A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, DIRECTING THE CITY ADMINISTRATION TO
DEVELOP AND IMPLEMENT A STREAMLINED, EFFICIENT, AND
TRANSPARENT PERMITTING SYSTEM SPECIFICALLY FOR POOL DECK
CONSTRUCTION PROJECTS, PROVIDED THAT NO CHANGES SHALL BE
MADE THAT DIMINISH OR COMPROMISE SAFETY REQUIREMENTS,
BUILDING CODE STANDARDS, OR APPLICABLE LEGAL PROTECTIONS.
WHEREAS, the construction of pool decks within the City of Miami Beach requires
applicants to navigate a complex permitting process involving both the Miami -Dade County and
the City of Miami Beach Building Department, including the submission of detailed architectural
plans, property surveys, and compliance documentation; and
WHEREAS, applicants must demonstrate full adherence to the Florida Building Code,
particularly provisions related to pool safety features, structural integrity, and the installation of
required safety barriers and setbacks; and
WHEREAS, the City's Resiliency and Sustainability Code imposes additional
requirements, including strict compliance with setback regulations from property lines and
adjacent structures, which must be reflected in the proposed pool deck design; and
WHEREAS, the placement of pool barriers (fencing) and associated mechanical
equipment must meet specific safety and zoning standards to ensure the protection of residents
and visitors; and
WHEREAS, both residential and commercial property owners frequently encounter
delays, inefficiencies, and confusion during the permitting process, often due to overlapping
jurisdictional requirements, inconsistent review timelines, and a lack of centralized guidance; and
WHEREAS, the City Commission recognizes the need to modernize and simplify the
permitting process to promote responsible development, reduce administrative burdens, and
enhance the overall customer experience for applicants while maintaining the highest standards
of safety and regulatory compliance.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Administration is
hereby directed to develop and implement a comprehensive system to streamline the permitting
process for pool decks, including but not limited to: consolidating review procedures, enhancing
interdepartmental coordination, providing clear applicant guidance, and leveraging digital tools to
improve transparency, efficiency, and compliance, provided that no changes shall be made that
diminish or compromise safety requirements, building code standards, or applicable legal
protections.
