A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, ADOPTING AS A 2026 STATE
LEGISLATIVE PRIORITY THE CITY'S OPPOSITION TO ANY STATE
LEGISLATION THAT WOULD PREEMPT OR OTHERWISE
RESTRICT THE CITY'S AUTHORITY TO REGULATE THE USE OF
GAS -POWERED LEAF BLOWERS, CHAINSAWS, AND OTHER
GAS -POWERED LANDSCAPING EQUIPMENT WITHIN THE CITY
OF MIAMI BEACH, TO MITIGATE AIR POLLUTION AND
EXCESSIVE NOISE.
WHEREAS, the City of Miami Beach ("City") has a lengthy history of environmental
stewardship and policymaking to protect the City's natural resources and promote sustainable
development; and
WHEREAS, gas -powered landscaping equipment produces a variety of pollutants that
can be harmful to the environment, including carbon monoxide, hydrocarbons, and particulate
matters; and
WHEREAS, a number of alternatives to gas -powered landscaping equipment exist, such
as portable or plug-in electric leaf blowers, chainsaws, and other landscaping equipment; and
WHEREAS, on June 22, 2022, the Mayor and City Commission adopted Ordinance No.
2022-4495, restricting the use of gas -powered leaf blowers within the City to protect the City's
environment by mitigating air pollution and excessive noise; and
WHEREAS, on February 10, 2024, the Mayor and City Commission adopted Ordinance
No. 2024-4589, restricting the use of gas -powered chainsaws within the City; and
WHEREAS, the City's regulations provided a reasonable phase -in period during which
City staff conducted outreach to inform and educate residents and landscape maintenance
companies of the City's new requirements, and available alternatives to gas -powered equipment.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby adopt as a 2026 State legislative priority the City's opposition to any State
legislation that would preempt or otherwise restrict the City's authority to regulate the use of gas -
powered leaf blowers, chainsaws, and other gas -powered landscaping equipment within the City
of Miami Beach, to mitigate air pollution and excessive noise.
