
City during the interim agreement negotiations. Kimley Horn has recently conducted a
topographical survey that indicates that the current elevation of most of Washington
Avenue is at 3.7 NAVD. Public Works will complete its verification of this recent finding
by October 21. The funding for work related to Flesiliency compliance would be in
addition to the construction cost outlined previously, although it is intended that the work
will be performed by the concessionaire concurrent with lhe construction of the Miami
Beach Light Rail/Modern Streetcar Project. The scope of work would include:
. Raising elevation of 5th Street and segments of Washington Avenue (only as
needed) to minimum height of 3.7 NAVD at edge ol right-of-way wilh minimum
elevation of top of catch basins at or above 3.0 NAVD while maintaining a
standard pavernent cross-slope of 2.00%.. Relocating, upgrading ancl/or protecting underground utilities (water main,
sanitary sewer, and storrn sewer) within vicinity of the route.
The resiliency-related scope of work is estimated at an "order of magnitude" cost of $12 -
$15 million and is proposed to be funded from $14 miltion in Storm Water proceeds in
2018 and $11 million in 2014 Miami-Dade County lnterlocal Agreement funds to be
received in 2017.

CONCLUSION
The City anticipates information from the draft environmental study (draft technical
reports) will be made available to the public in mid-November to mid Decernber 2016.
The Draft environmental report will provide information to the Commission and
community on the proposed project's definition, potential benefits, impacts and proposed
mitigation, as well as probable costs. This Draft environmental document will be
available for public review approximately in February,2017. A Conceptual Engineering
Fleport will contain technical findings related to the proposed project, as an
accompaniment to the Draft Environmental lmpact Repoft.
