A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA DIRECTING THE
ADMINISTRATION TO CONDUCT A CITYWIDE SURVEY OF
ABANDONED OR VACANT BUILDINGS, TO AFFIRMATIVELY
IDENTIFY BUILDINGS THAT ARE REQUIRED TO BE LISTED ON
THE ABANDONED AND VACANT PROPERTIES REGISTRY
PURSUANT TO CHAPTER 58 OF THE CITY CODE, ENTITLED
"HOUSING," ARTICLE III, ENTITLED "PROPERTY
MAINTENANCE STANDARDS," DIVISION 4, ENTITLED
"ABANDONED AND VACANT PROPERTIES REGISTRY"; AND
DIRECTING THE ADMINISTRATION TO EDUCATE OR ADVISE
PROPERTY OWNERS OF THE CITY'S REGISTRATION
REQUIREMENTS.
WHEREAS, the City of Miami Beach (the "City") has the authority to enact laws
which promote the public health, safety and general welfare of its citizens; and
WHEREAS, the City has determined that the presence of abandoned and vacant
properties poses a health and safety risk to the citizens of Miami Beach; and
WHEREAS, the City finds that the detrimental effects of abandoned properties
include neighborhood decline, attractive public nuisance, mosquito and animal control
problems, and increased crime; and
WHEREAS, the City additionally finds that abandoned properties contribute to the
degradation of the character and quality of the City' s local historic districts and pose a
threat to the retention of historically and architecturally significant buildings; and
WHEREAS, at the July 29, 2020 City Commission Meeting, the City Commission
adopted Ordinance No. 2020-4345 establishing the Abandoned and Vacant Properties
Registry; and
WHEREAS, the City Commission would like to ensure that compliance with
regulations on abandoned or vacant buildings is consistent to mitigate public nuisances,
promote code compliance, foster economic development, and enhance the character of
local historic districts and other neighborhoods in the City; and
WHEREAS, the City Commission would like to further ensure that property owners
in the City have been sufficiently informed of the requirements set forth in the code relating
to the registration of abandoned or vacant buildings.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby direct the Administration to conduct a citywide survey of abandoned,
vacant, or derelict buildings in order to affirmatively identify buildings already registered
with the City's Abandoned and Vacant Properties Registry, maintained by the Finance
Department, and to identify all unregistered abandoned, vacant, or derelict buildings that
are required to be registered; and further, direct the Administration to educate or advise
property owners of their obligation to register such properties under the City Code.
