LTC 422-2025 Monthly Improper Lane Closure Enforcement Update - August 2025MIAMI BEACH OFFICE OF THE CITY MANAGER LTC# TO: FROM: DATE: SUBJECT: LETTER TO COMMISSION Honorable Mayor Steven Meiner and Members of the City Commission Eric Carpenter, City Manager �� October 3, 2025 Monthly Improper Lane Closure Enforcement Update - August 2025 The purpose of this Letter to Commission (L TC) is to provide a monthly update for August 2025, on efforts by the Administration to enhance enforcement of violations against contractors that improperly close lanes on roadways. Pursuant to the direction provided by the Public Safety and Neighborhood Quality of Life Committee (PSNQLC) at their July 9, 2025, Administration is to provide the Mayor and City Commission with monthly updates over a three-month period (August, September, October 2025) regarding the effectiveness of the enhanced enforcement efforts, including data collection and analysis, along with any additional or alternative necessary measures. Lane closures in the City of Miami Beach occur regularly, both by the City and by private entities, to allow for the necessary upkeep of infrastructure and construction of approved structures safely throughout the city. Per City Ordinance, non-emergency lane closures on major roads are restricted to off-peak hours between 10:00 AM and 3:30 PM, minimizing impacts to traffic during high-volume periods (rush hours). Enforcement of lane closures is carried out by various departments. Pursuant to Sec. 82-151, the Parking Department is the primary enforcement authority authorized to issue "Notices of Violation" for unlawful street or sidewalk obstructions. Additionally, the Transportation and Mobility Department has contracted with TransCore to actively monitor citywide traffic conditions in real­ time for 14 hours a day/7 days a week, including holidays, using City, Miami-Dade County (County), Florida Department of Transportation (FOOT), and TransCore-owned cameras. When TransCore staff observe a suspected violation, such as an improper lane closure causing traffic disruption, they notify various city departments, including Public Works, Parking and Code Enforcement to conduct a site inspection, request right-of-way permits from the contractor, and take action, as appropriate. If the violation is confirmed, a Code Enforcement officer may issue citations. The Miami Beach Police Department (MBPD) supports the Parking, Public Works, Code Compliance, and Transportation and Mobility Departments through off-duty personnel conducting proactive site inspections to verify whether lane closures are properly authorized. If not authorized, MBPD officers instruct contractors to reopen the lanes immediately and notify Code 422-2025 Enforcement for inspections and potential citations. In cases where a violation creates an immediate public safety risk, MBPD is authorized to shut it down for public safety. As directed, enhanced enforcement of improper lane closures by the City has been carried out throughout the day citywide with the exception of State or County-owned and maintained roadways to include Alton Road (North of 5th Street), Collins Avenue/Indian Creek Drive, 5th Street, 41st Street and 71st Street (FOOT), as well as Dade Blvd, La Goree Drive, Pine Tree Drive, 23rd Street, and Venetian Way (County). In August 2025, Public Works issued 28 Maintenance of Traffic (MOT) permits that involve significant lane closures. Parking and Code Compliance officers issued 198 right-of-way violations, and two sites were shut down due to public safety concerns. Additionally, MBPD's Off Duty Unit conducted 26 location inspections of possible right-of-way violations in August 2025. All sites visited were found to be in compliance.
