Resolution 2025-33928 RESOLUTION NO. 2025-33928 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DISCHARGING THE LAND USE AND SUSTAINABILfTY COMMITTEE AND PLANN{NG BOARD FROM CONSfDERATION OF THE CITY COMMISSION'S PRIOR REFERRAL, DATED SEPTEMBER 11, 2024, OF THE PROPOSED AMENDMENTS TO THE NONCONFORMING BUILDING PROVISIONS AND RM-1 DISTRICT REGULATIONS IN THE COMPREHENSIVE PLAN AND RESILIENCY CODE TO ALLOW INTRODUCTION OF ON- SITE PARKING AND RESIDEN7IAL USES WITHIN A NONCONFORMING HOTEL USE ON THE NORTH SIDE OF BELLE ISLE (THE "REFERRAL"), AND RESCINDING AND CONCLUDING THE REFERRAL. WHEREAS, on September 11, 2024, the Mayor and City Commission referred the following matter ta the Land Use and Sustainability Committee ("LUSC") and Pfanning Board: amendments to the nonconforming building provisions and RM-1 district regulations in the Comprehensive Plan and Resiliency Code to allow the introduction of on-site parking and residential uses within a nonconforming hotel use on the north side of Belle Isle (the "Referral"); and WHEREAS, the Mayor and City Commission now wish to discharge the LUSC and Planning Board from consideration of the Referral, and rescind and conclude the Referral; and WHEREAS, under§ 36 of Robert's Rules of Order, 12th ed., "[b]y means of the motion to Discharge a Committee from further consideration of a question or subject, the assembly can take the matter out of a committee's hands after referring it to the committee and before the committee has made a final report on it, and the assembly itself can consider it." NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby discharge the Land Use and Sustainability Committee and Planning Board from consideration of the City Commission's prior referral, dated September 11, 2024, of the proposed amendments to the nonconforming building provisions and RM-1 district regulations in the Comprehensive Plan and Resiliency Code to allow the introduction of on-site parking and residential uses within a nonconforming hotel use on the north side of Belle Isle; and rescind and conclude the Referral.
