Kennedy Causeway, #3, North Bay Village, Florida 33141; the Town of Bay Harbor Islands("TBHI"), a municipal corporation organized and existing under the laws of the State of Florida, having its principal place of business at 9665 Bay Harbor Terrace, Bay Harbor Islands, Florida 33154; the Town of Surfside ("TS"), a municipal corporation organized and existing under the laws of the State of Florida, having its principal place of business at 9293 Harding Avenue, Surfside, Florida 33154; Bal Harbour Village {"BHV"), a municipal corporation organized and existing under the laws of the State of Florida, having its principal place of business at 655 96`"Street, Bal Harbour, Florida 33154; and the Miami Beach Chamber Education Foundation, Inc., a Florida not-for-profit corporation("MBCEF"), having its principal place of business at 100 16"' Street, Suite 6, Miami Beach, Florida 33139 (individually and/or collectively, the "Parties") to amend that certain Memorandum of Understanding entered into on May 17, 2018(as amended by Amendments No. 1 through No. 7, the"MOU"), ,as follows: RECITALS WHEREAS, the Parties have determined that a program to provide healthcare services to students attending underserviced public schools is in the best interests of the health and public welfare of CMB, NBV, TBHI, TS and BHV (individually and/or collectively, the "Participating Municipalities"); WHEREAS, following the Parties' determination that students at Miami Beach North Beach Elementary, Treasure Island Elementary, and Ruth K. Broad Bay Harbor K-8 Center (individually and/or collectively, the "Participating Schools") did not have full-time on-site healthcare services and were, thus, underserved as compared to other pubtic schools in the feeder pattern that falls within the City of Miami Beach, the Parties entered into a Memorandum of Understanding on August 19, 2013 for a Nurse Initiative, and another Memorandum of Understanding on April 23, 2014, to provide healthcare services to the Participating Schools during the 2013/2014 and the 2014/2015 School Years; WHEREAS, due to the success of the Nurse Initiative during the 2013/2014 and 2014/2015 School Years, the Parties implemented an enhanced nurse initiative ("Nurse Enhancement Initiative") for the 2015/2016, 2016/2017, and the 2017/2018 School Years for the Participating Schools because the basic healthcare services previously funded in the Nurse Initiative by the Participating Municipalities, the MBCEF, and the Children's Trust ("TCT"), were provided by TCT via the new School Health Programs; Page 1 c�f 12 Docusign Envelope ID: E273C4D0-4ECC-47C4-BCFD-78DFBA69C265 Dowsign Envelope ID:2136E321-D543-461C-6613-3FF58CF88A3A WHEREAS, on May 17, 2018, each of the Participating Municipalities and MBCEF executed the MOU for the continuation of the Nurse Enhancement Initiative for the Participating Schoois for the 2018-2019 School Year; WHEREAS, the Parties executed Amendment No. 1 to the MOU, dated December 24, 2018, adding an additional day of service at Ruth K. Broad Bay Harbor K-8 Center; WHEREAS, on September 11, 2019, the Mayor and City Commission adopted Resolution No. 2019-30956, approving Amendment No. 2 to the MOU and approving funding of CMB's contribution for each subsequent School Year, on a recurring basis, subject to funding approval during CMB's budgetary process and provided that CMB's contribution amount does not exceed $15,400.00; WHEREAS, the Parties have extended the Nurse Enhancement Initiative for the Participating Schools through a series of amendments: (a) Amendment No. 2, dated as of September 19, 2019, for the 2019-2020 School Year, (b)Amendment No. 3, dated as of August 19, 2020, for the 2020-2021 School Year, (c) Amendment No. 4, dated as of July 21, 2021, for the 2021-2022 School Year, (d)Amendment No. 5,dated July 26, 2022,for the 2022-2023 School Year, (e) Amendment No. 6, dated July 28, 2023, for the 2023-2024 School Year, and (f) Amendment No. 7, dated as of July 10, 2024, for the 2024-2025 School Year; WHEREAS, due to the continued success of the Nurse Enhancement initiative services, the Parties wish to provide the Nurse Enhancement Initiative for the 2025-2026 School Year; WHEREAS, a Nurse Enhancement Initiative should be established at the Participating Schools for Schooi Year 2025-2026 as herein provided and pursuant ta a separate agreement between MBCEF and TCT; and WHEREAS, MBCEF shall provide funding to TCT for the 2025-2026 Nurse Enhancement Initiative in the amount of�8,750.00. NOW, THEREFORE, in consideration of the mutual promises and conditions contained herein, and other good and valuabie consideration, the sufficiency of which is hereby acknowledged, the Parties agree to amend the MOU as follows: 1. ABOVE RECITALS. The above recitals are true and correct and are incorporated as part of this Amendment. 2. MODIFICATIONS. The MOU is hereby amended (deleted items s�r�s�� and inserted items underlined)as follows: (a) Paragraph 3 of the MOU is hereby amended to read as follows: On or before (�stobe�-�4 October 31, 2025, the Participating Municipalities shall provide their proportionate share of the funds for the�9�4-�9�5 2025-2026 Nurse Enhancement Initiative to MBCEF, subject to budget approval by the Participating Municipalities, which funds MBCEF sha�l hold in escrow pending the execution of its agreement with TCT, referenced in paragraph 1 of the MOU. Broad Bay Harbor K-8 Center; iv) TS shail provide funding in the amount of$10,140 for 2 days of service at Ruth K. Broad Bay Harbor K-8 Center; and vj BHV shall provide funding in the amount of $10,140 for 2 days of service at Ruth K. Broad Bay Harbor K-8 Center. (b) The following Paragraphs 8-11 are hereby added to the Agreement: 8. MBCEF aqrees to complv wfth Section 787.06, Florida Statutes as may be amended from time to time, and has executed the Anti-Human Traffickinq Affidavit containinq the certification of compliance with anti-human traffickinq laws as required bv Section 787 06(13? Ftorida Statutes a copy of which is attached hereto as Exhibit"A". 9. MBCEF warrants and represents that it is not currentiy enqaqed in and wiii not engaqe in a bovcott, as defined in Section 2-375 of the Citv Code. In accordance with Section 2-375.1(2)(a) of the Gitv Code, MBCEF herebvi certifies that MBCEF is not current{v enqaaed in, and for the duration of the Agreement will not enqaqe in a boycott of Israel. 10. MBCEF warrants and represents that within two(2)years prior to the Effective Date, MBCEF has not received compensation for services performed for a candidate for City elected office, as contemplated bv the prohibitians and exceptions of Section 2-379 of the Citv Code. For the avoidance of doubt, the restrictions on contractinq with the Citv pursuant to Section 2- 379 of the Citv Code shali not apply to the following {a) Any individual or entity that provides qoods to a candidate for office. (b) Any individua! or entitv that �rovides services to a candidate for office if those same services are requfariy performed bv the individual or entitv in the ordinary course of business for clients or customers other than candidates for office. This includes without limitation, banks, teleqhone or internet service providers, printinq companies, event venues restaurants, caterers, transportation providers, and office supplv vendors. WHEREAS, in January 2008, the City of Miami Beach (the "City") entered into an Education Compact with the Miami-Dade County Public Schools("MDCPS")to enhance learning opportunities for youth; and WHEREAS, the Education Compact reflects the desire of the Miami Beach community to support excellence in the City's public schools and enhance the health and well-being of the City's youth; and WHEREAS, in the 2012-2013 school year, five of the eight schools in the City's educational feeder pattern had Heaith Connect in Our Schools ("HCIOS") suites which were supported by The Children' s Trust("The Trust")and which provided a full-time Medical Assistant and a shared Registered Nurse on campus; and WHEREAS, for students who do not require routine medications, the HCIOS suites were used for nursing assessments, administration of first aid, and other purposes such as consulting with parents and caregivers; and WHEREAS, the City, North Bay Village, the Town of Bay Harbor Islands, the Town of Surfside, and Bal Harbour Village (collectively, together with the City, the "Participating Municipalities") determined that a program to provide healthcare services to students attending underserviced public schools is in the best interests of the health and public welfare of the Participating Municipalities; and WHEREAS,following the Participating Municipalities'determination that students at North Beach Elementary, Treasure Island Elementary, and Ruth K. Broad Bay Harbor K-8 Center (the "Participating Schools") did not have full-time on-site healthcare services and were, thus, underserved as compared to other public schools in the feeder pattern that falls within the City, the Participating Municipalities and Miami Beach Chamber Education Foundation, Inc. ("MBCEF" together with the Participating Municipalities, the"Parties")entered into the following agreements: Docusign Envelope ID:E273C4D0-4ECC-47C4-BCFD-78DFBA69C265 (i)an MOU on August 19, 2013 for a Nurse Initiative, and(ii)an MOU on April 23, 2014, to provide healthcare services to the Participating Schools during the 2013-2014 and the 2014-2015 school years; and WHEREAS, the Parties implemented an enhanced Nurse Initiative (the "Nurse Enhancement Initiative") for the Participating Schools because the basic healthcare services previously funded in the Nurse Initiative by the Parties were provided by The Trust via the new School Health Programs; and WHEREAS, Resolution No. 2016-29345 authorized the appropriation of$15,400.00 (the "City Contribution")for the Nurse Enhancement Initiative for the 2016-2017 school year from the Miami Beach Education Compact Fund; and WHEREAS, Resolution No. 2016-29468 approved a new Memorandum of Understanding for the implementation of the Nurse Enhancement Initiative during the 2016-2017 school year; and WHEREAS, Resolution No. 2017-29806 approved a new Memorandum of Understanding for the implementation of the Nurse Enhancement Initiative during the 2017-2018 school year; and WHEREAS, on May 17. 2018, the Parties entered into a new Memorandum of Understanding(as amended by Amendment No. 1 through Amendment No. 7, the"MOU")for the implementation of the Nurse Enhancement Initiative for the 2018-2019 school year; and WHEREAS, Resolution No. 2019-30956 approved a City Contribution in an amount not to exceed $13,887.00 for the Nurse Enhancement Initiative for the 2019-2020 school year and a City Contribution in an amount not to exceed $15,400.00, for each subsequent school year, on a recurring basis, subject to funding approval during the City's budgetary process; and WHEREAS, the Participating Municipalities executed Amendment No. 1 through Amendment No. 7 to the MOU to continue funding the Nurse Enhancement Initiative at the Participating Schools for subsequent school years; and WHEREAS, the benefits of this program have expanded to include comprehensive mental and behavioral health services, which have proven to be a critical component of student well- being and academic success; and WHEREAS, based on the success of the program and the increased demand for mental health support, it has become necessary to increase the funding to maintain and enhance these critical services; and WHEREAS, accordingly, the City Manager requests that the Mayor and City Commission do the following: (ij approve an increase in the City Contribution for the Nurse Enhancement Initiative from an amount not to exceed $15,400.00, as set forth in Resolution No. 2019-30956, to an amount not to exceed $19,250.00; (ii) approve an increase of the City Contribution to an amount not to exceed $19,250.00 for each subsequent school year, on a recurring basis, subject to funding approval during the City's budgetary process; (iii) approve, in substantial form, Amendment No. 8 to the MOU, attached to the City Commission Memorandum accompanying this Resolution, for the provision of the Nurse Enhancement Initiative for FY 2026 in an amount Docusign Envelope ID:E273C4D0-4ECC-47C4-BCFD-78DFBA69C265 not to exceed$19,250.00; and (iv)authorize the City Manager and City Clerk to execute any and all required agreements and documents to implement the program, including said Amendment No. 8. BACKGROUNDlHISTORY In January 2008, the City of Miami Beach("the City")entered into an Education Compact with the Miami-Dade County Public Schools ("MDCPS"). This compact was created to enhance leaming opportunities for youth and reflected the Miami Beach communiry's desire to support excellence in its public schools and the health and wefl-being of its youth. Dunng the 2012-2013 School Year, five of the eight schools in the educational feeder pattem had Health Connect in Our Schools(`HCIOS")suites. These suites were supported by The Children's Trust ("The Trust")and provided a full-time Medical Assistant and a shared Registered Nurse on campus. For students who did not require routme medications, the HCIOS suites were used for nursing assessments, first aid, and consultations with parents and caregivers. 285 of 1750 Docusign Envelope ID:E273C4D0-4ECC-47C4-BCFD-78DFBA69C265 The City of Miam� Beach, North Bay Village, the Town of Bay Harbor Islands, the Town of Surfside, and Bal Harbour Village ("Participating Municipalities") determined that a program to provide healthcare services to students attending underserved public schools was in the best interests of the health and public welfare of the Participating Municipalities. They realized that students at North Beach Elementary,Treasure Island Elementary,and Ruth K. Broad Bay Harbor K-8 Center did not have full-time on-site healthcare services and were, therefore, underserved compared to other public schools in the feeder pattem. To address this, the parties ente�ed into a Memorandum of Understanding (MOUj on August 19. 2013, for a Nurse Initiative, and a second MOU on April 23, 2014, to provide healthcare services to these schoots dunng the 2013-2014 and 2014-2015 School Years. Following that initial determination, the parties implemented an enhanced Nurse Initiative to provide the basic healthcare services previously funded by the Participating Municipalities, the Miami Beach Chamber Education Foundation, Inc., and The Trust, were now being provided by The Trust via the new School Health Programs. Resolution 2016-29345 (Attachment A) authorized an appropriation of $15,400 from the Miami Beach Education Compact Fund for the City's proportionate share of funding for the Nurse Initiative. A new MOU for the 2016-2017 School Year was then approved by Resolution 2016- • 29468 (Attachment B), and another new MOU for the 2017-2018 School Year was approved by Resolution 2017-29806(Attachment C).On May 17,2018,the Participating Municipalities entered into a new MOU for the 2018-2019 through the 2024-25 School Years per Resolution 2019-30956 (Attachment D}. The Participating Murncipalities executed amendments 1 through 7 (Attachment E) to the MOU to continue funding mental and behavioral heatth services for students in the participating schools. The benefits of this program have expanded to include comprenensive mental and behavioral health services,which have proven to be a critical component of student well-being and academic success. ANALYSIS Mental health suppo�t was sustained in 2025 with 252 youth receiving a total of 1,370 sessions, up from 131 youths and 7T9 sessions in the previous year. Several schools received telehealth services through a partnership with Hazel Health.
