FEBRUARY 11, 2018 (THE "EVENT"); WAIVING ALL SPECIAL
EVENT PERMIT FEES, AND PROVIDING FUNDING IN THE
AMOUNT OF $15,000.
WHEREAS, Footvolley is a growing international sport, created in Brazil,
combining soccer and beach volleyball; and
WHEREAS, Pro Footvolley Tour, LLC, a Florida for-profit limited liability
company ("Pro Footvolley"), previously hosted the successful 2017 South Beach
Footvolley Open (the "2017 Event") in Lummus Park, from July 27,2017 through July
30,2017, to coincide with the El Classico soccer match at Hard Rock Stadium, in order
to capitalize upon its media attention; and
WHEREAS, the 2017 Event was shown on National TV (belN SPORTS) both on
English and Spanish Networks. ln addition, the same 4-hours of programming was
broadcast on the following regional sports networks: Spectrum Sports (LA), Root Sports
NW (Seattle), Root Sports Pittsburgh, Root Sports SW (Houston), and Root Sports
Colorado; and
WHEREAS, in Latin America, the 2017 Event aired on ESPN; and
WHEREAS, Sergio Menezes, President of Pro Footvolley Tour, is willing to host
the 2018 World Footvolley Classic Event in North Beach and belN SPORTS, as well as
ESPN, have expressed their intent to broadcast the 2018 Event with 5 hours of
programming; and
WHEREAS, the 2018 World FootVolley Classic Event provides potential tourism
benefits to the City; and
WHEREAS, Pro Footvolley is requesting a waiver of relevant special event
application, permit, square footage, vehicle beach access, and police administrative
fees to hold its 2018 World Footvolley Classic Event in the City of Miami Beach, which
fees are estimated to be: $250.00 in application fees, $250.00 in permit fees, $1,500.00
in vehicle beach access passes, $5,216.25 in square footage fees, and $330.00 in
Police administrative fees (based upon the 2017 Event); and

WHEREAS, the City Manager is authorized to waive special event application,
permit, and vehicle access pass fees for not-for-profit applicants seeking such waivers,
and the City Commission can waive additional event special event fees, including
square footage fees, user fees, and police administrative fees; and
WHEREAS, Pro Footvolley is additionally requesting that the City provide a
$15,000 sponsorship to assist with the 2018 World Footvolley Classic Event costs.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve and authorize the waiver of special event fees, as set forth
herein, for the 2018 World Footvolley Classic Event to be held in the City of Miami
Beach February 9 to February 11,2018, subject to funding approval in the FY
201712018 City Budget, and authorize the City Manager to execute a sponsorship
agreement with Pro Footvolley Tour, LLC, in a form acceptable to the City Manager and
City Attorney, in an amount not to exceed $15,000.

WHEREAS, bullying creates a climate of fear and disrespect that can seriously
impair the physical and psychological well-being of its victims, creating conditions that
negatively affect learning, thereby undermining the ability of students to achieve their
full potential; and
WHEREAS, in 2013, Commissioner Michael Gongora championed a partnership
between the City of Miami Beach, Miami-Dade Public Schools, and the Anti-Defamation
League to implement a citywide anti-bullying program in the 2013-14 School Year
entitled "No Place for Hate," which resulted in the designation of the City of Miami
Beach as a Community of Respect by the Anti-Defamation League; and
WHEREAS, pursuant to Resolution No. 2017-29731, adopted by the City
Commission in February 2017, the City of Miami Beach again partnered with Miami-
Dade Public Schools and the Anti-Defamation League to implement the "No Place for
Hate" anti-bullying program in all six Miami Beach public schools to continue to address
bullying prevention and to foster a safe and respectful school environment where youth
can flourish and learn; and
WHEREAS, bullying has become the subject of local, state, and national
concern, resulting in an increased focus on prevention in Florida schools through
policies that permit students to transfer to other schools to ensure a safe environment
for students; and
WHEREAS, at its meeting on June 13, 2017, the LGBTQ committee
unanimously approved a motion recommending that a task force be created and
charged with ensuring that all youth-including at-risk LGBTQ youth-are protected
from bullying (in policies that prohibit bullying on the express basis of sexual orientation
and gender identity) in all City services, City-supported services, and City facilities; and

WHEREAS, in the 2017 Municipal Equality lndex (MEl), the City of Miami Beach
received a score of 100 from the Human Rights Campaign Foundation in its annual
national evaluation of municipal laws which rates municipalities on such areas as non-
discrimination laws, municipal employer benefits and policies, municipal services, law
enforcement, and relationships with the LGBTQ community; and
WHEREAS, in order to continue to maintain the City's strong commitment to anti-
bullying and anti-discrimination policies and programs, an Ad Hoc Anti-Bullying Task
Force ("Task Force") should be created to ensure that all youth, including-at-risk
LGBTQ youth, are protected from bullying (in policies that prohibit bullying on the
express basis of sexual orientation and gender identity) in all City services, City-
supported services, and City facilities; and
WHEREAS, the duties of the Task Force shall be to provide ideas and
recommendations to the Mayor and City Commission for the development of anti-
bullying policies and laws to protect youth from bullying in all City services, City-
supported seryices, and City facilities; the Task Force shall be composed of seven (7)
members who shall be direct appointments by the Mayor and City Commissioners and
shall report to and receive direction and input from the Mayor and City Commission;
and, theterms of membership on the Task Force shall begin on January 1,2018 and
expire on January 1,2019 (subject to earlier or later sunset by the City Commission).
NOW, THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEAGH, FLORIDA, that the Mayor and City
Commission hereby accept the recommendation of the LGBTQ Advisory Committee
and hereby create an Ad Hoc Anti-Bullying Task Force, whose members shall have the
duty to provide ideas and recommendations to the Mayor and City Commission for the
development of anti-bullying policies and laws to protect all youth from bullying (in
policies that prohibit bullying on the express basis of sexual orientation and gender
identity) in all City services, City-supporled services, and City facilities and shall report
to and receive direction from the Mayor and City Commission, and which shall be
composed of seven (7) members who shall be direct appointments by the Mayor and
City Commission with terms of membership to begin on January 1,2018 and to expire
on January 1, 2019 (subject to earlier or later sunset by the City Commission).

ADMI NISTRATION RECOMMEN DATION
The Administration recommends that the City Commission approve the subject
Ordinance at First Reading and set a Second Reading Public Hearing for February _,
2018.
H!STORY
On June 27, 2017, the Planning Board reviewed a companion ordinance pertaining to
NCD development regulations.
On July 25, 2017, the Planning Board discussed the item and continued it to the
September 26, 2017 meeting. On September 26, 2017, the Planning Board discussed
the item and continued it to the October 24,2017 meeting. On October 24,2017 the
Board continued the item to November 21,2017.
PLANNING ANALYSIS
The "Normandy lsles National Register District" was listed on the National Register of
Historic Place on November 12, 2008. This district is generally bounded by Biscayne
Bay to the south, Ray Street, Rue Notre Dame and Rue Versailles to the west,
Normandy Shores Golf Course to the north, and the western bulkhead of lndian Creek to

the east.
The "North Shore National Register District" was listed on the National Register of
Historic Places on November 18, 2009. This district is generally bounded by 73rd Street
to the south, Dickens Avenue, HaMhorne Avenue and Crespi Boulevard to the west,
87th Street to the north, and Collins Court to the east.
Each of these National Register Districts has a designation report, which contains
detailed information and data on the history, architecture and building types in the
district. Additionally, a comprehensive local historic district designation report, for the
local district boundaries authorized by the City Commission, is being prepared by
Planning Department staff.
On October 19,2016, the City Commission approved the North Beach Master Plan. The
Master Plan called for the establishment of a Conservation District in order to protect the
existing character of the neighborhood as properties are revitalized or redeveloped.
The proposed ordinance would establish the North Beach National Register
Conservation District Overlay within the Comprehensive Plan Future Land Use Map.
Additionally, the amendment allows for an increase in residential density for properties
with an RM-1 future land use designation within the Overlay. Within the Land
Development Regulations, the North Beach National Register Conservation District
Overlay proposes to reduce the minimum average unit size to 400 square feet from 800
square feet. ln order to ensure consistency between the Comprehensive Plan and the
Land Development Regulations, the amendment proposes to increase the density for the
aforementioned properties to 1 10 dwelling units per acre.
The affected area is primarily built-out with low-scale multifamily buildings which are at
or near their maximum floor area ratio, and as a result many parcels will not be taking
advantage of the increased density. According to the Miami-Dade Property Appraiser's
data, there are approximately 3.30 acres of vacant land within the area. The vacant
parcels represent an estimate of the parcels that will be taking advantage of the
increased density. lf these properties were to develop under current regulations, they
could contain a maximum of 198 dwelling units. With the proposed increase, there could
be a maximum of 363 dwelling units. lt is not expected that the proposed increase will
increase congestion beyond adopted levels of service (See Concurrency Analysis at the
end of this report). However, an individual concurrency review will be required with each
proposed development to ensure that levels of service are not exceeded and that any
potential impacts are mitigated.
Comprehensive Plan lssues
This application includes a text amendment to the Future Land Use element of the
Compressive Plan. Under Section 163.3184(2), F.S., this amendment shall follow the
expedited state review process for adoption of comprehensive plan amendments. This
process requires a public hearing by the local planning agency (Planning Board), a
public transmittal hearing before the City Commission, after which the amendment must
be transmitted to several state agencies for a 30-day review period, and a final adoption
public hearing before the City Commission. The amendment is effective 31 days after it
is adopted if there are no appeals.

lnterlocal Agreement for Public School Facility Planning
The 2005 Florida Legislature adopted laws which are incorporated in the Florida
Statutes, requiring each local government to adopt an intergovernmental coordination
element as part of their comprehensive plan, as well as a statutory mandate to
implement public school concurrency. The proposed amendment increases the
maximum residential density of RM-1 properties within the North Beach National
Register Conservation District Overlay from 60 to 1 10 dwelling units per acre.
For any increase in established residential units, final site plan approval is contingent
upon meeting Public School Concurrency requirements and any applicant will be
required to obtain a valid School Concurrency Determination Certificate (Certificate)
issued by the Miami-Dade County Public Schools. Such Certificate will state the number
of seats reserved at each school level. ln the event sufficient seats are not available, a
proportionate share mitigation plan shall be incorporated into a tri-party development
agreement and duly executed prior to the issuance of a Building Permit.
PLANNING BOARD REVIEW
On November 21, 2017, the Planning Board reviewed the item and transmitted the
proposed Ordinance Amendment to the City Commission with a favorable
recommendation.
CONCLUSION
ln view of the foregoing analysis, the Administration recommends that the City
Commission approve the subject Ordinance at First Reading and set a Second Reading
Public Hearing for February _,2018.
